Abstract

The flow of globalization not only affects people's attitudes, but also affects the development of science, technology development, and also affects changes in the social values ??of society. The value system referred to here is, in the past, in classical times, many people had a tendency to fight over inheritance, now the more prosperous people are, changing that perception. Some people today actually give inheritance to be waqf or even given to heirs who take care of their parents because the heirs who take care of their parents need it more or they find it more difficult to take care of their parents, so that in the view of other heirs, the heirs who care for Parents are more entitled to all inheritance. Giving inheritance to heirs who take care of parents seems contrary to the provisions of the Qur'anic verse which stipulates that inheritance must be divided according to the division determined by the Qur'an or determined by hadith. In this study, the researcher tries to re-examine the interpretation of the Qur'anic verses about inheritance verses by using a normative descriptive methodology and using a hermeneutic approach as a model of interpretation. This research is expected to be able to contribute to the thoughts of Islamic law which continue to experience changes both in the pattern of goals and or socioculture, especially the law that discusses al Mu'amalah al Insaniah.

Abstract

This study discusses the scientific dichotomy of Imam Ghazali and its influence on education policies in Indonesia. In Indonesia, there are two formal breeding institutions, namely religious education under the Ministry of Religion and general education under the Ministry of Culture, Research, and Technology of the Republic of Indonesia. When there are scientific dichotomies and different academic degrees, this will affect the public confidence in the ability of religious college graduates, this of course will not be in accordance with the goals of education in Indonesia which is just and equalizes religious education and general education. To show whether or not there is a dichotomy of science by Imam Ghazali, this research is carried out on Imam Ghozali's statements about the dichotomy of science, either in his work or in quotes from other people's works about Imam Ghazali. This research method uses Library Research, where the data presented is based on the related literature of the literaturE of Imam Ghazali's thoughts on science. The findings of this study stated that Imam Ghazali did not dichotomy of science, Imam Ghazali only classified which science was the first to be studied. The classification of knowledge carried out by Ghazali according to the needs and benefits of science for the students’ knowledge and al-Ghazali's thoughts did not have a significant influence on education policy in Indonesia.

Abstract

Lahirnya beberapa produk dan instrumen investasi di lembaga keuangan syariah haruslah sesuai dengan nilai-nilai syariah. Bank Syariah Indonesia disebut juga dengan BSI, baru-baru ini mengeluarkan produk baru yakni tabungan emas BSI. Tabungan emas BSI menggunakan akad wad?’ah yad al amanah dimana implementasi akad ini mewajibkan adanya ujrah yang harus dibayarkan oleh nasabah, hal ini karena barang yang dititipkan tidak boleh digunakan oleh pihak yang dititipi (bank) selama masa penitipan. Implementasi akad wad?’ah ini mengalami pergeseran dari wad?’ah fiqh klasik ke wad?’ah lembaga keuangan syariah saat ini. Akad wad?’ah dalam fiqih klasik merupakan salah satu akad tabarru’ yakni akad kebajikan yang dalam prakteknya tidak mewajibkan adanya ujrah atau imbalan. Dengan ketentuan kewajiban membayar ujrah dalam akad wad?’ah pada tabungan emas BSI, maka pertanyaanya bagaimana kesyariahan produk tabung emas BSI. Untuk mengetahui kesyariahan pada implementasi akad wad?’ah tabungan emas BSI dengan ketentuan ujrah tersebut, peneliti mencoba mengkonstruk akad wad?’ah yang digunakan dalam tabungan emas BSI. Jenis penelitian ini adalah field research, dan menggunakan pendekatan empiris normatif, dimana implementasi akad wad?’ah pada tabungan emas BSI akan dikonstruksi, Dengan mengkonstruksi akad wad?’ah, maka akan diketahui apakah konstruksi akad wad?’ah tabungan emas BSI sesuai dengan prinsip akad wad?’ah hukum Islam atau tidak.
