Abstract

Praktik aborsi yang cenderung semakin meluas memiliki dampak, baik dari aspek kesehatan, psikologi, maupun sosial. Merespon fenomena ini, dalam Islam, terdapat perdebatan terhadap status hukum aborsi. Penelitian ini termasuk penelitian kepustakaan (library research), dengan pendekatan multi approaches, sosiologis, psikologis, medis, dan sosiologi hukum. Dengan menggunakan jenis dan pendekatan ini, menunjukkan bahwa bagi empat mazhab menyepakati bahwa aborsi adalah tindakan yang diharamkan. Oleh karena itu, aborsi pada umumnya adalah tindakan kejam, bertentangan dengan nilai-nilai kemanusiaan, bertentangan dengan hukum dan ajaran agama. Tetapi keharaman hukum ini tidak mutlak karena praktik aborsi terjadi berdasarkan beberapa pertimbangan kondisi yang menyertainya. Sehingga pada satu sisi, praktik aborsi dibolehkan. Akan tetapi tetap saja praktik aborsi ini menimbulkan dampak negatif bagi pelakunya terutama di bidang kesehatan yang memicu terjadinya pendarahan, gangguan pada rahim bahkan tidak sedikit yang berujung dengan kematian. Selain itu, aborsi juga berdampak pada aspek sosial dan psikologi seperti stress, gangguan kejiwaan dan tingginya angka kematian dalam masyarakat.Abortion practice inclines to be wider among the people and it has some impacts in healthy, psychology, or social to the person who does it. In order to respond such phenomena, Islam has much debate dealing with legal status of abortion. This research is library research with multi approaches; sociology, psychology, medics, and legal sociology. Through applying such approaches, this research reveals that four major schools in Islam are in agreement in condemning and proscribing abortion practice and considering it as a forbidden practice in Islam. Therefore abortion is a cruel action, and contradicts to humanity values, and also law and religion teaching. However, the forbidden status of abortion is not absolute due to some considerable reasons attach to such practice. Therefore in one occasion abortion is allowed. This practice however has negative effect to its subject, mostly to the health of its subject such as bleeding, womb disease, and even it is ended to the death of its subject. Moreover, abortion also has a serious impact to social life and psychology such as stress, mental disorder, and the increasing of mortality among the people.Kata Kunci: aborsi, nilai-nilai kemanusiaan, gangguan kejiwaan, kematian

Abstract

Wages are a very basic value in business transactions. In wage agreements, the pattern and nature of the relationship between employers and workers can easily be identified. Unfair and exploitative wages occur because contracts are not open, lack transparency, and are not based on equality, understanding, and willingness. In the Marxist perspective, wages are always placed on suspicion of containing elements and relations of exploitation by the strong against the weak. In this context, transactions and wages are colored by capitalist elements and motives. Islam views wages as a gift from the Almighty which must be implemented in an affective-humanist manner. Although there are differences in roles between workers and employers, the answers to the material agreement are that of equality, openness, and willingness. On the other hand, at the same time, this principle is expected to make the character of work interconnected to make work relationships more conducive.
