Abstract

AbstractOne example of the problems in the state's claim is BLBI extended by Bank Indonesia to the national banking system, which has become the state's claim, but not resolved through PUPN, but further right to claim the government handed over to IBRA established by Presidential Decree No. 27 of 1998 . Since handed over to the government the right to collect BI, BI ended authority to withdraw BLBI of the receiving bank, resolved through non-litigation and mechanisms and the solution was not to use repressive laws. Receivables BLBI state is a case of default the unusually large number (extraordinary default), but penyelesaianya by IBRA implemented with the exclusion of the legal principles of the settlement of accounts receivable against the debtor country BLBI receiver, so in this case the journey is also a cost for settling disputes outstanding a big. This paper would like to see how the practice of politicizing the constitution that happens particularly with respect to issues of State receivables.AbstrakSalah satu contoh kasus persoalan dalam piutang negara adalah kasus BLBI yang disalurkan oleh Bank Indonesia kepada perbankan nasional, yang sudah menjadi piutang negara, namun tidak diselesaikan melalui PUPN, akan tetapi selanjutnya hak tagih tersebut diserahkan pemerintah kepada BPPN yang dibentuk berdasarkan Keppres Nomor 27 Tahun 1998. Sejak diserahkan hak tagih BI kepada pemerintah, berakhirlah wewenang BI untuk menarik kembali BLBI dari bank penerima, diselesaikan melalui jalur dan mekanisme non-litigasidan penyelesaiannya pun tidak menggunakan hukum represif. Piutang negara BLBI adalah kasus gagal bayar yang jumlahnya luar biasa besar (extraordinary default), akan tetapi penyelesaianya oleh BPPN dilaksanakan dengan mengesampingkan prinsip-prinsip hukum penyelesaian piutang negara terhadap debitur penerima BLBI, sehingga dalam perjalanannya kasus ini juga menelan biaya penyelesaian perkara yang luar biasa besar. Tulisan ini ingin melihat bagaimana praktek politisasi konstitusi itu terjadi khususnya terkait dengan masalah piutang Negara.

Abstract

Bank Indonesia has been established as a central bank that develops dual monetary policy. This paper identifies the challenges faced in Islamic financial policy that are different from other monetary policies. With a historical approach to law it can be concluded that there is still an opportunity for BI to develop Islamic finance in Indonesia by reinforcing its basic philosophy of returning to the real economy in the gold standard. Some suggestions for the implementation of the technical treatment of finance have been raised, but there is a need to accompany the implementation by stabilizing all Islamic-oriented central bank laws.

Abstract

This study examines what the Indonesian government has done after the declaration of the COVID-19 outbreak as PHEIC by WHO in terms of regulations and regulations. Abstract

This study identifies the religious awareness of informal sector tourism actors participating in the Malioboro Mengaji program in Yogyakarta. Qualitative descriptive research with a phenomenological approach is useful for getting a natural overview and views of informants. The data were collected by participatory observation and in-depth interviews. Most of the informants were middle-aged who had tasted the acid of life including all forms of deviations from religious teachings. The passage of age encourages the search for inner and outer happiness. One of them is by learning the Koran. The initial motivation behind the various participants experienced changes along with participation in the Al Quran reading training. The desire to realize a lighter life burden and peace of mind with a sense of pride in being able to directly read the Islamic holy book that is the guide of his life.

Abstract

History notes that America has gotten two giant economic crises both the Great Depression of 1930s and the Financial Crisis of 2008’s. On August 15, 1971 the United States Dollar went down drastically. Without Congressional approval, President Nixon ended the coinage between the United States Dollar and the gold. Consequently the dollar becomes Monopoly Money. After that, the biggest economic boom in history has begun. In 2009, when the economy ran aground, Central Bankers in the world created trillion dollars, yen, pesos, euros and pounds by following a monopoly for bankers.1 The concept has changed to the present time. The distribution of money has become a concept of debt in various forms, including the use of money as a capital instrument. The main contributors to capital in Islamic trade traffic (muamalah) are economic real, not loans (non-loans), actors who direct money used for business capital are concentrated in the form of financing, but after the end of the Gold standard (fiat money), how far the meaning of financing can fulfill justice based on Islamic economics. The concept of the Bank is any camouflage with the money industry, and it is not clear enough, exactly the difference between the Bank and Islamic nuances, because all financial industries are under one container, namely the interest-base central bank. In short, Islamic banking with a financing system, while conventional banking with a loan system. Two different central banks are greatly  needed.

Abstract

This study aims to examine using a structural approach regarding the institutional scope of world bodies in manifesting Acturian Actors in the context of global children's rights as a strengthening of regulations on sustainable custody that must be applied by every member country of the United Nations in responding to the lives of orphans who are victims of the pandemic. covid-19. With a structural and qualitative approach, it can be concluded that the pattern of handling tends to use a pattern of disaster management which is feared to prolong the uncertainty of the substance of the ongoing responsibility for orphans who are victims of Covid 19.

Abstract

Permasalahan hukum di dunia kenotariatan kerap melibatkan pertanggungjawaban pidana Notaris terkait akta partij yang dibuat sesuai prosedur tetapi kemudian terindikasi tindak pidana penipuan. Penelitian ini bertujuan untuk menganalisis tanggung jawab pidana Notaris atas akta partij yang dibuat secara sah berdasarkan putusan pengadilan, serta mengkaji kekuatan hukum akta tersebut jika Notaris dinyatakan bersalah. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan studi kasus yang relevan. Hasil penelitian menunjukkan bahwa Notaris dapat dimintai pertanggungjawaban pidana jika terbukti secara langsung terlibat dalam tindak pidana dan melanggar ketentuan Undang-Undang Jabatan Notaris (UUJN). Putusan Hakim Mahkamah Agung yang menjatuhkan hukuman pidana satu tahun penjara berdasarkan bukti kesaksian di luar akta dan menganggap Notaris membuat akta atas kehendak sendiri (akta ambtelijk). Selain itu, akta yang dibuat oleh Terdakwa Notaris telah sesuai prosedur UUJN tetap mengikat para pihak dan sah sebagai akta otentik. Penelitian ini merekomendasikan perlunya kebijakan hukum untuk memperjelas batas hukum pertanggungjawaban Notaris, dan pengawasan yang profesional guna menjaga integritas seorang Notaris.

Abstract

This article examines the concept of "dark law" — the manipulative actualization of law that operates in opaque spaces and times — and its implications for certainty, justice, and order. Law comprises three essential elements: certainty (nature), justice (function), and order (purpose). When legal manifestations (statutes, regulations, and practices) lose one or more of these elements, they become "dark law." Using normative legal research and theoretical reflection, this paper describes how dark spaces and periods facilitate legal manipulation, enabling illicit transactions and undermining public trust. The article argues for institutional transparency and civic oversight to prevent the rise and entrenchment of dark law.
