Abstract

Penyelesaian sengketa dapat dilakukan melalui lembaga pengadilan (litigasi) dan dapat juga diselesaikan diluar lembaga pengadilan (non litigasi). Penyelesain sengketa non litigas lebih dikenal dengan Alternative Disputes Resolution (ADR). Penyelesaian sengketa secara non litigasi lahir karena beberapa kelemahan dalam penyelesaian sengketa secara litigasi. Lahirnya Perda No. 7 Tahun 2018 tentang Nagari memberikan pembaruan hukum bagi masyarakat Sumatera Barat khususnya pada Kabupaten Tanah Datar dimana semula penyelesaian sengketa sako maupun pusako diselesaikan melalui Kerapatan Adat Nagari beralih kepada lembaga Peradilan Adat Nagari yang dibentuk oleh KAN. Berdasarkan hal ini maka rumusan masalah penelitian yaitu: 1) Bagaimana penyelesaian sengketa sako melalui mediasi oleh peradilan adat Kabupaten Tanah Datar berdasarkan Perda No. 7 Tahun 2018 tentang Nagari? 2) Bagaimana peran peradilan Adat di Kabupaten Tanah Datar dalam penyelesaian sengketa sako? Penelitian ini menggunakan jenis penelitian yuridis sosiologis, bersifat deskriptif analitis, dan analisis data secara kualitatif. Hasil penelitian merumuskan: 1). Penyelesaian sengketa sako di oleh peradilan adat nagari di Kabupaten Tanah Datar berdasarkan Perda No. 7 Tahun 2018 tentang Nagari dilaksanakan berdasarkan ketentuan adat yang berlaku yaitu bajanjang naiak batanggo turun. 2) . Peran Peradilan Adat di Kabupaten Tanah Datar dalam penyelesaian sengketa sako dilihat dari 3 nagari yaitu Nagari Balimbiang, Nagari Sungayang, dan Nagari Sumani yaitu tidak berperan karena diketahui bahwa KAN dari 3 Nagari tersebut belum mebentuk Peradilan Adat Nagari sebagaimana yang diamanatkan dalam Pasal 15 Perda No. 7 Tahun 2018 tentang Nagari sehingga penyelesaian sengketa sako masih dilakukan secara musyawarah mufakat oleh Kerapatan Adat Nagari di Nagari tersebut.

Abstract

Credit policy is a state goal to provide opportunities for the community to build businesses or businesses that have an impact on the nation's economic drive systemically. Banking financial institutions that serve credit financing products as products that are often in demand by customers in order to open a business by offering a prospectus for business activities. The existence of Rural Banks (BPR) has a significant role for local communities in the context of regional economic development. Broadly speaking, the role of BPR is not only in channeling funds to the public, but the bank and its customers work together to build a project through a financing product called profit sharing (dividend). The research method uses normative juridical (doctrinal research) with a qualitative approach, which in processing and analyzing data does not use numbers, symbols, and mathematical variables, but rather an in-depth understanding by reviewing the laws and regulations. The results of the study explain that, Developments in credit policy resulted in a change and were able to overcome the problem of instability in a country. Rural Banks have a policy of limiting credit distribution which is regulated in a regulation in order to achieve a productivity of capital to be distributed. The government through the Job Creation Law is to create an MSME ecosystem that is more integrated with investment and workers (human resources) for the sake of sustainability and the continuity of productive capital distribution. With the people's credit policy, regional creative products can be recognized and provide business opportunities for business actors in the region

Abstract

AbstractStructuring the tourism sector is a concern for the Regional Government, especially in West Sumatra, which continues to develop halal tourism as a hall mark of adaik basandi syara’ syarak basandi Kitabullah. The role of the Government of West Sumatra has been seen in structuring Halal Tourism after the issuance of West Sumatera Provincial Regulation concerning Organizing Halal Tourism. Halal tourism is a set of additional services for amenities, attractions and accessibility that are intended and provided to meet the experiences, needs and desires of Muslim tourists and other tourists who need them.West Sumatra part of the preservation of halal products as well as the application of the upholding philosophy of Islamic and customary values as the foundation of the life of the Minangkabau. In implementing halal tourism, the Government of West Sumatra is responsible for developing Halal Tourism business including providing investment incentives, facilitating investment facilities, as well as facilitating infrastructure facilities in implementing Halal Tourism. The results of this study explain that Regional Regulation concerning the Implementation of Halal Tourism in general has been implemented by the government, with so far establishing halal tourism destinations, including the Baso Pagaruyung Palace in Tanah Datar, Twin Lakes in Solok Regency, and the Islamic Center in Padang. The concept of halal tourism is not to prescribe a place, but rather to provide additional services to tourists who prioritize Muslim tourists and other tourists who need it.Keywords: Halal Tourism; Additional Service; Local Economy. AbstrakPenataan sektor wisata menjadi suatu concern Pemerintah Daerah terutama di Sumatera Barat yang terus mengembangkan Wisata halal sebagai ciri khas dari adaik basandi syara’ syarak basandi kitabullah. Peran Pemerintah Sumatera Barat telah terlihat dalam penataan Wisata halal setelah terbitnya Peraturan Daerah Provinsi Sumatera Barat tentang Penyelenggaraan Wisata Halal. Wisata halal sebagai perangkat layanan tambahan amenitas, atraksi, dan aksesibilitas yang ditujukan dan diberikan untuk memenuhi pengalaman, kebutuhan, dan keinginan wisatawan muslim dan wisatawan yang lain yang membutuhkannya. Keberadaan Wisata halal di Sumatera Barat bagian dari pelestarian produk halal sebagaimana penerapan dari junjungan tinggi filosofi Nilai-nilai Islam dan Adat sebagaimana dasar dari pijakan hidup masyarakat MinangKabau. Dalam penyelenggaraan wisata halal, Pemerintah Sumatera Barat bertanggungjawab dalam pengembangan usaha Pariwisata Halal meliputi pemberian insentif investasi, fasilitas kemudahan investasi, serta fasilitas kemudahan infrastruktur dalam pelaksanaan Pariwisata Halal. Hasil penelitian ini menjelaskan bahwa Penyelenggaraan Pariwisata Halal secara umum telah dilaksanakan oleh pemerintah, dengan sejauh ini telah menetapkan destinasi pariwisata halal antara lain yaitu Istana Baso Pagaruyung di Tanah Datar, Danau Kembar Kabupaten Solok, dan Islamic Center di Padang Panjang. Konsep wisata halal ini bukanlah mensyariat suatu tempat, melainkan lebih kepada pelayanan tambahan (addcended service) yang diberikan kepada wisatawan yang di utamakan wisatawan muslim dan wisatawan lain yang membutuhkan.Kata Kunci: Wisata Halal; Pelayanan Tambahan; Ekonomi Lokal.

Abstract

The existence of Article 36 of Law Number 23 of 2006 concerning Population Administration becomes a weapon for couples who wish to marry with different religions in registering their marriage through a decision from the District Court. This is contrary to Law Number 1 of 1974 concerning Marriage which prohibits interfaith marriages and also prohibits these marriages from being registered. In 2022 a citizen named E. Ramos Petege submitted a request for judicial review of Article 2 paragraph (1) and Article 8 letter F of Law Number 1 of 1974 concerning Marriage because these articles were considered to violate his constitutional rights. The Constitutional Court also decided to reject the petition of the applicant. Research using normative juridical method with the nature of descriptive analysis research. The results of this study explain that violations in the legal order of marriage in Indonesia are motivated by minimal understanding of religion with the assumption that marriage is only limited to civil relations and the Marriage Law does not explicitly imply a prohibition against interfaith marriages. Furthermore, the reasons for the District Court granting interfaith marriages are related to human rights in the 1945 Constitution and legal rules on population administration. So that the urgency of the decision of the Constitutional Court in rejecting interfaith marriages is to provide legal certainty and become a final and binding legal reference for all law enforcement agencies in Indonesia.
