Abstract

This article aims at promoting sustained character building through literature especially for college students in Indonesia. Till present, the character building has been restricted to the embedment of good virtues to children and adolescents. The majority of existing studies and researches, therefore, tend to focus their attention on such limited area. Character building ought to be a sustainable effort halted not when one finishes his/her study at elementary or intermediate grades. It should be maintained all life long. There are two highlighted problems which are going to explore in this paper: first, why literature is still considered to be one of the effective media to establish sustained character building for college students and second, what appropriate Instructional Strategies to conduct such effort are. The result shows that literature is still effective due to its natural characteristics, its wide spectrum, and its dynamically broadened functions. Under the conviction that the students have already been undergoing the process of embedment of some core values before, the given literary works containing, elaborating and questioning or challenging the given embedded values are taken to be the source of discussion. The instructional strategies cover discussion, debate, seminar, film appreciation, and creative writing.Keywords: character building, instructional strategies, literature, sustained

Abstract

Southerners are famous for their exaltation  of their honor and the sanctity of  their private property. Any obstacles in  the ownership and the management of their private property will be regarded as a form of interference and will be eliminated or at least minimalized.   Intestacy laws  and death taxes are regarded as  the government’ s interference. Intestacy laws are applied when there is no valid last will and testament. The taxes  will be high or low depending of  the smartness in utilizing the offered deduction through last will and testament.  Key words:    sanctity of private property, honor, intestacy laws, taxes, interference, last will and testament.

Abstract

This paper aims at revealing that last will and testament in southern white culture does not limit its function as the legal document for transfering material and worldly property as it has recently been the focus of some researchers and the belief of the majority of modern southerners. Southern last will and testament is a symbolic construct. Individually it is the representation or the self expression of the intention of the makers. Southern last will and testament is the expression of individual freedom to give or not to give his property to others and to keep or to reveal their hidden secret to public in the intention of preserving their honor. It is also utilized to embed familial and religious values.

Abstract

Law and Literature movement has been developing in western countries since the first half of the twentieth century as the response of the isolation of law from other disciplines and the idea of humanizing law to have optimal function for the betterment of  social order. This movement exerts great potentials in developing methods of teaching and interpreting legal texts resulting in the betterment of the performance of the law makers and the deeper understanding of law. The isolation also  happens in Indonesia; however, there is not  obvious  echo of the movement  in Indonesia. There is no place of  literature in Indonesians law. Under the movement of law and literature, this qualitative research aims not at finding out the reason of excluding literature from law; instead it aims at demontrating and promoting that literature could give contribution in   understanding and producing humanistic legal texts in Indonesia.  Taking available data by heuristic model and comparative and descriptive analysis, this research concludes that literary works could provide sources of  learning and understanding  law, and  literary theories could be applied in improving the making of more humanistic legal texts in Indonesia.

Abstract

This paper is library research attempting to explore the way to maintain the local identity in globalization for Indonesian particularly their national religious identity. Taking and tracking documents in the form of data relating to the issues of globalization, religious identity, and  Pancasila and adopting the concept of grounded globalism by James L. Peacock which affirms and seeks embodied connectedness to locale, this paper shares the perspective that Pancasila is still qualified and deserve to be used as a basic foundation to maintain and strengthen the national religious identity of the Indonesian people in the global era. Indonesia does not need to be transformed by global identity. Indonesia has already had its own national religious identity which is global. The five principles of Pancasila need to be actualized as the ground and cultural traits of their global identity. By grounding global identity on Pancasila, Indonesians can enjoy globalization without losing its national identity.

Abstract

This study explores a case that occurred on land owned by the former mayor of Semarang, Sukawi Sutarip. On land, land measurement errors occur and land ownership overlaps with other people's ownership. Conflicts between adjacent landowners were inevitable. This study aims to determine the chronology of the conflict, the causes of land measurement error and the legal consequences. This research is juridical-normative in nature, meaning that the truth of statements is measured based on positive legal norms. The data analysed is limited to secondary data collected from the internet. Data were analysed qualitatively. The results showed that it was true that there were errors in land measurement and the main causal factor was due to unprofessional officers; and give rise to legal conflict in the court. The legal consequence is that the certificate becomes legally and administratively flawed.Keywords:    Conflict, Land, measurement, administrative flaw
