Abstract

Berbagai usaha yang dilakukan para ahli hukum Islam telah melahirkan produk-produk hukum yang benar-benar aktual dan aplikatif. Tradisi ijtihad yang demikian kuat melahirkan pemikiran-pemikiran yang responsif terhadap tantangan zaman, telah mengantarkan umat Islam pada masa kemajuan Islam, dinamika perkembangan hukum Islam sangat dinamis dan kreatif. Namun Perkembangan selanjutnya dinamika perkembangan hukum Islam menjelma menjadi statis dan kurang apresiatif terhadap laju perkembangan masyarakat. Kenyataan ini terjadi khususnya setelah terjadi kristalisasi mazhab-mazhab fiqh. Namun demikian, terlepas dari kemandegan dan kemajuan yang telah dilalui, setidaknya ada empat produk pemikiran hukum Islam, yakni fiqh, fatwa, yurisprudensi, dan perundang-undangan. Keempat macam produk pemikiran Islam tersebut dalam realitas umat Islam berlaku dan diberlakukan sesuai kebutuhan

Abstract

Tulisan ini akan mengkaji lebih jauh tentang instrumen investasi dengan melihat akad-akad yang digunakan apakah akad itu sesuai dengan syara ataukah akad itu dilarang oleh syara. Investasi merupakan kegiatan muamalah yang sangat dianjurkan, karena dengan berinvestasi harta yang dimiliki menjadi produktif dan juga mendatangkan manfaat bagi orang lain. Instrumen investasi yang dibolehkan oleh syariat Islam diantaranya: ba’i salam, istisna, syirkah, mudharabah dan lain-lain, sedangkan instrumen investasi yang dilarang oleh syara yaitu riba, jual beli utang dengan utang, jual beli hashat dan lain-lain.

Abstract

Islam provides guidance to its adherents who are facing the problem of social inequality by placing tithe as one of the main pillars of Islamic establishment, especially in anticipation of the growth of dynamics and economic equality in society. As a source of funds, tithe is potential to be used as capital for the construction of the Muslims, and it will be very effective in anticipating the social gap in the community. Classical scholars, generally categorize the subject to tithe is cattle, gold, silver, merchandise, property excavation, and agricultural products. Today, contemporary ijtihad, one of which is represented by the book of Yusuf Qardawi, specify wealth that is subject to tithe, as many models and forms of wealth that was born from the increasing of complexity of economic activities. Yusuf Qardawi divide tithe into nine categories: tithe of cattle, tithe of gold and silver which includes money, tithe of trade, tithe of agricultural output includes farmland, tithe of honey and animal production, tithe of minerals and marine products, tithe of plant investment, buildings and others, tithe of livelihood, tithe of services and professions, and tithe stocks and bonds.

Abstract

This journal discusses "Why is there a dysfunction of zakat management institutions against poverty alleviation in Palopo City? From these problems arise several questions: 1) How the system of zakat management in Palopo city? 2) What factors affect the dysfunction of zakat management institutions in alleviating poverty? 3) How to overcome the dysfunction of zakat management institutions against poverty alleviation?The results showed that the collection of zakat fitrah funds and distribution is given responsibility to the UPZ in each mosque while the zakat mal reporting is still submitted to BAZNAS Palopo City. In addition, fundraising is also entrusted to SKPD (Zakat collector whose position in the staffing section) collects zakat through the treasurer and the treasurer submits it to the bank, either Bank BPD Sul-Sel-Bar, BSM and other Sharia banks. Factors affecting disfunction of Zakat Institution is 1. Funding system is not optimal yet, so the existing zakat funds with poor Muslim citizens have not been balanced, 2. There is a tendency of poverty rate to increase because citizens pretend to feel poor, 3.Some Muslims in  Palopo have not realized and do not understand that the charity is a duty for Muslims to be issued so that the lack of zakat funds that cause zakat management institutions have not been maximized in an effort to alleviate poverty through the existing zakat funds. While How to overcome the dysfunction of zakat management institutions against poverty alleviation is Community leaders provide guidance and knowledge to the public about the importance, benefits and laws of zakat, the Government supports the management of zakat with clear and firm regulations. For those who are reluctant to issue their zakat will be subject to the appropriate sanctions, the community supports the institution of zakat by channeling funds to the institution. as well as zakat amil develop the nature of trust in manage zakat and distribute zakat appropriately eight asnaf

Abstract

This paper discusses the dynamic of the Khalwatiyah Sufi Order in North Luwu, South Sulawesi. The type of research is qualitative. The research focuses were the dynamic between the leader (caliphs) and followers of the Khalwatiyah Sufi Order. The authors gathered data through library and field research. The techniques to obtain the data were observation, interview, and documentation. The instruments used were interview guidelines, writing instruments, and mobile phones to record audio and video data. The results showed that: 1) The absence of caliphs who guide and teach the Khalwatiyah followers; 2) The assumption of a Khalwatiyah follower said that today's society is modern material life; 3) The absence of regeneration of these Khal­watiyah followers; 4) The young people from the Khalwatiyah family attending tertiary institutions and following various social organizations, they are more likely to develop their organizations than follow the Khalwatiyah ritual. 5) The effect of the environment.

Abstract

This research is motivated by the relatively high level of aircraft and passenger security, but it is not comparable to the security of baggage services. The purpose of this research is to describe the form of airline responsibility at Makassar Sultan Hasanuddin International Airport in resolving disputes over loss and damage to passenger baggage, the factors that hinder airline baggage protection, as well as the views of Islamic law in resolving problems regarding forms of airline protection for goods. is lost. passenger baggage. Based on the type of data in this study the authors used an empirical approach with qualitative research data types. The types of materials in this study are primary data and secondary data. Data analysis techniques use three stages of data reduction, data display, and conclusion drawing/verification. The results of the study show that the form of air transport legal responsibility for the loss of damaged passengers is recorded in air transport operated by airlines, namely the airline must provide compensation of IDR 200 thousand per kilogram. , a maximum of IDR 4 million. The inhibiting factors for this protection are the acceptance factor of officers in the field, the engine factor, the negligence factor of the officers, and even the negligence factor of air passengers. In Islamic law, responsibility is known as Mas'uliyyah or Accountability, and the concept of responsibility in Islam is Ta'widh. Ta'widh in language is compensation or compensation.

Abstract

This research thoroughly examines the relationship between customary law and Islamic law and how they relate to Mampatangpulo. This type of research is qualitative, and the research location is in Enrekang Duri, where a sociological and phenomenological approach is used. The data in this research comes from primary and secondary data, while the data collection techniques used in this research use observation, interviews, and documentation. Data is processed and analyzed using data reduction techniques, presentation, and conclusion drawing. The results of this research show that the process of implementing the Mampatangpulo Tradition starts from the Sangbonginna, Mangbongi tallu, Mangbongi pitu events and the peak of the Mampatangpulo event after the death of the deceased. In the process of implementing the Mampatangpulo Tradition, several stages of traditional processions are considered sacred and essential to carry out, namely Mangpepellao (Lowering), Mampakande-kande (Feeding), Manggere' beke (Slaughtering a goat). The Mampatangpulo tradition can only be carried out if the procession does not violate Islamic law. According to a review of Islamic law regarding the implementation of the Mampatangpulo tradition, the law is okay when the procession does not violate Islamic law because, in the implementation of the Mampatangpulo tradition that developed in the people of South Sulawesi, there are habits that have positive values. This research also shows a strong relationship between customary law and Islamic law in the Mampatangpulo tradition, such as in the takziah and friendship events. The results of this study confirm that the culture that develops in Indonesian society and globally can be preserved if it does not conflict with Islamic values.
