Abstract

Islamisation in the Indonesian archipelago has been ongoing for centuries. Islam emerged as an influential force in the history of the archipelago. The entry of Islam into Indonesia, a country diverse in culture, led to culture and religion being closely linked. In the Angkola Batak tradition, ancestors' teachings remained embedded in everyday life until after the arrival of Islam, when acculturation and interrelationships took place between Islamic culture and religion. This study uses a qualitative research method, with a library research approach focusing on the acculturation of Sinamot (dowry) culture in the Batak Angkola community of South Tapanuli. The study findings cover three aspects of the topic. First, the social condition of the Angkola Batak community, which adheres to the dalihan na tolu social structure as a benchmark for communicating, acting, and resolving social problems. Second, the interrelationship between customs and Islam in the Sinamot tradition (one of the series in Angkola Batak marriages) in determining the amount of Sinamot is attended by the nuclear family from both parties to resolve the specified amount. Finally, it was discovered that there were changes in the banquets in the deliberation, such as abandoning forms prohibited in Islamic teachings, such as those involving the consumption of pork and palm wine, and also changes in the Sinamot tradition in the marriages of the Angkola Batak community due to several factors, including changes resulting from the move from traditional to modern times, and the wishes of the Batak Angkola community to familiarise themselves with and keep up with the times. The introduction of Islam provided a systematic and logical variation, allowing society to easily accept it at wedding ceremonies.

Abstract

Purpose – This article examines marriage registration in Islamic family law by positioning it as a legal-political arena, rather than merely an administrative requirement. Employing a qualitative socio-legal approach, this study investigates how the modern state constructs compulsory marriage registration as a mechanism for integrating Islamic norms, public interest, and legal pluralism. The analysis combines normative Islamic legal inquiry, historical examination of regulatory developments, and legal-political theories—particularly John Hart Ely’s representation-reinforcing theory, Savigny’s historical jurisprudence, and Mahfud MD’s contextual legal-political framework. Methods– This study employs a socio-legal method to examine marriage registration as a legal, social, and political construct within the framework of Islamic family law. Findings – The findings demonstrate that marriage registration signifies the transformation of Islamic family law from a community-based legal order into a state-centered legal system oriented toward rights protection, legal certainty, and social justice. From the perspective of maṣlaḥah mursalah and maqāṣid al-sharī‘ah, marriage registration functions as a legal mechanism to safeguard vulnerable groups, especially women and children, while simultaneously serving as a state instrument for shaping a legally recognized and administratively ordered family structure.  Research implications – The main contribution of this article lies in proposing an analytical framework that conceptualizes marriage registration as a site of legal-political negotiation between the state, religion and society. By foregrounding power relations, legal policy, and normative integration, this study advances contemporary scholarship on Islamic family law and highlights the political dimensions of the regulation of family institutions in Muslim societies.

Abstract

This study examines Islamic family law policies concerning child protection in Indonesia, with a specific focus on the regulation of child financial support and maintenance obligations. Islamic law provides comprehensive normative guidance on family welfare and parental responsibility; however, gaps often emerge at the level of legal implementation. Using a normative juridical approach, this study analyzes secondary legal materials, including statutory regulations such as the Marriage Law and the Compilation of Islamic Law, as well as relevant legal doctrines and court decisions. The findings reveal several concrete weaknesses in the implementation of child support obligations, including the absence of effective enforcement mechanisms against non-compliant parents, limited judicial consistency in determining the amount and continuity of maintenance, and the marginalization of children’s financial rights in post-divorce disputes. These weaknesses result in recurrent violations of children’s rights to adequate financial support, particularly in cases involving divorce and economic vulnerability. This study underscores the necessity of strengthening normative clarity, judicial enforcement, and legal awareness to ensure comprehensive and effective protection of children’s financial rights within Indonesia’s Islamic family law framework. [Studi ini mengkaji kebijakan hukum keluarga Islam terkait perlindungan anak di Indonesia, dengan fokus khusus pada regulasi dukungan finansial dan kewajiban pemeliharaan anak. Hukum Islam memberikan panduan normatif yang komprehensif mengenai kesejahteraan keluarga dan tanggung jawab orang tua; namun, celah sering muncul pada tingkat implementasi hukum. Menggunakan pendekatan juridis normatif, studi ini menganalisis bahan hukum sekunder, termasuk peraturan perundang-undangan seperti Undang-Undang Perkawinan dan Kompilasi Hukum Islam, serta doktrin hukum yang relevan dan putusan pengadilan. Temuan menunjukkan beberapa kelemahan konkret dalam implementasi kewajiban dukungan finansial anak, termasuk ketidakhadiran mekanisme penegakan hukum yang efektif terhadap orang tua yang tidak patuh, ketidakkonsistenan yudisial dalam menentukan jumlah dan kelangsungan pemeliharaan, serta marginalisasi hak finansial anak dalam sengketa pasca-cerai. Kelemahan ini mengakibatkan pelanggaran berulang terhadap hak anak untuk mendapatkan dukungan finansial yang memadai, terutama dalam kasus perceraian dan kerentanan ekonomi. Studi ini menekankan pentingnya memperkuat kejelasan normatif, penegakan hukum, dan kesadaran hukum untuk memastikan perlindungan komprehensif dan efektif terhadap hak-hak finansial anak dalam kerangka hukum keluarga Islam Indonesia.]
