Abstract

Abstrak: Artikel ini bertujuan untuk mengetahui kesesuaian putusan hakim dalam menjatuhkan pidana penjara terhadap anak pelaku tindak kekerasan berdasarkan ketentuan Pasal 354 Ayat (2) KUHP danUndang-Undang Sistem Peradilan Pidana Anak. Jenis penelitian yang digunakan adalah penelitian hukum normatif yang bersifat preskriptif dan terapan. Pendekatan penelitian hukum ini adalah pendekatan kasus.Bahan hukum yang digunakan terdiri dari bahan hukum primer dan bahan hukum sekunder. Teknikpengumpulan bahan hukum yang digunakan adalah studi kepustakaan. Teknik analisis bahan hukum yangdigunakan dalam penulisan hukum ini adalah metode silogisme dengan menggunakan pola berpikirdeduktif. Hasil penelitian ini menunjukkan bahwa putusan hakim dalam Putusan Pengadilan NegeriEnrekang Nomor 3/Pid.sus-Anak/2020/PN-Enr telah memberikan putusan yang tidak sesuai dengan ketentuan yang terdapat dalam Pasal 79 Ayat (2) UU Sistem Perlindungan Pidana Anak. karena Hakim tidakmemberikan pertimbangan yang mengacu pada Pasal 354 KUHP. Kata kunci: Penganiayaan; Putusan Hakim; Terdakwa AnakAbstract: This article aims to determine the suitability of the judge's decision in imposing prison sentences on children who are perpetrators of abuse based on the provisions of Article 354 Paragraph (2) of the Criminal Code and the Law on the Juvenile Criminal Justice System. The type of research used is normativelegal research which is prescriptive and applied. This legal research approach is a case approach. The legalmaterials used consist of primary legal materials and secondary legal materials. The technique of collecting legal materials used is literature study. The technique of analyzing legal materials used in writing this law is the syllogism method using deductive thinking patterns. The results of this study indicate that the judge'sdecision in the Enrekang District Court Decision Number 3/Pid.sus-Anak/2020/PN-Enr has given a decision that is not in accordance with the provisions contained in Article 79 Paragraph (2) of the Child CriminalProtection System Act. because the Judge did not give consideration that refers to Article 354 of the CriminalCode.
