Abstract

Globalization brings us to a new order of life, because globalization is a process that takes place in people's lives with various kinds of progress and the rapid rise of capitalism. Of course legal products also develop in the era of globalization. The purpose of this study is to determine the development of madat law in the current era of globalization by using normative juridical methods. The results of this study indicate that the national cultural identity and customary rights of indigenous peoples are respected and protected as long as they do not contradict the principles of state law. Abstract

Latar belakang: Pemagangan Negara di Indonesia diselenggarakan oleh perusahaan yang berkedudukan di Negara Republik Indonesia sebagaimana diatur dalam Undang-Undang Nomor 13 Tahun 2003 Tentang Keternagakerjaan jo. Peraturan Menteri Tenaga Kerja dan Transmigrasi Nomor 6 Tahun 2020 Tentang Penyelenggaraan Pemagangan Negara. Tingginya angka pengangguran, kompetensi tenaga kerja yang menganggur, dan adanya pelanggaran dari pemagangan menjadi latar belakang diadakannya kajian hukum mengenai perlindungan hukum pemagangan negara. Isu hukum yang terdapat dalam penelitian ini adalah status Pemagangan Negara dan upaya hukum yang dapat dilakukan oleh Pemagangan Negara apabila terjadi pelanggaran. Metode penelitian: Penelitian ini merupakan penelitian hukum normatif, dengan menggunakan pendekatan perundang-undangan, (statute approach), pendekatan konseptual (conseptual approach). Hasil penelitian: Dari hasil penelitian, status magang negara berbeda dengan pekerja. Selanjutnya upaya hukum jika terjadi perselisihan adalah melalui jalur litigasi (penyelesaian perselisihan didalam/pengadilan) atau diluar pengadilan yang dirinci menjadi mediasi, mekanisme bipartite, arbitrase, konsiliasi, dan melalui Pengadilan Hubungan Industrial.

Abstract

Para pelaku usaha berlomba-lomba dalam hal mengejar keuntungan sehingga terciptalah suatu iklim persaingan usaha antara perlaku usaha yang satu dengan pelaku usaha yang lain. Hal seperti ini menjadi positif apabila dalam suatu persaingan tersebut menggunakan cara-cara yang adil dan fair. Hal yang terjadi adalah tidak jarang pelaku usaha didasari oleh keinginan untuk menambah keuntungannya menggunakan cara-cara yang melanggar hukum dengan membuat suatu kesepakatan dengan pelaku usaha lain yang bertujuan untuk merusak iklim persaingan usaha yang telah berjalan baik yang salah satunya dikenal dengan istilah kartel. Melalui Undang-Undang Nomor 5 Tahun 1999 Tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat, iklim persaingan usaha dijaga oleh Negara. Komisi Pengawas Persaingan Usaha sebagai garda terdepan dalam hal pengawasan persaingan usaha. Namun terjadi beberapa permasalahan mengenai kewenangannya yang menyebabkan tetap terjadinya kartel dalam suatu persaingan usaha. Penelitian ini berusaha menjawab itu semua melalui pendekatan perundang-undangan, pendekatan konseptual maupun pendekatan kasus agar menghasilkan pemahaman atas permasalahan kartel dan penegakan hukum pidananya di Indonesia.

Abstract

Artikel ilmiah ini membahas tantangan yang dihadapi oleh debitur pengganti selama proses asumsi pinjaman rumah, yang memerlukan pengaturan rahasia untuk mengalihkan tanggung jawab pembayaran kredit dari debitur pertama. Terlepas dari pemenuhan kewajiban kredit, debitur penerus mengalami hambatan dalam mengamankan sertifikat rumah, yang terus didaftarkan dengan nama debitur pertama, yang disebabkan oleh pelaksanaan prosedur administrasi yang diperlukan oleh bank yang tidak memadai. Melalui analisis komprehensif undang-undang terkait, termasuk Undang-Undang Hak Ketergantungan, Undang-Undang Perbankan, dan Peraturan Bank Indonesia, dalam hubungannya dengan Teori Perjanjian dan Teori Keadilan, artikel ini mengeval_uasi hambatan hukum yang muncul dan mengusulkan rekomendasi yang bertujuan untuk meningkatkan protokol pengalihan sertifikat rumah untuk menumbuhkan kepastian hukum dan kesetaraan bagi debitur pengganti. Rekomendasi tersebut mencakup peningkatan transparansi bank dalam proses administrasi, penguatan pengawasan mengenai perjanjian informal, dan peran penting lembaga terkait untuk memastikan bahwa hak debitur pengganti atas rumah, yang pembayaran kreditnya telah diselesaikan, dapat diperoleh tanpa halangan.

Abstract

This article discusses fraud as a legal ground for contract annulment from the perspective of Indonesian civil law. Using a normative juridical approach, the article examines the provisions of the Indonesian Civil Code (Kitab Undang-Undang Hukum Perdata), particularly Articles 1321 and 1320, and analyzes several court decisions as jurisprudence. The findings indicate that fraud constitutes a defect of will (wilsgebrek) that can invalidate a contract if it is proven to have influenced the consent of one of the parties. The article recommends strengthening evidentiary instruments related to fraud in contractual relationships to safeguard legal certainty and justice for the injured party.

Abstract

The rejection of life insurance claims due to the insured’s failure to disclose health conditions often leads to legal disputes between insurance companies and beneficiaries. This study aims to analyze the legal basis for claim rejection under Article 251 of the Indonesian Commercial Code (KUHD) and the application of the good faith principle in life insurance contracts. The research employs a qualitative method with a normative juridical and case study approach, examining an actual claim rejection case by Prudential and several court decisions. The findings indicate that concealing material facts about health conditions constitutes a valid legal ground for insurers to reject claims. However, the role of insurance agents, transparency of information, and policyholder education are crucial in ensuring balanced legal protection for both parties. This study recommends strengthening regulations and establishing a more transparent risk verification system to prevent future disputes.

Abstract

The protection of workers’ rights is an integral aspect of responsible corporate governance. In Indonesia, corporate policies enacted by company directors frequently result in labor rights violations, including unilateral termination, wage neglect, and denial of social security. This article employs a normative juridical and comparative approach to analyze the intersection of labor law and corporate law in defining both the authority and liability of directors. The findings reveal that directors carry fiduciary duties and a duty of care, which may extend to safeguarding workers as stakeholders. Nevertheless, Indonesian legislation has yet to explicitly impose such responsibilities on directors in relation to worker protection. This article therefore recommends harmonizing relevant regulations and strengthening corporate governance principles based on social justice within industrial relations.

Abstract

Doctors are a noble profession. Doctors provide services to patients in the health sector with the aim of recovering from their illness. Doctors in carrying out their practice are guided by all the regulations that function in providing legal protection to themselves. Doctors do their best to seek health for patients regardless of the results. Sometimes the patient does not accept all medical actions performed by the doctor where the patient feels aggrieved. Especially if the patient dies, often the patient's family blames the doctor who treated the patient by saying that the doctor has committed medical malpractice. Therefore we need a legal certainty that regulates medical practice carried out by doctors in order to provide justice and legal protection for doctors in carrying out their duties.

Abstract

In general, credit extended by banks to customer requires a guarantee (collateral) as Credit is carried out first by agreeing to the clauses in the credit agreement. One of these clauses is Cross Collateral which will have an impact on Cross Default if the debtor defaults. Cross Collateral and Cross Default clauses in credit agreements can potentially weaken and cause injustice to debtors. Abstract

The article examines the challenges and opportunities in optimizing the role of the Indonesian police (Polri) in humanistic law enforcement. It highlights structural, cultural, and technical barriers, including inefficiencies in bureaucracy, outdated leadership approaches, and inadequate adoption of modern technology. These issues hinder effective policing and diminish public trust. The article also underscores the importance of aligning law enforcement practices with community-specific cultural contexts, such as handling traditional conflict resolution practices like carok in Madura, by employing a humanistic and dialogical approach. To bridge the gap between societal expectations and on-the-ground realities, the article proposes comprehensive strategies. These include capacity-building through humanistic training, emphasizing empathy and cultural understanding, reforming recruitment processes, and leveraging technology for transparency. The implementation of community policing models, such as Polmas, is highlighted as a practical way to foster collaboration between police and communities. The study employs a combination of normative and sociological approaches, drawing on legislation, direct observation, and interviews with police practitioners. By integrating ethical guidelines, continuous training, and community-centric policies, the article advocates for a transformative policing framework that upholds justice, respects cultural diversity, and strengthens public trust. This framework aligns with Indonesia’s Pancasila values, emphasizing fairness and human dignity in law enforcement.
