Abstract

As the queen of the family, the wife is a determinant of household harmony who understands every detail of her domestic realm. But in fact, several social traditions and norms under the guise of religion limit the space for wives to move in their palaces. This study aims to reveal Husein Muhammad's thoughts on domestic rights in the household and to analyze his mindset in doing istinbath. The method used is literature study in the study of thought. This descriptive qualitative research used the main data sources in the form of two books by Kyai Husein, namely: (1) Women's Fiqh: Kyai's Reflections on the Interpretation of Religious and Gender Discourses published by LKiS in 2019; and (2) Islam, Religion Friendly to Women: Defending Kyai Pesantren, published by LKiS in 2009. Data collection techniques tend to be qualitative with literature documentation techniques. Therefore, an analysis of Kyai Husein's istinbath mindset was carried out using a deductive mindset approach. The results of this study are: (1) The wife has several domestic rights in the household, including the right to support, the right to be the head of the household, the right to express an opinion, the right to mu'asyarah bi al-ma'ruf, and the right to get health services; (2) The mindset of Kyai Husein Muhammad in determining legal istinbath departs from the postulates of sharia with cultural contextualization which then gave birth to the principles of justice and human equality, the concept of sharia as a cultural reflection, and emancipatory jurisprudence.

Abstract

Hyperlipidemia is one of the non-communicable diseases which is the top 10 leading causes of death globally. The prevalence of hyperlipidemia in Indonesia in the 25-34 year age group is 9.3% and in the 55-64 year age group it has increased to 15.5%. The geographical conditions of Karangnongko Village are favorable for the growth of Moringa plants, so that many Moringa plants grow in residents' yards. For this reason, the KKM 135 team at UIN Maulana Malik Ibrahim Malang held counseling and training activities for women from the PKK driving team to improve the health status of the Karangnongko village community by making nutraceutical products Moringa dimsum. This activity is carried out using lecture methods, discussions, and direct practice through training. The results of community service activities show that the community does not know about hyperlipidemia. With counseling and training in the manufacture of nutraceutical products, the public knows more about hyperlipidemia and nutraceutical products as new innovations. After being given the material, the community began to understand hyperlipidemia and the nutraceutical product Moringa Dimsum as a way to prevent it.

Abstract

Problem wali adhal telah marak di Indonesia saat ini, khususnya di Pengadilan Agama Gresik, hal ini dibuktikan dengan ditemukan banyak kasus wali adhal yang masuk pada tahun 2020-2021. Sebanyak 25% perkara diantaranya, alasan wali tidak mau menikahkan karena menganggap calon suami dari perempuan di bawah perwaliannya tidak sekufu padahal dalam Islam alasan tersebut dibenarkan namun mengapa majelis hakim terkesan selalu mengabulkan. Penelitian ini menggunkan prespektif maqasid syariah Jasser Auda untuk mengukur kemaslahatannya. Tujuan penelitian ini adalah menjelaskan latar belakang pengajuan perkara wali adhal dan ratio decidendi hakim dalam penetapan perkara wali adhal dengan alasan tidak sekufu di PA Gresik pada tahun 2020-2021 prespektif maqasid syariah. Penulis menggunakan jenis penelitian Yuridis Normatif dengan menggunkan pendekatan penelitian kasus (case approuch). Hasil dari penelitian ini menyimpulkankan bahwa: latar belakang pengajuan perkara wali adhal di Pengadilan Agama gresik kebanyakan didominasi dengan alasan calon suami tidak sekufu. Ratio decidendi majelis hakim adalah banyak wali nikah yang tidak hadir dalam persidangan sehingga sulit untuk mendapat keterangan dan antara calon pengantin tidak ada halangan syar’i untuk menikah. Penetapan wali adhal dengan alasan tidak sekufu yang telah dianalisis sudah sejalan dengan konsep maqasid syari’ah yang digagas oleh Jasser Auda dilihat dari aspek penyesuaian konteks waktu dan kultur budaya di Indonesia.

Abstract

Islamic marriage rules in practice form values that are lived out and practiced in the context of cultural society so that they emerge as symbols as a form of the dialectical process between religious values and cultural values. As an example of the concept of dowry in Islam which has two dimensions, the universality of the values adhered to by all its adherents and also the value locality that is formed from the dialectical process that occurs between religious teachings and the local culture of the adherents. This was seen in the santri community in Karangbesuki Village, Malang City in determining the dowry in their marriage by identifying aspects of the normative dowry in the fiqh that they embraced into their marital culture.

Abstract

The practice of lavender marriage, which is motivated by one party's dishonesty regarding their sexual orientation, has significant psychological and social consequences for the couple. However, to date, there are no regulations that explicitly govern and provide legal protection against this practice, so it has not been dealt with optimally. This article aims to review legal regulations related to psychological sexual violence in order to formulate a direction for legal reform that can respond to the practice of lavender marriage. This study uses a normative-qualitative method with a document study approach to interpret Article 4 paragraph (2) letter d of the Sexual Violence Criminal Law (TPKS Law) through a progressive legal perspective. The results of the study show that this article can be interpreted more broadly as a form of psychological sexual violence that includes the practice of lavender marriage and various other forms of non-conventional sexual violence. Thus, the application of progressive law encourages the law not to stop at normative texts, but to function adaptively and humanistically in responding to the needs of substantive justice and realising justice and community welfare

Abstract

The ngarunghal tradition is a customary practice in Sundanese society that regulates the prohibition of a younger sibling marrying before their older sibling without a certain form of respect. This study aims to analyse the function of the ngarunghal tradition as living law in the Miduana Traditional Village community and to examine this practice from the perspective of legal anthropology and maslahah mursalah theory. This study uses empirical research methods with a legal anthropology approach and is qualitative in nature. Data was obtained through field observations, in-depth interviews with traditional leaders, community leaders, and practitioners of the ngarunghal tradition (older siblings, younger siblings, and immediate family), as well as supporting documentation. The results show that the ngarunghal tradition functions as a customary norm that regulates family relations and maintains social harmony through a mechanism of deliberation and family agreement, including in determining the form and amount of gifts to be given to the older sibling who is being bypassed. This practice is adhered to by the community, mainly to avoid taboos and customary sanctions known as kabadi or katulak, which are understood as symbolic consequences for violating customs. From a legal anthropology perspective, belief in these sanctions acts as an effective social control mechanism, even though it is not formal in nature. From the perspective of maslahah theory, the ngarunghal tradition contains social benefits that are hajiyyah and 'ammah in nature, as it aims to maintain order, family harmony, and social balance in the community. However, this study also found the potential for a shift from benefit to injustice if the demands for gifts do not take into account the economic capacity of the younger sibling. Therefore, the ngarunghal tradition remains relevant to be preserved as long as it is carried out based on the principles of deliberation, fair agreement, and does not cause harm.

Abstract

This study aims to analyze the pillars and conditions of marriage from the perspectives of Islamic jurisprudence (fiqh) and Egyptian positive law, and to compare them within the framework of contemporary Islamic family law. The focus of the analysis is directed at identifying both the differences and similarities in the views of Islamic legal schoolsparticularly the Hanafi schooland the regulation of marriage law in Egypt, which has undergone processes of codification and modernization. This research employs a normative legal research method with a comparative approach, drawing upon classical fiqh literature, Egyptian statutory regulations, and relevant contemporary scholarly works. The findings indicate that Egyptian marriage law substantively adopts the principles of Hanafi fiqh, while simultaneously introducing adjustments through the establishment of a minimum age for marriage, the mandatory registration of marriage, and the strengthening of legal protection for women and children. From a comparative perspective, it can be concluded that Egyptian marriage law represents a model of integration between Islamic legal norms and modern state law. Therefore, an integrative approach that combines madhhab-based fiqh, maqāṣid al-sharī‘ah, and the demands of positive law is essential to maintain the relevance and legitimacy of Islamic family law in addressing contemporary social challenges.
