Abstract

In Indonesia, the settlement of disputes through arbitration is regulated by Law no. 30 of 1999 concerning Arbitration and Alternative Problem Resolutions. Article 7 Law no. 30 of 1999 stipulates that the parties can agree to an agreement on a dispute that has occurred or will occur between them to be resolved through arbitration with a written agreement agreed upon by the parties. In the selection of arbitral settlement there is a link between the arbitration clause and the selection of settlement through arbitration as well as the implementation of absolute authority and the selection of arbitral institutions in the practice of dispute resolution outside the court. The approach method used is normative juridical. The results of the study state that the choice of arbitration as a dispute resolution is based on a contract in accordance with what is implied in Article 7 and Article 9 paragraph (1) of Law Number 30 of 1999, and in this case the parties to the agreement agree to include an arbitration clause, The court is bound by the agreement made by the parties, with the provisions of the article, the absolute competence of arbitration is born when the parties expressly choose to resolve disputes through an arbitration forum where this has been accommodated in Article 3, Article 4, Article 10 and Article 11 paragraphs (1) and (2) in Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution, which negates the authority of court institutions to examine cases that are already bound by an arbitration clause.

Abstract

Eigendom verponding is a right to land ownership whose rights must be adjusted through the conversion provisions of the UUPA. The implementation of the conversion was given a period of time until September 24, 1980. In practice, there was still recognition of ownership of the formerland eigendom verponding which later resulted in a dispute over the land. For example, the acknowledgment of ownership of the former eigendom verponding in decision number 19/Pdt.G/2019/PN.Slw and decision number 30/Pdt.G/2019/PN.Unr. The formulation of the problem in the research: 1. What is the legal status of the formerland eigendom verponding which has not been converted according to the laws and regulations? 2. What are the legal consequences for holders of ex-rights eigendom verponding that are not converted in land ownership disputes? The approach method used is qualitative with the type of normative legal research. The main data source comes from secondary data which is also interviewed as supporting data. Secondary data sources are divided into primary legal materials, secondary legal materials, and tertiary legal materials. Data collection techniques using library research and field studies in the form of interviews.

Abstract

This research aims to analyze the regulation development of objection against the KPPU's decision after the issuance of the Supreme Court Regulation (PERMA) No. 3/2021 and its implementation. The research is descriptive with normative juridical type, using primary data through interviews and secondary data through library research, using qualitative analysis and logical deduction reasoning. There are differences in absolute competence, timeframe, and case examination between PERMA No.3/2021 with previous arrangements. This PERMA has been implemented at the Commercial Courts of Central Jakarta, Surabaya, and Medan. In addition, the transfer of absolute competence to the Commercial Court makes the performance of the KPPU's litigation team more efficient because it no longer needs to travel to many cities to face objections, considering the Commercial Court is only domiciled in 5 regions throughout Indonesia. Commercial Court judges should also understand business law better and be expected to produce quality decisions.

Abstract

For the purpose of regulating the financial effects of their marriage, a husband and wife may enter into a prenuptial or postnuptial agreement. In light of Law No. 1 of 1974, the author seeks to clarify the effect of a postnuptial agreement and the subsequent status of the spouses' property. Juridically, the research is based on an approach to the principles of legal principles and rules relating to the applicable legislation, the Implementing Government Regulation of the Republic of Indonesia Number 9 of 1975 concerning the Implementation of Law Number 1 of 1974, and the decision Number 69/PUU-XIII/2015 of the Constitutional Court of the Republic of Indonesia. Constitutional Court decision 69/PUU-XIII/2015 governs the process by which a husband and wife can enter into a marriage agreement after their wedding by using a District Court Decision.

Abstract

This research discusses the making of a marriage agreement before and after the marriage period in terms of Indonesian law. The purpose of this research is to understand the differences in the application of marital agreements made before and after the issuance of the Constitutional Court Decision Number 69/PUU-XIII-2015. This research uses a normative juridical method by examining several laws and regulations governing marital agreements. The results of this study indicate that the making of a marriage agreement during the marriage period is a valid agreement because the Constitutional Court Decision Number 69/PUU-XIII-2015 regarding the timing of making a marriage agreement is a final and binding decision.

Abstract

ABSTRACTMixed marriages involving differences in nationality between WNI and WNA give rise to legal consequences regarding land ownership, particularly when such marriages are conducted without a prenuptial agreement. This issue is significant because legal certainty for WNI in maintaining land ownership, which  is reserved exclusively for Indonesian citizens, has not been fully ensured. This study aims to examine legal certainty concerning land ownership for WNI in mixed marriages without a marital property separation agreement. The research employs a normative juridical method with a literature-based approach. The findings indicate that in mixed marriages without a prenuptial agreement, WNI may lose certain land rights, as land acquired during the marriage is considered joint marital property, thereby granting WNA an indirect legal interest in the land.  Keywords: Legal Certainty; Mixed Marriage; Land Ownership Right.ABSTRAKPerkawinan campuran yang melibatkan perbedaan kewarganegaraan antara WNI dan WNA menimbulkan akibat hukum terhadap kepemilikan hak atas tanah apabila perkawinan dilangsungkan tanpa perjanjian kawin. Kondisi ini penting dikaji karena belum terdapat kepastian hukum yang memadai bagi WNI dalam mempertahankan hak atas tanah yang secara hukum hanya dapat dimiliki WNI. Penelitian ini bertujuan menganalisis kepastian hukum kepemilikan tanah bagi WNI dalam perkawinan campuran tanpa perjanjian perkawinan pemisahan harta. Penelitian ini menggunakan pendekatan studi kepustakaan dengan metode penelitian yuridis normatif. Hasil penelitian bahwa perkawinan campuran tanpa perjanjian pemisahan harta bagi WNI berpotensi kehilangan hak atas tanah tertentu karena kepemilikan tanah akan menjadi harta bersama dan WNA secara tidak langsung memiliki bagian dari tanah tersebut.Kata Kunci: Kepastian Hukum; Perkawinan Campuran; Hak Milik Atas Tanah.

Abstract

The level of Sharia compliance in a Sharia insurance contract is closely tied to whether the insured subject matter is permissible (halal) or forbidden (haram). This study explores limitations on insurable subject matter under general Sharia insurance from a Sharia perspective and examines the regulatory frameworks in Indonesia and Malaysia that govern these limitations. Adopting a doctrinal and comparative approach, it finds that insurable subject matter must be halal or otherwise permissible under Sharia, with permissibility depending not only on the nature of the subject matter but also on its intended use. The study also reveals differing scholarly opinions regarding the permissibility of specific subject matter within the context of Sharia insurance. Findings further show that neither Indonesia nor Malaysia has clear regulations governing the scope of insurable subject matter, as existing rules are predominantly general and leave the assessment to Sharia insurance operators. The absence of these regulations can lead to divergent perceptions among operators and may erode consumer trust in Sharia insurance products. This study contributes by identifying regulatory gaps in the scope of insurable subject matter under Sharia insurance and by demonstrating the need for clearer regulatory standards to enhance Sharia compliance and legal certainty.

Abstract

ABSTRACTLanggam Jawa is the result of traditional Indonesian folk culture and becomes the common ownership of the Indonesian people and correlated with this, the Copyright Law (UUHC) stipulates that the copyright of songs, dances, and other works of art in Indonesia is held by the state.  But it is not accompanied by a spirit of legal protection against it. This research is normative legal research, with a statutory approach, using primary and secondary legal materials. Carried out using qualitative analysis, with deductive reasoning. As a result of research on Langgam Jawa as a traditional artwork that has been going on for generations, the copyright protection of traditional works will be held by the state as regulated in Pasa1 10 paragraph 2 of the UUHC.Keywords: Traditional Arts; Javanese Style.ABSTRAKLanggam Jawa ialah hasil kultur tradisional rakyat Indonesia dan menjadi kepemilikan bersama masyarakat Indonesia dan berkorelasi dengan hal tersebut, Undang-Undang Hak Cipta (UUHC) menetapkan hak cipta lagu, tari, dan karya seni lainnya yang ada di Indonesia dipegang oleh negara.  Namun tak diiringi dengan spirit proteksi hukum terhadapnya. Riset ini ialah riset hukum normatif, dengan pendekatan peraturan perundang-undangan, memakai bahan hukum primer dan sekunder. Dilaksanakan dengan memakai analisis kualitatif, dengan penalaran deduktif. Hasil riset Langgam Jawa sebagai karya seni tradisional yang sudah berlangsung turun temurun, maka proteksi Hak Cipta atas karya tradisional akan dipegang oleh negara sebagaimana diatur dalam Pasa1 10 ayat 2 UUHC. Dalam rangka mengembangkan Langgam Jawa dibutuhkan peran masyarakat dan seniman untuk memakai Langgam Jawa dalam segala aktivitas.Kata Kunci: Kesenian Tradisional; Langgam Jawa.
