Abstract

Mediation has a confidentiality principle as an advantage that should be able to safeguard the reputation of the disputing parties. Still, mediation arrangements in district courts are influenced by the principle of open trial to the public, causing problems, which are; how is the confidentiality principle-based mediation arrangement in district courts in providing protection for the reputation of the party in the dispute and how efforts to reform mediation arrangements in court to realize the confidentiality principle in settlement of civil cases in district courts which is oriented towards legal protection of the reputation of the litigant by using normative legal research that uses primary, secondary and tertiary legal materials collected by document study and then analyzed using descriptive, comparative, evaluative and argumentative techniques. The conclusion is that the mediation procedure in court is regulated by the Supreme Court Regulation Number 02 of 2003 then replaced by the Supreme Court Regulation Number 01 of 2008. Finally, the Supreme Court Regulation Number 1 of 2016 has regulated the principle of confidentiality but has not fully regulated the principle of confidentiality so that efforts are needed. Regulations on mediation experience law unification and reformation of the civil procedural law. The House of Representatives and the government form a special law to regulate mediation to become the legal basis for laws and regulations that use mediation.

Abstract

AbstrakTujuan Penelitian ini ialah untuk menjelaskan para pihak yang berperkara perdata di pengadilan wajib mengikuti mediasi dengan itikad baik namun ada juga pihak yang tidak mengikuti mediasi dengan itikad tidak baik. Itikad tidak baik mempunyai bentuk-bentuk yang telah diatur dalam Pasal 7 ayat (2) Peraturan Mahkamah Agung Nomor 1 Tahun 2016 tentang Mediasi di Pengadilan. Perbuatan tidak beritikad baik dalam mediasi akan mempengaruhi jalannya proses mediasi karena mengakibatkan tidak lancarnya proses mediasi sehingga mediasi dapat menjadi gagal. Kegagalan mediasi banyak ditemukan dalam praktek mediasi di pengadilan seperti pihak yang mempublikasikan mediasi tanpa kehendak pihak lain. pihak yang telah mempublikasikan mediasi tanpa kehendak pihak lain yang mengakibatkan kegagalan mediasi menimbulkan permasalahan apakah pihak yang telah mempublikasikan materi mediasi tanpa kehendak dari pihak lain dapat dijadikan kriteria sebagai bentuk pihak yang tidak mempunyai itikad tidak baik dan bagaimanakah akibat hukum terhadap para pihak yang tidak beritikad baik dalam mediasi?. Untuk menjawab permasalahan maka digunakan penelitian hukum normatif. Berdasarkan hasil penelitian  bahwa  pihak dalam mediasi yang telah mempublikasikan materi mediasi tanpa kehendak dari pihak lain seharusnya dapat menjadi bentuk perbuatan yang tidak beriktikad baik karena tidak sesuai dengan ketentuan Pasal 5 Peraturan Mahkamah Agung Nomor 1 Tahun 2016 tentang Mediasi di Pengadilan dan berdasarkan Peraturan Mahkamah Agung Nomor 1 Tahun 2016 tentang Mediasi di Pengadilan, Pengugat dan para pihak yaitu penggugat dan tergugat secara bersama-sama tidak mempunyai itikad baik menimbulkan akibat hukum terhadap putusan akhir yaitu putusan dengan gugatan dinyatakan tidak dapat diterima oleh Hakim Pemeriksa Perkara sedangkan tergugat yang tidak beritikad baik dikenai kewajiban pembayaran mediasi. Kata kunci : Mediasi, Itikad Baik, Perkara Perdata.AbstrakThe purpose of this study is to explain that parties to civil litigation in court are obliged to participate in mediation in good faith, but there are also parties who do not participate in mediation in bad faith. Bad faith has forms that have been regulated in Article 7 paragraph (2) of Supreme Court Regulation Number 1 of 2016 concerning Mediation in Courts. Acts of not having good faith in mediation will affect the course of the mediation process because it results in the mediation process not running smoothly so that mediation can fail. Mediation failures are often found in mediation practices in courts such as parties who publish mediations without the will of the other party. parties who have published mediation without the will of the other party resulting in mediation failure raises the issue of whether the party who has published mediation material without the will of the other party can be used as a criterion as a form of a party that does not have bad faith and what are the legal consequences for the parties who do not have good faith in mediation? To answer the problem, normative legal research is used. Based on the results of the study, a party in mediation who has published mediation material without the will of the other party should be a form of action that is not in good faith because it is not in accordance with the provisions of Article 5 of Supreme Court Regulation Number 1 of 2016 concerning Mediation in Courts and based on Supreme Court Regulation Number 1 of 2016 concerning Mediation in Courts, the Plaintiff and the parties, namely the plaintiff and the defendant jointly did not have good faith resulting in legal consequences for the final decision, namely the decision with a lawsuit was declared unacceptable by the Case Examining Judge while the defendant who did not have good intentions was subject to the obligation mediation payment. Keywords: Mediation, Good Faith, Civil Cases
