Abstract

Haryono No. 169 Malang e-mail : azahrahajar@student.ub.ac.id ABSTRAK Penelitian ini bertujuan untuk mengetahui bagaimana upaya PT Bank Syariah Indonesia Tbk, Cabang Madiun Agus Salim dalam penyelesaian peralihan kreditur penerima jaminan hak tanggungan terhadap pembiayaan bermasalah pasca merger. Dalam pelaksanaannya, proses ubah nama kreditur tidak sesuai dengan Surat Edaran BPN mengenai pedoman tahapan ubah nama PT Bank Syariah Indonesia Tbk yang menyebabkan terhambatnya kegiatan operasional bank. Jenis penelitian ini adalah penelitian empiris yang menggunakan pendekatan penelitian yuridis sosiologis. Dari hasil penelitian ini, diketahui bahwa permasalahan yang dihadapi adalah mengenai pemenuhan syarat administratif yang tidak sesuai dengan Surat Edaran BPN, dimana BPN Kota Madiun masih mensyaratkan KTP Nasabah dan KTP Kepala Cabang selain akta merger dan akta perubahan nama. Pelaksanaannya belum dilakukan secara elektronik, sehingga dibutuhkan biaya lebih untuk memenuhi dokumen yang harus dilengkapi dalam bentuk tercetak kepada BPN Kota Madiun, hal ini menjadi sebab penumpukan berkas pada BPN Kota Madiun. Adapun Upaya Bank Syariah Indonesia Cabang Madiun Agus Salim adalah dengan membentuk peraturan internal yang mengatur dua hal, pertama terkait penggunaan skala prioritas yang diperuntukkan untuk dua jenis nasabah pembiayaan, yaitu terhadap nasabah dengan pembiayaan bermasalah dan nasabah yang hendak atau sedang dalam proses pelunasan. Kedua, memproyeksikan target untuk kantor cabang terkait jumlah yang setidak-tidaknya harus terselesaikan dalam jangka waktu satu tahun. Kemudian secara eksternal, pihak Kementerian Agraria dan Tata Ruang / Badan Pertanahan Nasional ikut turut serta melakukan evaluasi dan sosialisasi terhadap kantor pertanahan yang belum mengaplikasikan Surat Edaran Badan Pertanahan Nasional sebagaimana diatur terkait syarat administratif yang harus dipenuhi, salah satunya Badan Pertanahan Nasional Kota Madiun. Kata Kunci: Hambatan, Ubah Nama Kreditur, Hak Tanggungan ABSTRACT This research aims to find out the measures taken by PT Bank Syariah Indonesia Tbk, Branch Office of Madiun Agus Salim in settling the transfer of creditor as the recipient of mortgage right regarding non-performing loans following the company merger. In the practice, the change of the creditor’s name did not comply with the Circular Letter of the National Land Agency regarding the guidelines of name change in PT Bank Syariah Indonesia Tbk, and this issue hampered the operational activities in the bank. This is an empirical study using socio-juridical methods. The research results reveal that the issue was related to the fulfillment of administrative requirements not relevant to the Circular Letter issued by the National Land Agency of Madiun, where the Citizen Cards of the bank client and the Head of the Branch Office were required, in addition to the merger certificate and name change certificate. Since the process was not performed electronically, it was not cost-efficient recalling that some documents needed were plenty and had to be printed in the National Land Agency of Madiun. Abstract

This thesis discusses the basic legal construction of the regulation of non-judgmental mediators outside the court, with a focus on the incompleteness of the regulations in Articles 4, 11, and 36 of Supreme Court Regulation (Perma) No. 1 of 2016. These provisions do not adequately regulate the position, authority, and responsibilities of non-judgmental mediators, thus creating legal uncertainty and potentially weakening the legitimacy of non-litigation mediation results. This study aims to answer two research problems: (1) the urgency of establishing legal regulations regarding non-judgmental mediators outside the court; and (2) the appropriate basic legal construction for the regulation. The research method used is normative juridical with a statutory, conceptual, and comparative approach. The results of the study indicate that the urgency of establishing new regulations lies in the need to guarantee legal certainty, strengthen the position of mediators, and increase the effectiveness of mediation as an alternative dispute resolution. Based on Gustav Radbruch's theory of legal certainty, the current regulations do not fulfill the principle of legal certainty. Therefore, it is necessary to amend Articles 11 and 36 of Perma No. 1 of 2016, which covers the qualifications, legal status, accreditation, supervision, code of ethics, and accountability of non-judge mediators. This construction is based on Singapore's Mediation Act 2017 and analyzed using Maria Farida's legal theory. This proposal is expected to provide legal certainty and strengthen the non-litigation mediation system in Indonesia.
