Abstract

The MUI, an ulama organization founded by the government in 1975, was engineered to be the national authority on Islam. This organization functions as a forum for the ulama to discuss problems related to ‘the duties of  ulama’. Therefore, the organization issues religious decrees in the form of  fatwa and recommendation to respond cases in the society including the Ahmadiyah case. Thus, this article aims at describing the aforementioned fatwa and recommendation on the Ahmadiyah and the debate around them.MUI, sebuah organisasi ulama yang dibentuk pemerintah pada tahun 1975, ditujukan sebagai pemegang otoritas nasional dalam Islam di Indonesia. Organisasi ini berfungsi sebagai forum bagi para ulama untuk  mendiskusikan berbagai masalah terkait dengan tugas ulama. Oleh karena itu, organisasi ini mengeluarkan keputusan-keputusan dalam bentuk fatwa- fatwa dan rekoomendasi untuk merespon berbagai macam masalah dalam masyarakat termasuk kasus Ahmadiyah. Tulisan ini bermaksud menjelaskan fatwa-fatwa dan  rekomendasi yang telah dikeluarkan MUI tentang Ahmadiyah dan perdebatan seputar fatwa tersebut. Keywords: MUI, Fatwa, Recommendation, Ahmadiyah.

Abstract

It is well known that a large amount of knowledge had been transformed by the Greek's scientist through the works of the scribes who translated various knowledge into Arabic who then retranslated them info other languages. One of the important works of the Greek scientist is a treatise on Medical Regime for the Pilgrims to Mecca that was edited by Gerrit Bos. The author of this work, a Christian scholar named Qusta' ibn Luqa, knows the condition of Mecca quite well that he could write such a complete guide on medicine for somebody who wanted to perform the pilgrimage to the holy city. This, this article aims at describing this prominent work of Qusta' ibn Luqo through the text edition written by Gerrit Bos. Keywords: Qusta' ibn Luqo, Gerrit Bos, manuscript, pilgrimage

Abstract

Recently, marriage among lesbian, gay, bi-sex and transgender inIndonesia became a phenomenal issue discussed by the society. The effort tolegalize such a marriage in Indonesia is conducted in the name of freedomof choice and the human rights that should be upheld. This has evoked prosand cons among the community. Therefore, the researchers are interestedin discussing this marriage in depth, based on the perspective of Islamic andpositive laws. This is a study on normative laws (doctrine) using deductivelogic in analyzing primary and secondary legal materials. The results of thisstudy are (1) in the perspective of Islamic laws, same-sex marriage amongLGBT is forbidden since it violates the nature and is contrary to maqasid shari’ain the sense that it could threaten the essential needs of existence of humanbeings such as not preserving religion, soul, descendants, mind and honor; (2)in the perspective of positive laws in Indonesia, the state allows merely themarriage between male and female and that it should be in accordance withtheir religion. Meanwhile, all religions in Indonesia, including Islam, forbidsame-sex marriage. Therefore, marriage among LGBT is unlawful and as aresult the state does not guarantee their prosperity. Akhir-akhir ini, isu fenomenalperkawinan LGBTdi Indonesiasemakin mencuat ke permukaan dan marak diperbincangkan diberbagaikalangan.Upaya legalisasi perkawinan LGBT di Indonesia semakin marakdilakukan atas nama kebebasan dan hak-hak asasi manusia yang harusdihormati dan dijunjung tinggi. Hal ini tentunyamenimbulkan pro dankontradi kalanganmasyarakatBerdasarkan hal tersebut, peneliti tertarik untukmelakukan kajian mendalam tentang bagaimana sebenarnya perkawinanLGBT dalam perspekif hukum Islam dan hukum positif Indonesia.Penelitianini merupakan penelitian hukum normatif (doktriner), dengan menggunakanlogika deduktifdalam menganalisis bahan hukum primer dan sekunder. Hasildari penelitian ini adalah: (1) Dalam perspektif hukum Islam, perkawinansesama jenis oleh kaum LGBT adalah dilarang karena menyalahi kodrat danbertentangan dengan maqâshid al-syar?’ah, karena dapat mengancam eksistensikebutuhan esensial bagi kehidupan manusia, yaitu tidak terpeliharanya agama,jiwa, keturunan, akal, dan kehormatan; (2) Dalam perspektif hukum positifIndonesia, Negara hanya membolehkan perkawinan yang dilakukan antaralaki-laki dan perempuan, dan pelaksanaannya harus sesuai dengan agamanyamasing-masing. Sementara semua agama di Indonesia, termasuk Islam,tidak membolehkan adanya perkawinan sejenis. Jika dilakukan perkawinansesama jenis oleh kaum LGBT, maka perkawinannya dianggap tidak sahyangberimplikasi kepada tidak diperolehnya jaminan kesejahteraan sosial dariNegara bagi kaum LGBT yang melakukan perkawinan.

Abstract

This paper discusses two relevant fatwas and corresponding recommendations by Indonesian’s Ulema Council (Majlis Ulama Indonesia: MUI) on the doctrines of Ahmadiyah. In doing so, it takes the historical background of the issue of the fatwas along with its political context. MUI in issuing the fatwa received the full political support of the New Order government, which at that time was highly concerned with the national security and stability. Moreover, Indonesia did not seem able to reject the influence of the transnational Islamic countries’ policy, which stronglydemanded that Ahmadiyah must be banned from any Muslim country. A strong influence of particularly the government has created distrust in the MUI’s authority as an Islamic scholar organization that was politically notsterilized. Many have doubted that MUI’s fatwa was genuine and/or even effectively binding, particularly when its fatwa dealt with the status of sects within Islam–whether or not they are heretic.

Abstract

The purpose of this article is to produce new findings or the development of existing theories stating that “the more mature the child the easier it will be for the teacher to teach”. The findings from this research can be used to provide criticism and information for policy, education, and teachers and parents regarding whether children should enter school at the age of 6 and why parents must comply with state regulations on new student admission process (PPDB). The research was conducted in Pangkalpinang, Bangka Belitung Island Province. The researcher observes 4 schools, 7 homeroom teachers of first grade, 4 principles and 235 students of first grade. The technique in collecting data in this article are structured interview and participant observation. This study uses qualitative research method through anthropological approach using ethnography. Finally, the data analysis technique in this article uses reduction, display and verification of data. The article asks whether the culture of school in Bangka Island promote or hinders the principle of the proper age of School. We found that Jean Piaget’s stages of cognitive development have influenced the proper age for school in Bangka Island. The authors believe that Bangka follows the cultural global construction in determining the proper age of a child to enter the elementary school.
