Abstract

This study examines the legal awareness of halal certification of restaurant businesses in Malang. Considering law No. 33 of 2014 on Halal Product Guarantee has been enacted for 5 years, the obligation of halal certification should have been carried out. Moreover, in malang area which is notabene one of the cities with the highest number of universities in East Java. This study has two formulations on how to awareness of halal certification law of restaurant businesses in Malang and how to implement halal certification procedures in LPPOM MUI East Java. The purpose of this study is to measure legal awareness of restaurant businesses in Malang related to halal certification and halal certification management procedures. This research is a sociological juridical research using 2 (two) data collection techniques, namely field research and library research. The theory used is the theory of legal awareness as the basis of analysis in this study. The results of this study are as follows: First, legal awareness of restaurant businesses in Malang related to halal certification has not been maximized because there are indicators and elements that are not fulfilled properly. Second, the process of implementing halal certification from both LPPOM MUI and business actors is in accordance with the provisions that have been given

Abstract

This study aims to find out all procedures for the transfer of rights to ex-customary land that have not been certified along with the requirements that must be completed to register the transfer of rights to ex-customary land that has not been certified as well as to find out the problems faced by the people of Ambit Village related to the registration of the transfer of rights to land. former customs and solutions for their solutions. The research method used is field research with an empirical juridical approach that is based on field research and interviews and is adapted to legal conditions. The results of the study can be concluded that the registration of the transfer of rights to former customary land that has not been certified in Ambit Village has been carried out in accordance with the provisions of the government regulation of land registration No. 24 of 1997. There are several problems that arise in the process of registering the transfer of rights to former customary land that has not been certified, such as land parcels that are still in dispute and there is no proof of SPPT PBB payment from the previous owner. It can be concluded that the community must follow the procedure and register their land with complete required documents and pay taxes on time. Abstrak Penelitian ini bertujuan untuk mengetahui seluruh prosedur peralihan hak atas tanah bekas adat yang belum bersertifikat beserta persyaratan-persyaratan yang harus dilengkapi untuk mendaftarkan peralihan hak atas tanah bekas adat yang belum bersertifikat serta mengetahui permasalahan yang dihadapi oleh masyarakat Desa Ambit terkait dengan pendaftaran peralihan hak atas tanah bekas adat beserta solusi penyelesaiannya. Metode penelitian yang digunakan adalah penelitian lapangan dengan pendekatan yuridis empiris yang didasarkan pada penelitian lapangan dan wawancara serta disesuaikan dengan keadaan hukum. Hasil penelitian dapat disimpulkan bahwa Pelaksanaan pendaftaran peralihan hak atas tanah bekas adat yang belum bersertifikat di Desa Ambit telah dilaksanakan sesuai dengan ketentuan peraturan pemerintah pendaftaran tanah No. 24 Tahun 1997. Terdapat beberapa permasalahan yang timbul dalam proses pendaftaran peralihan hak atas tanah bekas adat yang belum bersertifikat seperti bidang tanah masih dalam keadaan sengketa serta tidak ada bukti pembayaran SPPT PBB dari pemilik sebelumnya. Dapat disimpulkan bahwa masyarakat harus mengikuti prosedur dan mandaftarkan tanahnya dengan dokumen persyaratan lengkap serta membayar pajak tepat waktu.

Abstract

The auction winner as a legitimate buyer is often unable to retrieve the auction object  that has been purchased because the object under the the previous owner. This led to the auction winner filing an execution lawsuit  to the Court of Appeal. However, thereis rarely a third party that fights  against the seizure of executions with the intention of stalling. Author conducted a study on The Verdict No. 39/Pdt.Bth/2019/PN.Mjk  and 14/Pdt.Bth/2020/PN.Mjk  Mojokerto District Court  regarding  derden verzet related to the seizure of execution No. 5/Eks.HT/2019/PN.Mjk. This study aims to find out the reasons for resistance, know the consideration of judges in rejecting resistance and know the legal protections provided to auction winners for  the existence of third-party resistance. The research method used was normative legal research. Based on the research, the author obtained the results according to article 195 paragraph (6) HIR, derden verzet can be filed on the basis of property rights to the confiscated object. However, hakim rejected both resistances with the consideration that contrarians are not true contrarians. Basically, legal protection against the winner of the auction has been given by  Vendu Reglement and PMK No. 27/PMK.06/2016, but the resistance to the emptying execution confiscationdoes notmandate the absence of certainty for the winner of the auction in order to  complywith  the auction object that has been defended  . Abstrak Pemenang lelang sebagai pembeli yang sah seringkali tidak dapat menikmati secara langsung objek lelang yang sudah dibeli karena masih dalam penguasaan pemilik sebelumnya. Hal ini menjadi alasan pengajuan permohonan eksekusi pengosongan ke Pengadilan Negeri oleh pemenang lelang. Akan tetapi, tidak jarang ada pihak ketiga yang mengajukan perlawanan terhadap sita eksekusi dengan maksud mengulur waktu. Penulis melakukan studi pada Putusan No. 39/Pdt.Bth/2019/PN.Mjk dan 14/Pdt.Bth/2020/PN.Mjk  Pengadilan Negeri Mojokerto mengenai derden verzet terkait adanya sita eksekusi Nomor 5/Eks.HT/2019/PN.Mjk. Penelitian ini bertujuan untuk mengetahui alasan perlawanan, mengetahui pertimbangan hakim dalam menolak perlawanan dan mengetahui perlindungan hukum yang diberikan untuk pemenang lelang atas adanya perlawanan pihak ketiga. Penulis mengkaji kasus ini dengan menggunakan metode penelitian yuridis normatif. Berdasarkan penelitian, Penulis memperoleh hasil yaitu menurut pasal 195 ayat (6) HIR, derden verzet bisa diajukan dengan dasar adanya hak milik atas objek yang disita. Namun, Majelis Hakim menolak kedua perlawanan dengan pertimbangan bahwa pelawan bukanlah pelawan yang benar. Pada dasarnya, perlindungan hukum terhadap pemenang lelang telah diberikan oleh Vendu Reglement dan PMK No. 27/PMK.06/2016, namun adanya perlawanan terhadap sita eksekusi pengosongan mengakibatkan tidak adanya kepastian untuk pemenang lelang agar dapat menikmati objek lelang yang telah dibelinya.
