Abstract

Abstrak Perjanjian kemitraan antara penyedia platform dengan gig worker (kurir) merupakan perjanjian kemitraan yang berbentuk semu, di mana kedudukan di antara keduanya tidak seimbang. Penelitian ini bertujuan untuk mengetahui dan menindaklanjuti pertanggungjawaban dari penyedia platform yang menjalin kemitraan dengan gig worker atas tindakan wanprestasi yang dilakukan pembeli kepada gig worker. Metode penelitian dalam penelitian ini adalah yuridis normatif dengan menitikberatkan pada pemanfaatan bahan pustaka atau data sekunder, yang memuat bahan hukum primer, sekunder, ataupun tersier. Dalam mengumpulkan data yang diperlukan untuk penelitian dilakukan dengan 2 (dua) tahap penelitian yaitu penelitian kepustakaan dan penelitian lapangan yang diperoleh melalui wawancara secara daring. Berdasarkan hasil penelitian bahwa tanggung jawab penyedia platform kepada gig worker terbatas karena adanya klausul eksonerasi (batasan tanggung jawab) dalam perjanjian kemitraan yang telah dibuat, sehingga penyedia platform tidak memiliki tanggung jawab kepada gig worker terhadap akibat dari adanya wanprestasi yang dilakukan pembeli. Selain itu, pelindungan hukum bagi gig worker tidak dapat dilaksanakan karena di dalam perjanjian kemitraan, gig worker menyetujui perjanjian tersebut yang di dalamnya berisi klausul ganti rugi mengenai tidak dapat menuntut ataupun mengajukan gugatan kepada penyedia platform. The Responsibility of the Platform Provider to Gig Worker in a Partnership Relationship for the Buyers Default is Reviewed from the Civil Law Code Abstract The partnership agreement between the platform provider and gig worker is a pseudo-partnership agreement, in which the position between the two is not balanced. This study aims to identify and follow up on the accountability of platform providers who form partnerships with gig workers for default actions committed by buyers to gig workers. The research method in this study is normative juridical with an emphasis on the use of library materials or secondary data, which contains primary, secondary, or tertiary legal materials. In collecting the data needed for research, it is carried out in 2 stages of research, namely library and field research obtained through online interviews. Based on the results of the research, the responsibility of the platform provider to the gig worker is limited due to the exoneration clause in the partnership agreement that has been made, so the platform provider has no responsibility to the gig worker for the consequences of a default by the buyer. In addition, legal protection for gig workers can’t be implemented because in the partnership agreement, gig worker agrees to the agreement which contains a compensation clause regarding not being able to sue or file a lawsuit against the platform provider. Abstract

Nowadays, student internship programs are increasingly being held by start-up companies. However, in practice there are still many students participating in internships who have not received their rights as agreed in the internship agreement. Apart from that, there is no clear regulation regarding student internship programs in labor regulations in Indonesia, especially in Law of the Republic of Indonesia no. 6 of 2003 concerning Employment and Regulation of the Minister of Manpower of the Republic of Indonesia Number 6 of 2020 concerning the Implementation of Domestic Apprenticeships. This research aims to analyze the legal relationship between student interns and start-up companies and to find appropriate legal protection for student interns to defend their rights. This research was written using a normative juridical approach. The research results show that there is no employment law relationship between student interns and start-up companies. The legal relationship that occurs is a legal relationship that arises because of an internship agreement which is civil in nature and is subject to the Civil Code agreement law. Intern students whose rights are not fulfilled can seek repressive legal protection to defend their rights through non-litigation dispute resolution through negotiation. If non-litigation efforts are not achieved, litigation efforts can be pursued by filing a lawsuit, with the basis of the lawsuit being default and prioritizing mediation efforts in court first.

Abstract

The implementation of equipment standardization and occupational health and safety (OHS) in construction projects in Indonesia is regulated through several laws and regulations and refers to international guidelines such as ILO Convention No. 155 of 1981 concerning Occupational Health and Safety and FIDIC. Although these regulations require compliance with technical, safety, and occupational health standards, their implementation still experiences various obstacles. This can be seen from the continued use of obsolete and uncertified equipment, as well as the high number of work accidents. To improve the effectiveness of standardization, the supervision and law enforcement system in Indonesia can be compared with other countries such as the Philippines. Therefore, reform efforts are needed in supervision, enforcement of sanctions, and increased education to increase awareness and compliance with OHS standards, so as to protect workers and create a safe and sustainable work environment.
