Abstract

Roads as one of the transportation infrastructure are important elements in building the life of the nation and state. The government has an important role in providing investment for road construction in accordance with its authority as regulated in Law Number 2 of 2022 on the Second Amendment to Law Number 38 of 2004 concerning Roads. However, there are district governments carrying out the construction of national roads which should be the authority of the central government. This writing uses a normative research method with a statutory approach and a conceptual approach related to regulations and regulatory concepts over the authority of local governments in the construction of national roads. Besides that, it uses a conceptual approach , namely the approach taken to the concept of regional government authority in road construction . The purpose of this study is to analyze the abuse of authority by the Regional Government for the construction of National Roads. The results of the study stated that the Regency/City Regional Government carried out the construction of national roads , The regency /city regional government fulfills the element of abusing authority or exceeding authority . For this reason, the central and regional governments can carry out road construction, but this must be in accordance with their respective authorities.

Abstract

Konsep Penyalagunaan Wewenang sebagaimana terdapat dalam UU 31/1999 sebagaimana diubah dan ditambahkan dengan UU 20/2001 tentang Pemberantasan Tindak Pidana Korupsi menimbulkan dualisme pengertian. Pengertian penyalahgunaan wewenang dalam hokum pidana dan pengertian penyalahgunaan wewenang dalam hukum administrasi jelas mengalami perbedaan dari segi konsep dan penegakkan hukumnya. Penelitian ini menguraikan mengenai konsep penyalagunaan wewenang dari perspektif hukum administrasi, penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual agar dapat dimengerti mengenai pengertian penyalahgunaan wewenang dan akibat hukumnya dalam hukum administrasi, serta hubungannya dengan penegakan tindak pidana korupsi.

Abstract

This study aims to assess the effectiveness of the implementation of the Mineral and Coal Information System (SIMBARA) in supporting the digital transformation of mining sector governance in Indonesia and its role in preventing potential state financial losses. SIMBARA has been developed as an integrated platform connecting various ministries and government agencies to ensure transparency, accountability, and efficiency in the end-to-end management of mineral and coal resources. The research adopts a qualitative descriptive approach through literature review, with data analysis based on the “Miles and Huberman model”, encompassing data reduction, data presentation, and conclusion drawing. Data sources include regulations, government evaluation reports, scientific journals, and relevant academic documents published since 2015. The findings reveal that SIMBARA has successfully integrated cross-sectoral systems such as MODI, MOMS, e-PNBP, and SIMPONI, contributing to enhanced regulatory oversight, expedited licensing processes, and optimized state revenue from Non-Tax State Revenue (PNBP) and taxation. Furthermore, SIMBARA has proven effective in identifying illegal mining activities and various fraudulent schemes, including manipulation of the State Revenue Transaction Number (NTPN). The implementation of this system has been recorded to prevent potential state financial losses amounting to IDR 7.71 trillion during the 2022–2024 period. These findings affirm that SIMBARA serves as a critical foundation for the digitalization of national mining governance that is adaptive, integrated, and sustainable.
