Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis mengapa praktik trademark squatting dapat terjadi dalam proses pendaftaran merek beserta cara mengatasinya. Selanjutnya, penelitian ini juga membahas mengenai konsepsi ideal terkait proses pendaftaran merek di Indonesia guna menghindari dan meminimalisasi praktik trademark squatting. Penelitian ini merupakan penelitian kualitatif yang bersifat yuridis empiris dan data yang terkumpul dianalisa dengan metode deskriptif kualitatif. Hasil penelitian menunjukkan bahwa praktik trademark squatting merupakan suatu tindakan mendaftarkan merek milik orang lain yang belum terdaftar, sehingga membuat pemilik merek yang sebenarnya tidak dapat lagi mendaftarkan mereknya. Setelah itu, pelaku menjual sertifikat hak atas merek tersebut kepada pemilik aslinya dengan harga melebihi biaya permohonan pendaftaran merek pada umumnya. Kendala yang ditemui dalam proses pendaftaran merek di Indonesia adalah kurangnya sumber daya manusia dalam menangani jumlah permohonan pendaftaran merek yang mencapai ribuan setiap harinya. Hal ini berdampak pada tidak optimalnya proses pendaftaran merek di Indonesia yaitu dengan menggagas suatu sistem yang bernama first to file based on use guna mengoptimalisasikan perlindungan pemilik merek, pertimbangan untuk meratifikasi Madrid System juga merupakan salah satu opsi lain untuk mencegah praktik trademark squatting.Trademark Squatting Practice in Trademark Registration Process in IndonesiaAbstractThe purpose of this research is to identify and analyze why the practice of trademark squatting could occur in Indonesias trademark registration process along with the constraints found in the trademark registration process in Indonesia and how to overcome them. Furthermore, it will also discuss the ideal conception related to trademark registration process to avoid and minimize the practice of trademark squatting. This research is an empirical legal research and all data were analyzed with qualitative methods. The results showed that trademark squatting is an act performed by actors (trademark squatters) to file trademarks application owned by others, so that when application registered by the real owner is rejected, the trademark squatters will offer the real trademark owners to buy the certificate with unreasonable price. Obstacle encountered in the process of trademark registration in Indonesia is the lack of human resources who handle the application which caused the inspection process to become ineffective. The ideal concept of the trademark registration process can be achieved by initiating first to file based on use system to strengthen protections for trademark owner. Abstract

AbstractThis research aims to identify and to analyze the legal reason for “Object Protection Rules” on vehicle insurance contract of PT Asuransi Takaful Umum based on the principles of Islamic law, the Sharia. The reason is to assure the contract, the Akad, of vehicle insurance of PT Asuransi Takaful Umum fulfills the sharia requirement. The requirement should cover only the objects permitted by the Sharia. Moreover, the Indonesian Sharia Economic Code (KHES) obliges every contract to fulfill all requirements related to objects and purposes of contract. The implementation of Object Protection Rules based on Sharia Principles in the vehicle insurance of PT Asuransi Takaful Umum is not effective. This is evidenced by the lack of explanation of the clause by PT Asuransi Takaful Umum to the insurance participants at the registration process. In addition, there is no control mechanism by PT Asuransi Takaful Umum to assure the use of insurance object as the contract goes. Furthermore, PT Asuransi Takaful Umum faces difficulties in tracing the history of insurance object use when the insurance participants make their claim.AbstrakPenelitian ini bertujuan untuk mengetahui dan menganalisis alasan hukum dari adanya klausula mengenai “Ketentuan Objek Perlindungan Dengan Prinsip Sharia Islam” pada polis asuransi kendaraan bermotor PT Asuransi Takaful Umum. Hasil penelitian memperlihatkan bahwa alasan hukum dari adanya klausula mengenai “Ketentuan Objek Perlindungan Dengan Prinsip Sharia Islam” pada polis asuransi kendaraan bermotor PT Asuransi Takaful Umum adalah guna menjadikan akad atau perjanjian pada produk asuransi kendaraan bermotor menjadi benar-benar sesuai dengan sharia Islam dengan sebisa mungkin hanya melindungi objek-objek asuransi yang secara sifat maupun pemanfaatannya sesuai dengan sharia Islam. Hal ini didasari oleh adanya pengaturan mengenai objek akad dan tujuan pokok akad sebagai syarat sahnya suatu akad dalam Kompilasi Hukum Ekonomi Sharia (KHES) yang menyatakan hanya objek yang sesuai dengan sharialah yang boleh ada dalam akad. Penerapan klausula mengenai “Ketentuan Objek Perlindungan Dengan Prinsip Sharia Islam” pada polis asuransi kendaraan bermotor PT Asuransi Takaful Umum dapat dikatakan belum efektif. Terlihat pada belum optimalnya sosialisasi kepada calon peserta asuransi mengenai keberadaan klausula tersebut pada proses awal permohonan penutupan asuransi. Hal ini berlanjut pada saat periode perjanjian asuransi berjalan dimana tidak ada mekanisme untuk mengawasi penggunaan objek oleh peserta asuransi. Sejalan dengan itu pada saat proses pengajuan santunan klaim oleh peserta asuransi PT Asuransi Takaful Umum kesulitan untuk mengecek apakah kendaraan bermotor yang diasuransikan selama periode asuransi digunakan pada kegiatan-kegiatan yang sesuai dengan sharia Islam.DOI: https://doi.org/10.22304/pjih.v5n2.a8

Abstract

The purpose of this study is to determine and analyze the upcoming risks that can occur in the bank as a new creditor over the implementation of transfer of receivable house ownership credit (KPR) via top up. In addition, this study also discusses the form of ideal legal protection for banks as the new creditor over the transfer of house ownership credit via top up. The research that use Bank Tabungan Negara (BTN) Yogyakarta Branch as the respondent is a qualitative empirical legal research and analyze the data collected by qualitative descriptive method. Take over KPR via top up have a legal certainty risk associated with the interlude time between signing the agreement with the transfer of collateral from the old creditor to the new creditor. Currently, the legal protection for banks as the new creditor in the implementation of take over KPR via top up is only in the form of preventive protection that could be seen in precautionary actions to ensure the fullfillment of the rights and obligations of the parties. Furthermore, subrogation agreements are also required as a complement and legal basis to ensure the release of the collateral from the previous agreement.

Abstract

Abstract Mediation is a method of resolving disputes through a negotiation process to obtain an agreement between the Parties with the assistance of a Mediator. Normally the mediation process is carried out directly face to face. Still, the COVID-19 pandemic that has spread in Indonesia since March 2020 has significantly impacted the order of people's lives, including the justice sector. One of the keys to minimizing the spread of COVID-19 is to reduce the intensity of face-to-face meetings, including implementing the mediation process, which has begun to be directed to be carried out remotely or electronically. This study seeks to provide answers related to the extent of the role of electronic mediation as an alternative to civil dispute resolution in the District Court (PN). In addition, this study also discusses the factors that hinder the implementation of electronic mediation. The research that uses the PN Padang and PN Marabahan as the object of this research is qualitative research with empirical juridical nature. It analyzes the collected data using a qualitative descriptive method. The study results show that in both the PN Padang and PN Marabahan, the application of electronic mediation has not been appropriately implemented and standardized. This can be seen in the non-uniform application of electronic mediation among the district courts that are the research object. At the PN Marabahan, the application of electronic mediation was only carried out several times, but this was not done because it prevented the spread of COVID-19 but had to be done when the province of South Kalimantan experienced a flood. Hence, the parties couldn't attend court. In the PN Padang, electronic mediation has been carried out by one of the judges several times. However, the implementation is still sporadic, where other judges have not utilized the electronic mediation. The factor that hinders the implementation of electronic mediation is that there is no technical rule from the Supreme Court that regulates the implementation of electronic mediation. Keywords: alternative civil dispute resolution; electronic mediation; COVID-19 pandemic Abstrak Mediasi adalah cara penyelesaian sengketa melalui proses perundingan untuk memperoleh kesepakatan Para Pihak dengan dibantu oleh Mediator. Normalnya proses Mediasi dilaksanakan secara langsung dengan bertatap muka, akan tetapi Pandemi COVID – 19 yang merebak di Indonesia sejak bulan Maret 2020 berdampak besar pada tatanan kehidupan masyarakat tidak terkecuali pada sektor peradilan. Salah satu kunci untuk meminimalisasi penyebaran COVID – 19 adalah dengan mengurangi intensitas pertemuan tatap muka secara langsung, termasuk pada pelaksanaan proses Mediasi yang mulai diarahkan untuk dilaksanakan secara jarak jauh atau elektronik. Penelitian ini berupaya memberikan jawaban terkait sejauh mana peranan Mediasi elektronik sebagai alternatif penyelesaian sengketa perdata di Pengadilan Negeri (PN). Selain itu, penelitian ini juga membahas mengenai faktor yang menghambat terimplementasinya Mediasi elektronik. Penelitian yang menjadikan PN Padang dan PN Marabahan sebagai objek penelitian ini merupakan penelitian kualitatif yang bersifat yuridis empiris dan menganalisa data yang terkumpul dengan metode deskriptif kualitatif. Hasil penelitian menunjukan bahwasanya baik di PN Padang maupun PN Marabahan penerapan Mediasi elektronik belum terlaksana dengan baik dan terstandar. Hal ini terlihat pada masih belum seragamnya penerapan Mediasi secara elektronik di antara pengadilan negeri yang menjadi objek penelitian. Pada PN Marabahan penerapan Mediasi elektronik baru dilaksanakan beberapa kali namun hal tersebut dilakukan bukan karena mencegah penyebaran COVID – 19 tetapi terpaksa dilakukan saat provinsi Kalimantan Selatan mengalami musibah banjir sehingga para pihak tidak mungkin hadir ke pengadilan. Pada PN Padang Mediasi elektronik sudah beberapa kali dilaksanakan oleh salah seorang Hakim, namun pelaksanaannya masih bersifat sporadis dimana Hakim – Hakim lain belum memanfaatkan Mediasi elektronik tersebut. Faktor yang menghambat terlaksananya Mediasi secara elektronik adalah dikarenakan belum adanya aturan teknis dari Mahkamah Agung yang mengatur pelaksanaan Mediasi secara elektronik Kondisi ini ditambah juga dengan adanya ketidakpahaman dari masyarakat pengguna peradilan terkait dimungkinkannya pelaksaanaan Mediasi secara elektronik. Abstract

Eigendom verponding is a right to land ownership whose rights must be adjusted through the conversion provisions of the UUPA. The implementation of the conversion was given a period of time until September 24, 1980. In practice, there was still recognition of ownership of the formerland eigendom verponding which later resulted in a dispute over the land. For example, the acknowledgment of ownership of the former eigendom verponding in decision number 19/Pdt.G/2019/PN.Slw and decision number 30/Pdt.G/2019/PN.Unr. The formulation of the problem in the research: 1. What is the legal status of the formerland eigendom verponding which has not been converted according to the laws and regulations? 2. What are the legal consequences for holders of ex-rights eigendom verponding that are not converted in land ownership disputes? The approach method used is qualitative with the type of normative legal research. The main data source comes from secondary data which is also interviewed as supporting data. Secondary data sources are divided into primary legal materials, secondary legal materials, and tertiary legal materials. Data collection techniques using library research and field studies in the form of interviews.

Abstract

This research discusses the making of a marriage agreement before and after the marriage period in terms of Indonesian law. The purpose of this research is to understand the differences in the application of marital agreements made before and after the issuance of the Constitutional Court Decision Number 69/PUU-XIII-2015. This research uses a normative juridical method by examining several laws and regulations governing marital agreements. The results of this study indicate that the making of a marriage agreement during the marriage period is a valid agreement because the Constitutional Court Decision Number 69/PUU-XIII-2015 regarding the timing of making a marriage agreement is a final and binding decision.

Abstract

In Indonesia, the settlement of disputes through arbitration is regulated by Law no. 30 of 1999 concerning Arbitration and Alternative Problem Resolutions. Article 7 Law no. 30 of 1999 stipulates that the parties can agree to an agreement on a dispute that has occurred or will occur between them to be resolved through arbitration with a written agreement agreed upon by the parties. In the selection of arbitral settlement there is a link between the arbitration clause and the selection of settlement through arbitration as well as the implementation of absolute authority and the selection of arbitral institutions in the practice of dispute resolution outside the court. The approach method used is normative juridical. The results of the study state that the choice of arbitration as a dispute resolution is based on a contract in accordance with what is implied in Article 7 and Article 9 paragraph (1) of Law Number 30 of 1999, and in this case the parties to the agreement agree to include an arbitration clause, The court is bound by the agreement made by the parties, with the provisions of the article, the absolute competence of arbitration is born when the parties expressly choose to resolve disputes through an arbitration forum where this has been accommodated in Article 3, Article 4, Article 10 and Article 11 paragraphs (1) and (2) in Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution, which negates the authority of court institutions to examine cases that are already bound by an arbitration clause.

Abstract

For the purpose of regulating the financial effects of their marriage, a husband and wife may enter into a prenuptial or postnuptial agreement. In light of Law No. 1 of 1974, the author seeks to clarify the effect of a postnuptial agreement and the subsequent status of the spouses' property. Juridically, the research is based on an approach to the principles of legal principles and rules relating to the applicable legislation, the Implementing Government Regulation of the Republic of Indonesia Number 9 of 1975 concerning the Implementation of Law Number 1 of 1974, and the decision Number 69/PUU-XIII/2015 of the Constitutional Court of the Republic of Indonesia. Constitutional Court decision 69/PUU-XIII/2015 governs the process by which a husband and wife can enter into a marriage agreement after their wedding by using a District Court Decision.

Abstract

ABSTRACTThe company understands the importance of land acquisition for the smooth operation of its business activities. However, in practical fieldwork, the company encounters several obstacles in acquiring land. The purpose of writing this journal article is to identify obstacles and efforts to resolve land rights acquisition issues for the company's operations in Klaten Regency. The research method employed is empirical juridical, focusing on the implementation of normative legal provisions in societal legal events. Research findings indicate that obstacles in land rights acquisition can be overcome through dedicated land acquisition for industrial zones. The primary challenge in acquiring land for the company's business activities is the extended process of obtaining Building Use Rights on behalf of the company and significant land price escalation.Keywords: Company; Business Activity; Land Bank.ABSTRAKPerusahaan (perseroan) memahami pentingnya perolehan tanah untuk kelancaran kegiatan usahanya. Namun, dalam praktek lapangan, perusahaan menghadapi sejumlah kendala dalam mengakuisisi tanah. Top of Form Tujuan dari penulisan artikel jurnal ini adalah untuk mengetahui kendala dan upaya menyelesaikan masalah perolehan hak atas tanah untuk kegiatan usaha perseroan di Kabupaten Klaten. Metode penelitian yang digunakan adalah yuridis empiris, yang berfokus pada implementasi ketentuan hukum normatif dalam peristiwa hukum masyarakat. Hasil penelitian menunjukkan bahwa kendala dalam perolehan hak atas tanah dapat diatasi dengan pengadaan tanah khusus untuk kawasan industri. Kendala utama dalam perolehan tanah untuk kegiatan usaha perseroan adalah lamanya proses perolehan Hak Guna Bangunan atas nama perseroan dan kenaikan harga tanah yang signifikan.Kata Kunci: Perseroan; Kegiatan Usaha; Bank Tanah

Abstract

Perkawinan merupakan jalan untuk memenuhi kebutuhan batin dan kebutuhan biologis manusia yang di ikat pada suatu upacara baik itu secara adat maupun secara agama dan negara dalam ikatan yang sah. Aturan mengenai perkawinan di Indonesia diatur pada Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan. Seiring berjalanya waktu perkembangan pemikiran manusia, perkawinan beda agama apabila tidak diperbolehkan dipandang sebagai suatu yang diskriminatif. Tujuan dari penelitian ini untuk menjelaskan tentang tinjauan yuridis perkawinan beda agama di Pengadilan Negeri Ungaran. Penelitian ini menggunakan metode yuridis empiris dengan studi kepustakaan merupakan suatu penelitian menggunakan data sekunder yang menitikberatkan pada norma-norma hukum yang terdapat pada penetapan pengadilan maupun peraturan perundang-undangan yang berlaku, kemudian Undang-Undang Dasar Negara Republik Indonesia tahun 1945 dan juga Undang-Undang Nomor 1 tahun 1974 tentang Perkawinan. Hasil penelitian menunjukan bahwa adanya inkonsistensi hukum terkait perkawinan dan warisan beda agama di Indonesia. Meski Undang-Undang Perkawinan mewajibkan perkawinan sesuai hukum agama masing-masing, beberapa putusan pengadilan tetap mengesahkan perkawinan beda agama dengan dasar hak asasi manusia. Dalam hal warisan, hukum positif hanya mengakui pewarisan antar pihak yang seagama, sebagaimana ditegaskan dalam Putusan MA No. 172 K/Sip/1974, meskipun KUH Perdata tidak mengaturnya secara jelas.
