Abstract

Penyelundupan Pekerja Migran Indonesia merupakan suatu bentuk kejahatan transnasional yang bisa dikatakan terorganisir. Dalam perkembangannya banyak faktor-faktor yang menyebabkan terjadinya penyelundpan Pekerja Migran Indonesia ke Negara lain, salah satunya kelompok pelaku kejahatan penyelundup yang terorganisir. Hal ini dibuktikan dengan cara kerja para pelaku kejahatan dapat mengetahui resiko dan alur pertanggungjawaban terkait pidana pelaku penyelundupan manusia menurut hukum positif Indonesia. selain itu, modus operandi yang dilakukan oleh para pelaku dengan menggunakan pelabuhan ilegal yang sulit diakses oleh masyarakat yang bersifat tertutup dan temporer. Otak intelektual ini diduga bergerak disaat adanya upaya perlindungan oleh oknum otoritas yang dapat menjamin keamanan para pelaku kejahatan. Hal ini bertujuan untuk memberikan informasi kepada otak intelektual untuk bekerja di saat pengawas keamanan lengah. Secara garis besar praktik penyelundupan Pekerja Imigran Indonesia merupakan bentuk kejahatan terorganisir. Hal tersebut dibuktikan berdasarkan teori yang dikemukan oleh Frank Hagan pada Traditional Crime Syndicates, unsur 8 unsur kejahatan terorganisir.

Abstract

Traffic accidents involving electric bicycles in the Sula Islands continue to increase; however, regulatory gaps and low levels of safety awareness make case resolution by the police more complex, requiring adaptive and effective legal strategies that are aligned with local social conditions. This study aims to analyse the application of law, case resolution mechanisms, and factors influencing the handling of traffic accidents involving electric bicycles within the jurisdiction of the Sula Islands Police. The study is grounded in several theoretical and conceptual frameworks, including Progressive Law Theory, Public Policy Theory, Management Theory, Traffic Accident Concept, Electric Bicycle Concept, Restorative Justice Concept, Community Policing Concept, Case Resolution Concept, and Police Science Concept. A qualitative case study method is employed to examine empirical conditions and law enforcement practices. The findings indicate that law enforcement in electric bicycle accident cases is constrained by the absence of regional regulations, leading to reliance on supervision and appeals; case settlement therefore adopts an adaptive, restorative justice-oriented approach focused on victim recovery, accountability, and community involvement; and effectiveness is determined by officer competence, resource availability, and integrated, flexible working methods. Overall, this study underscores the urgency of strengthening local regulatory frameworks and institutional capacity to ensure legal certainty, public safety, and substantive justice in a sustainable manner.

Abstract

Community policing has become a strategic approach adopted in many countries to enhance public trust in the police and to create safer and orderly neighborhoods. It emphasizes active partnership between the police and the public in detecting, preventing, and tackling crime collaboratively. Indonesia and New Zealand have both implemented community policing systems with characteristics that reflect institutional isomorphism. This study examines isomorphism in community policing in the two countries and explore the development of community policing practices through a literature case study. Data were obtained through digital research, interviews, observations, and documentation, which were analyzed using textual and social network analysis methods. The findings reveal significant similarities between policing systems of the two countries’, including the existence of a single national police force that respects the principle of independence and the adoption of community policing models. Nevertheless, differences remain, mainly due to each country’s distinct social, cultural, and historical contexts. These variations influence the implementation patterns of community policing, although both countries share similar core objectives, namely, improving security and building public trust. Thus, the findings suggest that isomorphism in policing provides opportunities for sharing best practices across countries, enabling international collaboration and mutual learning to improve the effectiveness of community policing strategies.
