Abstract

This research aims to know and to analyze the cause of Abandoned land in Sumbarang village, Tegal regency, the effort which has been done by land office of Tegal regency and the obstacle which is faced by the Tegal Regency’s Land Office in controling the Abandoned land. The type of this research is an empirical law which placed in Sumbarang village, Tegal regency. The source of the data consist of primary and secondary data. It is analyzed by qualitative technique. The results of this research find that the factors of the Abandoned land in Sumbarang village are: (1) the wide of the land is not comparable with the worker (2) the right land is lended to Sugar Company (PG) Pangkah, so the farm is changing function. (3) plant hama attack. The efforts which is done by the land office of Tegal regency toward the Abandoned land are (1) directing the right holder to use their land. (2) monitoring towards the land right, (3) evaluating the land right (4) controling based on Government Regulation Number 11 of 2010 jo. Regulation of the Head of the National Land Agency Number 4 of 2010. The Tegal office land faces some obstacles, they are (1) the right holder lives is unknown, so, it causes difficulty in giving the warn. (2) the right holder is not cooperative. There is no coordination and coorperation betwen the right holder and land Office.Keywords: Controling, Abandoned Land, Tegal Regency

Abstract

Indonesia has defined Pancasila as nation’s ideology which taught people to live with tolerance. Most Indonesian people embraced Islam and some sects such as salafi, wahabi, jama’ah tabligh, ikhwanul muslimin, and hizbut tahrir which offer alternative for Muslim to know and understand in practising Islamic values individually, group or country (Daulah Isamiyah). The emergence of those various teachings organizations become Islam dynamic. Religion (Islam)-based Radicalism movement is deemed to contradict the state ideology, Pancasila. This article tries to examine organizations or Islamic movement which should be tolerable, respect (lakum dinukum waliyadin), and keep the sovereignty of state. Thus, any Islamic movements that are not based on those principles are convinced that they do not come from Indonesian which is identical with local wisdom and plurality. Keywords: ideology, Pancasila, radicalism, Islam, terrorism

Abstract

ABSTRACTBoarding school was a religious educational institution, had become a very important entity in the process of transmutation of values within the Republic of Indonesia, especially in the election. This research was qualitative descriptive exposure. The approach of research was the study on a problem that occured in a scope of society. Collecting data in this study used observation, in-depth interviews, documentary studies and literature study, internet, plus a simple qualitative supporting data. The results showed that the participation of youth in the 2014 election in Pondok Pesantren Ali Maksum positive implications (good) against political resistance region of the boarding school. The implications of such forms of ductility and toughness of youth in response to the 2014 election, because it did not impact on apathy in contributing to the resilience aspect of the 2014 election in the form of resistance to the social and political consciousness, discipline and social dynamics of the region.ABSTRAKPondok pesantren merupakan lembaga pendidikan agama, telah menjadi entitas yang sangat penting dalam proses transmutasi nilai-nilai dalam wilayah Republik Indonesia terutama dalam pemilu. Penelitian ini merupakan penelitian kualitatif dengan pemaparan secara deskriptif. Pendekatan penelitian yang digunakan adalah studi pada suatu permasalahan yang terjadi di suatu ruang lingkup masyarakat. Pengumpulan data dalam penelitian ini menggunakan observasi, wawancara mendalam, studi dokumentasi dan studi kepustakaan, internet, ditambah data penunjang kualitatif sederhana. Hasil penelitian menunjukkan bahwa Partisipasi pemuda dalam Pemilu 2014 di Pondok Pesantren Ali Maksum berimplikasi positif (baik) terhadap  ketahanan politik wilayah pondok pesantren. Bentuk implikasi ini berupa keuletan dan ketangguhan pemuda dalam menanggapi pemilu 2014, karena tidak berdampak pada apatisme dalam berkontribusi dalam pemilu 2014. Aspek ketahanan tersebut berupa ketahanan terhadap kesadaran sosial politik, disiplin wilayah dan dinamika sosial.

Abstract

Abstract: This research aims to identify the factors causing overlapping of land certificates in Land Office of Banjarbaru and the strategy of the office to resolve it. This research is an empirical research. Data collection was conducted through literature study and field study through interviews. The data was analyzed using qualitative method. The results show that: (1) The causes of overlapping of certificate in Kota Banjarbaru are: Land office did not carried out the certification process based on the procedures written on laws and regulations, lack of registration map as a base map, the owner (the applicant) does not life in the same area with the location of the parcel, and lack of awareness of the applicant regarding to land boundaries. (2) The problems were tackled by: grievence mechanism, research, prevention of mutation, revoke the decree and submit lawsuit to the State Administrative Court. (3)The solution and recommendation giving by Land Office of Kota Banjarbaru are the implementation of computerized land registration and good land administration system at land office level and village level.Keyword: overlapping, certificate, freehold title.Intisari: Penelitian ini bertujuan untuk mengetahui faktor penyebab tumpang tindih sertipikat hak milik atas tanah di Kantor Pertanahan Kota Banjarbaru, serta strategi penyelesaian yang dilakukan Kantor Pertanahan. Penelitian ini merupakan penelitian empiris. Pengumpulan data dilakukan dengan studi literatur dan pengumpulan data di lapangan melalui wawancara. Data yang terkumpul dianalisis dengan metode kualitatif. Hasil penelitian menunjukkan bahwa: (1) Faktor penyebab terjadinya tumpang tindih sertipikat hak milik atas tanah pada Kantor Pertanahan Kota Banjarbaru yaitu: Kantor pertanahan tidak menjalankan tugas sesuai dengan prosedur dan ketentuan peraturan perundang-undangan yang berlaku, kantor pertanahan belum memiliki peta pendaftaran yang lengkap, pemohon berdomisili di luar kota dari tanah yang disengketakan, pemohon kurang memahami letak batas tanah miliknya.(2) Penyelesaian masalah dilakukan dengan cara: pengaduan, penelitian, pencegahan mutasi (status-quo), pencabutan Surat Keputusan di Bidang Pertanahan oleh Kantor Pertanahan Kota Banjarbaru dan gugatan ke Pengadilan Tata Usaha Negara Banjarmasin. (3) Solusi dan rekomendasi yang diberikan oleh kantor pertanahan adalah melalui program komputerisasi peta pendaftaran tanah, tertib administrasi pendaftaran tanah, tertib administrasi desa berkaitan dengan informasi tanah.Kata Kunci: tumpang tindih, sertipikat, hak milik.

Abstract

Cultural diversity of the Indonesian nation had the potential to generate a variety of understanding and radical movements, whether in the name of religion, tribe, and class. It became a necessity that this social reality is a frequent cause of horizontal conflict in society, one of which was radical action inte name of religion. Radicalism didn’t only occur in the local-national currents, but that understanding is likely to be internalized by the global discourse on religious issues that have been happening. This study used a qualitative approach with the hope that this approach is able to answer the research question (research question). In addition, through this approach was very possible for researchers to arrange road map and goal setting of each stage performed.Based on the findings of the data, it is necessary to make several approaches culturally, such as: (1) revitalizing Pancasila values and encouraging people to have good religious literacy; (2) on the policy aspect, the government need to have de-radicalization pograms so that the action of radicalism caused by SARA sentiments or other factors can be eliminated. The state had a very strategic and important role to make counter-narrative efforts on that actions can be planned systematically, massively, and measurably.

Abstract

This research is intended to find out in-depth the juridical aspects of land registration due to inheritance. Two issues were examined, namely: (1) Why were the requirements for the Deed of Sharing Common Rights mandatory and the Deed of inheritance rejected when registration of the transfer of title to the land due to inheritance? (2) What are the legal consequences of the Deed of Sharing of Joint Rights in the registration of the transfer of title to the certified land due to inheritance? The study was conducted by a combination of literature research and field research. Data were analyzed qualitatively. The results showed: (1) the Magelang Land Office requires that all inheritance of land rights be processed first through inheritance, followed by the making of the Deed of Sharing Common Rights, and then registered, on the grounds that the computerized system is not yet perfect. So it's not a legal problem. (2) The legal consequences are that the heirs are forced to pay tax 2 (two) times. This matter is burdensome to the heirs.

Abstract

This study explores a case that occurred on land owned by the former mayor of Semarang, Sukawi Sutarip. On land, land measurement errors occur and land ownership overlaps with other people's ownership. Conflicts between adjacent landowners were inevitable. This study aims to determine the chronology of the conflict, the causes of land measurement error and the legal consequences. This research is juridical-normative in nature, meaning that the truth of statements is measured based on positive legal norms. The data analysed is limited to secondary data collected from the internet. Data were analysed qualitatively. The results showed that it was true that there were errors in land measurement and the main causal factor was due to unprofessional officers; and give rise to legal conflict in the court. The legal consequence is that the certificate becomes legally and administratively flawed.Keywords:    Conflict, Land, measurement, administrative flaw

Abstract

This study aims to analyze the maladministration of land acquisition for the public interest (Case study: Solo-Yogyakarta Toll Road). This type of research is juridical-normative. The nature of the research: descriptive-qualitative, meaning that it provides an overview of the problem/object being studied. The data studied were limited to secondary data. Sources of data: documents, archives, previous research results, and other validated sources. Data analysis was carried out through the following stages: data reduction, data display, data processing, and data meaning. Conclusions are drawn inductively. The results of the study show: (1). It is true that there has been maladministration in land acquisition. The committee has carried out deceitful practice, namely the practice of lying or being dishonest to the public regarding the contents of the regulation, as well as the assessment of compensation; (2). In the practice of providing compensation for non-physical components, it is not discussed, and is not taken into account, so that the amount of compensation is low; (3). The former holders of land rights feel very disadvantaged because non-physical compensation which includes: moving costs, solatium, PPAT fees, BPHTB fees, and waiting interest expenses, are not taken into account. In fact, these costs are the rights of the people affected by the land acquisition. In order to buy replacement land or move, they had to pay for it themselves.Keywords: Maladministration, compensation, land acquisition
