Abstract

Abstract The throwing of chickens at Kali Progo bridge by the bride and groom's families is one of the traditional Javanese wedding ceremony traditions that we still see in Jombor Village. When the bridal procession's second journey passes through a large river, this tradition is carried out. The purpose of this research is to learn about Urf tradition of dumping chickens at Kali Progo bridge by the bride's family, as well as the origins of this tradition. This qualitative study examines and directly observes the lives of people who still practice historical, anthropological, and Islamic legal approaches. Data collection techniques were used to collect primary data from interviews with traditional leaders, religious leaders, and residents of Jombor Village who still practice this tradition. Books, documents, journals, and other secondary data sources were used, and they were then analyzed using descriptive methods. The findings of the study show that Islam forbids the belief that throwing away chickens will provide safety, because Allah SWT is the only one who can provide salvation. The urf aspect, which is based on syara' and the framework of ushul fiqh, also states that it is not permissible to do so, because this tradition includes urf fasid, which are actions that are not in accordance with the Quran and hadith or make the group's journey to difficult location. Furthermore, this tradition wastes previously discarded chickens. Keywords: Tradition; Java Chicken; Urf Abstrak Salah satu tradisi upacara pernikahan adat Jawa yang masih sering kita jumpai di Desa Jombor salah satunya adalah tradisi membuang ayam dijembatan kali progooleh keluarga pengantin baik pengantin putra maupun pengantin putri. Tradisi ini dilakukan saaat iring -iringan pengantin yang perjalanan keduanya melewati sungai yang besar. Penelitian ini bertujuan untuk mengetahui tentang tradisi pembuangan ayam di jembatan Kali Progo oleh keluarga pengantin dalam perspektif urf dan asal mula adanya tradisi tersebut. Penelitian kualitatif ini menggunakan pendekatan sejarah, antropologi dan hukum Islam dengan melihat dan mengamati secara langsung kehidupan masyarakat yang masih melakukannya. Teknik pengumpulan data dilakukan dengan menggunakan data primer yang diperoleh dari wawancara dengan tokoh adat, tokoh agama dan masyarakat Desa Jombor yang masih melakukan tradisi tersebut. Sumber data sekunder diperoleh dari buku-buku, dokumen, jurnal dan lain-lain kemudian dianalisis menggunakan metode deskriptif. Hasil penelitian menunjukkan bahwa agama Islam tidak membolehkan meyakini dengan membuang ayam akan memberikan keselamatan, karena yang memberikan keselamatan hanyalah Allah SWT. Segi urf yang disandarkan pada syara’ dan Kerangka ushul fiqh juga menyatakan tidak diperbolehkan untuk dilakukan, karena tradisi ini temasuk urf fasid , yakni perbuatan yang tidak selaras dengan al-Quran dan hadits atau menyulitkan proses perjalanan rombongan menuju lokasi. Selain itu, tradisi ini memubadzirkan ayam yang telah dibuang.

Abstract

Membahas tentang adat Jawa tidak asing lagi bahwa adat Jawa memiliki kebiasaan yaitu keyakinan menentukan waktu dalam melaksanakan suatu hajat, misalkan hajatan perkawinan. Dalam adat Jawa ada satu bulan yang biasanya tidak digunkan dalam melakukan perkawinan yaitu bulan Suro (Muharram). Adat ini juga berlaku di desa Sukomarto, Kecamatan Jumo, Kabupaten Temanggung, meskipun mayoritas masyarakatnya memeluk Agama Islam akan tetapi masyarakat masih mempertahankan adat turun temurun tersebut. Tujuan penelitian ini untuk mengetahui presepsi masyarakat Desa Sukomarto terhadap pantangan menikah di bulan Suro (Muharram) dan pandangan hukum Islamnya. Jenis penelitian ini yaitu penelitian field research (lapangan), sifatnya penelitian ini yaitu kualitatif, penelitian ini termasuk dalam penelitian deskriptif analisis sedangkan pengumpulan data menggunakan teknik observasi, wawancara dan dokumentasi. Hasil dari penelitian ini menunjukkan bahwa masyarakat sangat menghormati bulan Suro (Muharram), hal ini dikarenakan secara filosofis bulan tersebut terdapat peristiwa-peristiwa atau sejarah tentang pembantaian keluarga Nabi Muhammad SAW yang menimbulkan rasa kagum dan haru yang menjadikan bulan tersebut menjadi bulan yang sangat dimuliakan, selain itu masyarakat memiliki keyakinan jika meggelar hajatan pada bulan tersebut takut terjadi seuatu yang tidak baik. Selain perkawinan kegiatan yang tidak dilakukan pada bulan Suro (Muharram) ialah khitan, bangun rumah, pindah tempat tinggal (boyongan), tujuh bulanan (tingkeban). Dalam agama Islam melakukan pernikahan atau hajatan lainnya pada bulan Suro (Muharram) tidak dilarang karena dalam Islam tidak ada hari dan bulan yang tidak baik, bahkan bulan Suro (Muharram) termasuk bulan yang sangat mulia, yang menjadikan haram ialah ketika melaksanakan hajatan pada bulan Suro (Muharram) dan beranggapan akan terjadi cobaan atau peristiwa yang tidak baik, karena hal tersebut telah mendahului kehendak Allah SWT dan termasuk perbuatan syirik.

Abstract

The development of digital transactions through e-commerce platforms such as Shopee necessitates a fiqh al-mu‘āmalāt review of the relevance of classical contracts, particularly the salam contract and others. The salam contract, known as a sale in which payment is made in advance while the goods are delivered at a later time, aligns closely with the pattern of online transactions. This study aims to analyze the relevance of the salam contract in sales conducted on Shopee and to identify other contracts that are more appropriate to the characteristics of specific transaction features on the platform. The research adopts a qualitative approach through field studies, with data collected from interviews with fiqh al-mu‘āmalāt experts and transaction practitioners, supported by documentation and direct observation. Data validity was tested using source triangulation techniques. The findings indicate that most Shopee transactions involving advance payment followed by subsequent delivery fulfill the conditions and pillars of the salam contract. However, not all transactions can be categorized as salam. The Cash-on-Delivery (COD) feature is more akin to an ordinary sale, Shopee Food resembles a wakālah contract, PayLater tends toward a qarḍ contract, while pre-order transactions are more relevant to an istisnāʿ contract. Therefore, mapping contracts according to the characteristics of each transaction is essential to ensure that digital trade practices remain aligned with sharī‘ah principles.

Abstract

The prohibition of marriage during the month of Suro remains a widely observed tradition in Javanese society, reflecting the dynamic interaction between local cultural practices and Islamic values, particularly in relation to Javanese cosmology and the concept of the sacredness of time. This study aims to examine the historical development and philosophical significance of the tradition of prohibiting marriage during the month of Suro from the perspectives of Javanese culture and Islamic law. The research employs a qualitative library research method using historical and philosophical approaches. Data were collected from historical literature, studies on Javanese culture, scholarly journal articles, and previous research, and were analyzed using a descriptive-analytical method. The findings indicate that this tradition constitutes a form of cultural heritage shaped through a long historical process, rooted in pre-Islamic cosmological beliefs and subsequently developed through the acculturation of Hindu-Buddhist and Islamic traditions. Philosophically, the tradition embodies values of prudence, respect for ancestors, and the preservation of harmony between human beings, nature, and the spiritual realm. Over time, its function has shifted from a binding social norm to a cultural symbol and an expression of local wisdom. From the perspective of Islamic law, there is no prohibition against marriage in any specific month. Therefore, this tradition may be regarded as a form of customary practice (ʿurf) that is acceptable as long as it does not contradict the principles of Islamic law.
