Abstract

AbstractThis article aims to examine (a) the settlement of Madurese community heritage dispute among legal pluralism; (b) the Madurese consideration which tends to apply adat law based on the consensus principle of inheritance disputes. The enactment of Indonesian Law Number 3 year 2006, which provides absolute competence to the Shari’ah Courts in resolving first level cases among Moslems in the field of inheritance was not followed by the increase interest of Madurese to settle inheritance dispute in the Shari’ah Court. They prefer settling such disputes outside the court. This is a socio-legal research. The results shows that Madurese prefer adat law as the basis of inheritance dispute resolution rather than the state law. The consideration of Madurese to is to maintain harmony and to bind kinship relations between parties. On the other hand, they lack of understanding on civil or shari’ah court procedural law as well as the high expense if choosing a dispute resolution through court.AbstrakArtikel ini bertujuan untuk mengkaji (a) penyelesaian sengketa warisan masyarakat Madura di tengah pluralisme hukum; dan (b) pertimbangan masyarakat Madura lebih memilih hukum adat yang menggunakan prinsip musyawarah dalam penyelesaian sengketa warisan. Diundangkannya Undang-Undang Nomor 3 Tahun 2006 yang memberikan kompetensi absolut kepada Pengadilan Agama untuk menyelesaikan perkara di tingkat pertama antara orang-orang yang beragama Islam di bidang waris ternyata tidak diikuti dengan peningkatan minat masyarakat Madura untuk menyelesaikan sengketa harta warisannya ke Pengadilan Agama. Masyarakat Madura lebih memilih penyelesaian sengketa harta warisannya secara non-litigasi. Penelitian dalam artikel ini menggunakan metode sosio-legal research. Hasil penelitian menunjukkan bahwa dalam menyelesaikan sengketa warisan di tengah pluralisme hukum, masyarakat Madura lebih memilih hukum adat sebagai dasar penyelesaian sengketa daripada hukum Negara. Yang menjadi pertimbangan adalah untuk menjaga kerukunan, menjaga hubungan kekerabatan dan silaturahim diantara para pihak. Di samping itu, kurang pahamnya mereka tentang prosedur beracara dalam hukum formal dan mahalnya biaya yang harus dikeluarkan  jika harus memilih penyelesaian sengketa perdata secara litigasi.

Abstract

Pragaan Daya Village is a village located in Pragaan District, Sumenep Regency, East Java Province. Pragaan Daya Village is a village that has a thousand abundant resources, both natural resources and human resources. This wealth of resources should be used as best as possible to support the economy of the community. As is known, in this village there are abundant siwalan fruit plants which are known to have a different taste from siwalan fruits in other places. The siwalan fruit in this village has a legit and high-quality taste that makes this siwalan fruit a pity if it is not processed properly. So by doing so, we, the KKNT students of Trunojoyo Madura University, help create this siwalan fruit so that later it can become an MSME idea for the community in Pragaan Daya village. So that the creation of this siwalan fruit can be known to the wider community and can become an economic field for the community.
