Abstract

Pelaksanaan hak asimilasi bagi narapidana pada masa pandemi covid 19 berdasarkan Permenkum Ham nomor 43 Tahun 2021 di Lapas Kelas IIA Padang dijalankan dengan merujuk padaketentuan hukum yang diawali dengan Permenkum HAM Nomor 10 Tahun 2020 Tentang Syarat Pemberian Asimilasi Bagi Narapidana dan Anak dalam Rangka Pencegahan dan Penanggulangan Penyebaran Covid-19. Ketentuan Permenkum HAM Nomor 10 Tahun 2020 tersebut kemudian dicabut dan digantikan dengan Permenkum HAM Nomor 32 Tahun 2020 yang diubah lagi pertama dengan Permenkum HAM Nomor 24 Tahun 2021 dan perubahan kedua dengan Permenkum HAM Nomor 43 Tahun 2021.Kajian tentang pelaksanaan hak asimilasi dalam upaya pencegahasn penyebaran Covid 19 di Lapas Kelas IIA Padang ditelaah dengan menggunakan pendekatan yuridis normatif dengan spesifikasi penelitian yang bersifat deskriptifyang menggunakan data sekunder sebagai sumber data utama. Teknik pengumpulan data yang digunakan dalam penelitian ini adalah penelitian kepustakaan (libararyresearch dengan analisis data secara kualitatif. Dengan melalui tahap-tahap dan prosedur yang telah diatur dalam ketentuan Menkun Ham nomor 43 tahun 2021. Prosedur juga memperketat persyaratan untuk pemberian hak asimilasi bagi narapidana dalam upaya pencegahan penyebaran Covid 19. Hak asimilasi dan hak integrasi berupa Pembebasan Bersyarat, Cuti Menjelang Bebas dan Cuti bersyarat yang dilakukan dalam upaya pencegahan penyebaran Covid 19 di dalam Lapas menetapkan bahwa bentuk pelaksanaannya dilakukan di rumah narapidana bersangkutan dengan membuat pernyataan bahwa narapidana yang diberikan hak asimilasi akan mematuhi semua persyaratan asimilasi yang ditetapkan dan bersedia untuk tetap berada di rumah selama menjalani masa asimilasi. Pelaksanaan asimilasi tersebut dijalankan secara bersamaan dengan pelaksanaan hak integrasi yang dapat berupa Pembebasan Bersyarat, Cuti Menjelang Bebas ataupun Cuti Bersyarat. Pelaksanaan asimilasi yang dijalankan di rumah dan bersamaan pengeluarannya dalam rangka pencegahan penyebaran Covid 19 ini lebih dikenal dengan sebutan asimilasi rumah.

Abstract

The investigation into the destruction of Ema Idham's heritage building by PPNS at BPK West Sumatra is governed by Article 66 Paragraph (1) of Law No. 11 of 2010 concerning Cultural Heritage. It states that everyone is prohibited from damaging cultural heritage, whether in whole or in part, from the unit, group, or original location. The research questions are: 1) How is the investigation of the criminal act of destroying Ema Idham's cultural heritage building by PPNS at BPK West Sumatra conducted? 2) What are the obstacles faced during the investigation of this crime? 3) What efforts are being made to overcome these obstacles? This study uses a sociological-legal approach and a descriptive method. The findings are: 1) The investigation met the elements of the crime of destroying cultural heritage, but legal proceedings faced challenges because the Padang District Court canceled the suspect’s status through a pre-trial decision. 2) Obstacles include limited witnesses, investigator capabilities, and PPNS officials at BPK West Sumatra. 3) To address these issues, efforts include increasing community awareness to gather witnesses, enhancing cooperation among PPNS officials, and improving capacity through training and discussion forums.

Abstract

Article 1 of Law Number 23 of 2004 concerning the elimination of domestic violence, states that every act against someone, especially women, which results in physical, sexual misery and/or domestic neglect, including threats to commit acts, or deprivation of liberty is against the law in household sphere. The formulation of the problem in this research is: How is the investigation of criminal acts of domestic violence at Padang Police: LP/B/601/IX/2023 SPKT/Padang Police? . What are the obstacles in investigating criminal acts of domestic violence at the Padang Police LP/B/601/IX/2023 SPKT/Padang Police? How are efforts to overcome obstacles in investigating criminal acts of domestic violence LP/B/601/IX/2023/SPKT Padang Police? The problem approach used is a sociological juridical approach, namely looking at the facts in the field and linking them to applicable law. The results of this research are the implementation of investigations into criminal acts of domestic violence committed by husbands against wives in the jurisdiction of the Padang Police LP/B/601/IX/2023/SPKT Padang Police). The results of the research were a report from the victim to the PPA Unit of the Padang Police, after which the police carried out an investigation by investigators, then continued with the investigation, after finding the perpetrator the investigators made an arrest, then investigators carried out a search, confiscation and detention at the Padang Police for 20 days from 11 September to 01 October 2023, then investigators carried out examinations of the suspects until the case files were handed over to the prosecutor's office. Obstacles in investigating criminal acts of domestic violence committed by husbands against wives in the jurisdiction of Padang Police LP/B/601/IX/2023/ SPKT/ Padang Police) are the lack of competent investigation personnel in the PPA Unit, not having a safe house for victim. The effort to overcome obstacles in investigating criminal acts of domestic violence committed by husbands against wives in the jurisdiction of the Padang Police LP/B/601/IX/2023/SPKT Padang Police) is to propose additional personnel, entrusting them to the victim's parents' house.

Abstract

Narcotics are a type of drug/substance used in the world of medicine, but if used without restrictions and careful supervision, it can cause dependence and endanger health to the point of destroying the user's soul. The implementation of the investigation into drug abuse carried out by the South Solok Police Investigators did not run smoothly and experienced several obstacles. The problems discussed. The approach used is a descriptive sociological juridical approach that presents data in accordance with the facts systematically and logically according to the research objectives. The results of the study can be concluded with the following problems:1. There is a report from the community and witnesses are examined, then the suspect is arrested and after sufficient evidence is obtained and the suspect is detained and evidence is confiscated, and the suspect is examined and a report is made and handed over to the public prosecutor. 2. The obstacles faced by investigators are the occurrence of mistaken arrests of suspects, lack of facilities and infrastructure, Suspects are difficult to find because suspects make transactions by moving from place to place, making it difficult for investigators to find suspects. 3. Efforts to overcome obstacles in the investigation are that investigators must be more observant and careful in the arrest process so that there is no mistake in mistakenly arresting suspects with other members of the public, The second way is that the South Solok Police must improve the facilities and infrastructure to conduct investigations, and in overcoming the lack of facilities used by investigators to find other ways, namely by using local community vehicles to continue the arrest, and to overcome the occurrence of mistaken arrests of suspects, namely by dividing groups and scattering in the search for the suspect.

Abstract

An investigation is a series of actions by investigators, in accordance with the procedures stipulated in this Law, to seek and collect evidence and identify suspects.The problem formulation is: How is the investigation of children as perpetrators of bullying at SDN 10 Durian Jantung? What are the obstacles to the investigation of children as perpetrators of bullying at SDN 10 Durian Jantung? How are obstacles to the investigation of children as perpetrators of bullying at SDN 10 Durian Jantung? This research method uses a sociological legal approach with a descriptive nature. The types and sources of data use primary and secondary data. Primary legal materials, secondary legal materials, and tertiary legal materials. Data collection techniques use document studies and interviews. Data processing uses editing and coding, and data analysis uses qualitative methods.The results of this study are: The reported party or child in conflict with the law (ABH) cannot be arrested, searched, detained, or questioned because they are still 10 years old. Law Number 11 of 2012 concerning the Juvenile Criminal Justice System states that children who can be held criminally responsible are those aged 12 but under 18.Children under 12 years of age were returned to their parents.The investigation encountered obstacles, including the failure to find evidence, as the gasoline bottle caught fire. Efforts to overcome these obstacles included investigators incorporating the missing evidence into the search and shifting to gathering other evidence by interviewing witnesses, which was deemed more strategic and easier, to allow the investigation to continue.
