Abstract

Kekayaan Intelektual adalah suatu hasil kegiatan berdaya cipta pikiran manusia yang diungkapkan ke dunia luar dalam suatu bentuk, baik material maupun immaterial. Kekayaan dibagi menjadi dua yakni Kekayaan Intelektual dengan kepemilikan personal, dan Kekayaan Intelektual dengan kepemilikan komunal. Kekayaan Intelektual Komunal (KIK) memiliki ciri khas yaitu bersifat kebersamaan, dalam arti bahwa keuntungan dan kepentingan yang diprioritaskan adalah kepentingan banyak orang. Kecamatan Bandungan yang berada di Kabupaten Semarang merupakan salah satu daerah yang kaya akan obyek wisata baik wisata alamnya yang sangat menarik, wisata budaya, peninggalan sejarah, sejarah teknologinya, maupun keanekaragam sumber daya alamnya, salah satunya ialah kesenian budaya di Kelurahan Bandungan berupa tarian dan alat musik, sedangkan di Desa Jetis mempunyai potensi dan inovasi produk berupa sabun mandi dan shampoo, begitu juga dengan desa lain di Kecamatan Bandungan yang mempunyai potensi KIK yang dapat didaftarkan sebagai Indikasi Geografis serta hasil Ekspresi Budaya Tradisionalnya. Berdasarkan hal tersebut, penting adanya perlindungan dan pemahaman lebih lanjut bagi Perangkat Desa dan Masyarakat Kecamatan Bandungan terkait Kekayaan Intelektual Komunal yang tersebar di wilayahnya, agar ke depannya Perangkat Desa dapat lebih tanggap dalam melakukan identifikasi serta inventarisasi untuk setiap Kekayaan Intelektual Komunal demi menghindari terjadinya sengketa/konflik antar anggota masyarakat desa/daerah lain yang disebabkan oleh saling klaim kepemilikan atas suatu Kekayaan Intelektual Komunal. Hasil penyuluhan serta pendampingan memberikan pengembangan wawasan tentang pentingnya dilakukan identifikasi serta inventarisasi kebudayaan yang termasuk dalam Kekayaan Intelektual Komunal. Rekomendasi yang dapat disampaikan adalah diperlukan pembinaan dan pendampingan lebih lanjut kepada para masyarakat serta perangkat desa di Kecamatan Bandungan dalam kaitannya dengan pentingnya dilakukan identifikasi serta inventarisasi suatu Kekayaan Intelektual Komunal.

Abstract

One of the important components of consumer rights protected by Law Number 8 of 1999 concerning Consumer Protection is after-sales service, such as the availability of spare parts and repair services. Consumers can suffer losses due to the loss of access to these services when the manufacturer or official distributor ceases operations. Consumer rights that should be obtained often cannot be fully implemented and fulfilled. Consumers are often the most disadvantaged parties due to the negligent practices of companies. By examining case studies of car manufacturers that have ceased operations in Indonesia, this study uses a juridical-empirical methodology. Based on the research findings, consumers are in a weak position to obtain protection or compensation due to the legal vacuum. Therefore, it is necessary to strengthen regulations and long-term responsibility mechanisms from business actors to ensure the continuity of after-sales services even though the business entity has ceased operations.

Abstract

The presence of digital banks in Indonesia has also raised issues related to high-interest deposits that exceed the limits stipulated by the Deposit Insurance Corporation (LPS). This risks harming customers if the bank defaults, goes bankrupt, or goes into liquidation. Therefore, it is important to examine the legal provisions of digital banks and legal protection for customers for these deposits. This research is normative with a qualitative approach, using secondary data analyzed through literature studies. The results of the study show that the provisions regarding digital banks have been regulated in POJK Number 12/POJK.03/2018 and POJK Number 12/POJK.03/2021, but are still limited to the POJK level which has lower legal force, so strengthening is needed through special laws. Legal protection for customers is regulated preventively through Law Number 8 of 1999 and POJK Number 6/POJK.07/2022, as well as repressively through complaint and compensation mechanisms. However, this protection is not yet optimal because there are no specific regulations requiring digital banks to provide clear information regarding deposits that are not guaranteed by LPS and the absence of effective sanctions for transparency violations.

Abstract

ABSTRAK Kemajuan teknologi informasi dan komunikasi (TIK) telah mengubah berbagai aspek kehidupan modern, termasuk komunikasi dan pengelolaan data pribadi. Meskipun teknologi digital menawarkan kemudahan akses informasi dan efisiensi operasional, muncul ancaman baru yang mempengaruhi hak individu, terutama dalam keamanan siber. Ancaman seperti pencurian data, pelanggaran privasi, dan serangan siber semakin umum dan kompleks, memerlukan perhatian dan tindakan yang tepat.Metode penelitian ini menggunakan pendekatan analisis hukum dan studi kasus. Data dikumpulkan melalui analisis dokumen hukum, peraturan yang berlaku, serta studi kasus terkait pelanggaran data pribadi. Teknik analisis yang diterapkan adalah analisis kualitatif untuk mengevaluasi efektivitas regulasi dan memberikan rekomendasi perbaikan.Pembahasan mencakup analisis kualitatif terhadap regulasi hukum perdata yang ada dan efektivitasnya dalam menghadapi ancaman teknologi. Studi kasus pelanggaran data pribadi di Indonesia menunjukkan kekurangan dalam sistem hukum, seperti keterlambatan proses hukum dan penegakan yang lemah. Rekomendasi untuk perbaikan termasuk penyusunan regulasi baru dan penambahan ketentuan spesifik untuk perlindungan data pribadi.Hukum perdata perlu beradaptasi dengan cepat untuk menghadapi ancaman yang ditimbulkan oleh kemajuan teknologi, seperti pencurian data dan pelanggaran privasi. Regulasi yang ada saat ini sering kali tidak memadai untuk melindungi hak-hak individu, sehingga diperlukan pembaruan regulasi untuk memberikan perlindungan yang lebih efektif. Penelitian ini menekankan pentingnya mengkaji ulang dan memperbarui regulasi hukum perdata agar dapat mengakomodasi perubahan teknologi dan melindungi hak individu di era digital. Abstract

Artificial Intelligence (AI) is reshaping the legal profession by enhancing research speed, document review, and case analysis. Yet, its integration also raises pressing concerns over accountability, data privacy, and ethical standards. This study addresses the research problem: How should Indonesia regulate AI in law to balance innovation with justice and human rights? Three guiding questions inform the analysis: (1) What is the extent of AI adoption by Indonesian legal practitioners? (2) What legal and ethical risks arise? (3) What regulatory responses are most suitable for Indonesia’s plural legal context? Adopting a socio-legal methodology, data were collected through literature review, in-depth interviews, and an online survey of 102 practitioners. Findings show that 38% of respondents currently use AI tools, mainly for legal drafting and research, but skepticism persists. Advocates in Semarang reported errors in AI-generated contracts, illustrating unresolved accountability gaps under existing laws. Judges highlighted risks of bias and opacity if AI expands into case management without safeguards. The novelty of this research lies in its empirical evidence: it is the first Indonesian study to combine practitioner perspectives with regulatory analysis, moving beyond conceptual debates. By linking adoption patterns to deficiencies in the ITE Law, PDP Law, and PERMA No. 1/2019, the study reveals concrete vulnerabilities in legal practice. The study concludes that interim sectoral measures such as PERADI guidelines and judicial ethics updates are urgently needed while developing a comprehensive AI law. Responsible governance is essential to ensure AI strengthens, rather than undermines, fairness, transparency, and the rule of law.

Abstract

Perkembangan teknologi digital telah memberikan kemudahan bagi kreator untuk menghasilkan karya, namun juga memunculkan potensi pelanggaran hukum, khususnya terkait hak cipta. Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap hak cipta atas lagu yang dicover tanpa izin oleh kreator digital, serta mekanisme penyelesaian sengketa atas pelanggaran tersebut. Metode yang digunakan adalah yuridis normatif dengan pendekatan studi kepustakaan dan studi kasus, dianalisis secara deskriptif-kualitatif. Hasil penelitian menunjukkan bahwa tindakan meng-cover lagu tanpa izin dan mengunggahnya ke platform digital melanggar hak moral dan ekonomi pencipta sebagaimana diatur dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Perlindungan hukum diberikan melalui upaya preventif dan represif, sedangkan penyelesaian sengketa dapat dilakukan melalui jalur litigasi maupun non-litigasi. Kasus antara Tri Suaka dan Zinidin Zidan dengan Erwin Agam menjadi contoh konkret dalam kajian ini. Diperlukan kolaborasi antara pemerintah, Lembaga Manajemen Kolektif Nasional (LMKN), platform digital, dan para kreator untuk menciptakan ekosistem digital yang adil, berkelanjutan, dan menghormati hak kekayaan intelektual.

Abstract

Hak cipta memiliki peran penting dalam melindungi karya intelektual, terutama di era digital yang memungkinkan distribusi tanpa batas. Penelitian ini mengkaji putusan Pengadilan Niaga Jakarta Pusat No. 92/PDT.SUS-HKI/CIPTA/2024 terkait pelanggaran hak cipta lagu “Bilang Saja” oleh Agnes Mo, serta menilai efektivitas sistem direct licensing Lembaga Manajemen Kolektif Nasional (LMKN) dalam menegakkan hak pencipta. Metode yang digunakan adalah yuridis normatif deskriptif, dengan analisis peraturan dan literatur hukum. Hasil menunjukkan bahwa bahwa pengadilan membebankan tanggung jawab hukum kepada artis berdasarkan asas due diligence dan sistem perizinan langsung, tanpa mempertimbangkan prinsip vicarious liability yang menempatkan tanggung jawab utama pada penyelenggara acara (EO). Temuan ini menguatkan hak moral pencipta, namun berpotensi menimbulkan efek penundaan (chilling effect) bagi artis dalam pemanfaatan komersial karya. Untuk memperkuat kepastian hukum dan distribusi royalti yang adil, direkomendasikan revisi PP No. 56/2021 untuk memperjelas pembagian tanggung jawab antara event organizer dan artis serta pengembangan sistem terintegrasi yang menghubungkan data direct licensing dan kolektif.

Abstract

The development of non-traditional brands has led to the expansion of trademark legal protection, including against sound brands. In Indonesia, voice trademarks have been recognized normatively in Law Number 20 of 2016 concerning Trademarks and Geographical Indications and are registered through an online trademark registration system managed by the Directorate General of Intellectual Property. However, this recognition raises various legal and institutional issues, especially related to legal certainty, technical standards for registration, and the effectiveness of the online registration mechanism. This study aims to analyze the normative regulation of voice trademark registration in the Indonesian legal system and examine the legal implications of online voice trademark registration. This study uses a normative legal research method with a legislative approach and a comparative legal approach, by comparing the regulation and practice of voting trademark registration in Indonesia, Australia, and the European Union. In addition, a conceptual approach is used to examine the concept of non-traditional brands, differentiating power, and legal certainty. The results show that although sound trademarks have been normatively recognized, the trademark registration system in Indonesia has not been supported by adequate technical arrangements and operational standards. The absence of examination guidelines and limited transparency in the online registration system create legal uncertainty and expand the administrative discretion of the examiner. This condition has an impact on weak legal protection for applicants and interested parties. This study concludes that strengthening implementing and institutional regulations is needed to realize effective, transparent, and fair registration of voice trademarks.

Abstract

This study aims to analyze the legal protection for retail investors against the practice of liquidity exit carried out by controlling shareholders in the Initial Public Offering mechanism in Indonesia. The phenomenon of exit liquidity shows a shift in the function of IPO from business expansion to a means of transferring business risk from the old owner to the public, which often causes significant losses for retail investors due to information asymmetry and massive stock sales after the IPO. This study uses a normative juridical research method, although the current capital market regulations have provided procedural certainty, there is still a legal vacuum in limiting the volume of divestment of controlling shares after the IPO. This condition is exacerbated by the exchange's technical policies such as the closing of the broker's code on the JATS system in real time which hinders trading transparency. This study recommends the need for regulatory reform through the adoption of quantitative restrictions on the volume of stock sales as per the standard of SEC Rule 144 in the United States or UAE Federal Decree Law no. 32 of 2021 on Commercial Companies as well as the acceleration of the demutualization of the Indonesia Stock Exchange to ensure the integrity of the capital market.

Abstract

The development of Artificial Intelligence (AI) in the beauty industry has led to the innovation of electronic-based skin diagnostic services, one of which is AI in Skin Health Services. While offering convenience and personalized product recommendations, the use of this technology poses the risk of misdiagnosis that could potentially harm consumers. This study addresses two main issues: how to protect consumers from misdiagnosis by AI in Skin Health Services in Indonesia and the legal liability of business actors for the resulting losses. The research method used is normative legal research with a statutory and conceptual approach, through an analysis of provisions in the Consumer Protection Law, the Electronic Information and Transactions Law, and regulations related to electronic systems. The results show that AI in Skin Health Services can be qualified as an electronic service and system, thus making business actors responsible based on the principle of presumption of liability with a tendency towards strict liability to ensure protection and legal certainty for consumers.
