Abstract

Pendekatan filsafat merupakan pendekatan dalam pemecahan suatu masalah dengan mengungkap permasalahan secara bijaksana dan mendalam untuk mendapatkan hasil dari permasalahan tersebut. Pendekatan Filsafat bersifat mendalam dalam arti pembahasan dilakukan sampai ke akar permasalahan hingga tidak sanggup lagi dijangkau. Model pendekatan filsafat selanjutnya dapat dijadikan untuk memahami ajaran-ajaran agama. Metode dalam penelitian ini adalah penelitian kepustakaan yang diuraikan secara deskriptif analisis. Pendekatan filsafat menjadi salah satu cara untuk memahami lebih dalam tentang studi Islam. Filsafat dalam studi Islam memiliki peran penting dalam mengkaji isu-isu kontemporer seputar Islam. Beberapa cabang dalam pendekatan filsafat diantaranya Epistemologi, Etika, Logika, dan Metafisika. Kata Kunci: Pendekatan, Filsafat, Studi Islam

Abstract

This research examines the legitimacy of children, child custody, and child guardianship in the perspective of Islamic law in Muslim countries in the world. This study aims to find out how the implementation of child legitimacy, child custody, and child guardianship in the perspective of Islamic law exists in Muslim countries in the world. This study uses library research by collecting qualitative data. Data is obtained by collecting from several sources, such as books and journal articles. The approach in this research is normative by analyzing existing rules in several countries related to child legitimacy, child custody, and child guardianship that already exist and are clearly described. The results of this study indicate that child legitimacy, child custody, and child guardianship have different provisions and are regulated in different laws in every Muslim country in the world.

Abstract

Islamic inheritance law is an important expression of Islamic family law which is a half of the knowledge possessed by humans as emphasized by the Prophet Muhammad Saw. Islamic inheritance laws basically apply to Muslims anywhere in the world. Islamic inheritance law stipulates that children can be replace their father's position, both sons and daughters. The purpose of this research is to find out how Islamic inheritance law is implemented in several Muslim countries in the world. This research uses a library research types with a normative juridical approach. The research was conducted by collecting data as the main source such as books, journal articles and other data which were analyzed by Islamic law. The research is described normatively clearly according to the existing data. The results of this study indicate that the law of inheritance in Islam states that a child who can replace his father's position is a son and daughter from the male lineage whose father has died before the heir. Meanwhile, sons and daughters from the female lineage have no right at all to replace their mother's position to obtain property from their grandfather (heir). Besides that, the culture of a Muslim country and the social life of the people in that country have an influence on the inheritance law in that country.
