Abstract

Polygamy is something very sensitive and most painful for women (wives) andchildren. Although Islam allows polygamy, it is difficult for them (wife and children)to accept. Why is that, because love and time will be divided. This paper examinesthe psychological impact of polygamy on children. There are several negative effectsof polygamy on children's psychological. Among them the child feels less loved, thebirth of hatred in the child against a father, the loss of self-confidence in the childand the child will experience trauma. Parents must realize that the growth anddevelopment of children is very important. Parents are responsible for their children.Parents must prioritize children's interests compared to their own interests. Allahwill hold us accountable for every action we (parents) do. Abstract

Islamic law prohibits the practice of adopting children which has juridical implications such as adoption which is known by western law/secular law and the practice of jahiliyah society: namely adoption which makes adopted children become biological children, adopted children are cut off from legal relations with their biological parents, adopted children have Inheritance rights are the same as the inheritance rights of biological children, adoptive parents become absolute guardians of adopted children. Islamic law only recognizes adoption in the sense of transferring the obligation to provide daily living, education, care and so on, in the context of worshiping Allah.

Abstract

Every couple desires a prosperous, peaceful and godfearing home. Let a family create a household as the Prophet (peace and blessings of Allaah be upon him) suggested. With the creation of a household like this, every family member will feel happy, happy, safe, loving each other, looking after each other. Every family member is always called to go home, because the house is not just a shelter when it is raining and hot. But the house is a place of calming the restless heart, a place of family coaching and a place to cultivate inner bonds between its inhabitants. That way arranges the household so beautifully to please all the family members.

Abstract

Joint assets (gono gini) are assets obtained by the husband and wife during the marriage. The assets obtained during the marriage will become one unit, so that when a divorce occurs, the joint assets (gono gini) will be divided into 2 (two), namely ½ (one half) for ex-husband and ½ (one half) for ex-wife. The legal basis for joint property (gono gini), namely: Article 35 paragraph (1) of the Marriage Law. Joint assets (gono gini) cannot be transferred/sold or mortgaged (secured) to another party, unless there is mutual agreement between the husband and wife. This is regulated in Article 36 paragraph (1) of the Marriage Law: "Regarding joint property, a husband or wife can act with the consent of both parties." And Article 92 of the Compilation of Islamic Law (KHI): "A husband or wife is not permitted to sell or transfer joint property without the consent of the other party."

Abstract

Setiap pasangan suami-istri menginginkan rumah tangga yang sakinah, mawaddah wa rahmah. Untuk mewujudkan keluarga yang demikian dibutuhkan bimbingan pranikah. Tujuan dari bimbingan perkawinan adalah untuk membekali calon pengantin supaya masing-masing pengantin mengetahui hak dan kewajibannya. Penting bagi calon pengantin untuk mendapatkan bimbingan guna mempersiapkan mental psikologis dalam menghadapi konflik rumah tangga. Apabila terjadi masalah dalam rumah tangga, setiap pasangan mampu berpikir secara rasional dan mampu mengambil keputusan secara bijak.

Abstract

Islam regulates family matters not in outline, but in detail. This shows a great concern for the welfare of the family. The family is formed through marriage, therefore marriage is highly recommended by Islam for those who already have the ability. The purpose of marriage according to Islam is to fulfill religious instructions in order to establish a harmonious, prosperous and happy family. Harmonious in using the rights and obligations of family members; Prosperous means the creation of inner and outer peace due to the fulfillment of the necessities of life both physically and mentally, so that happiness arises, namely love between family members. If you look at the purpose of marriage above, then sirri marriages that occur in society will be difficult to establish a harmonious, prosperous and happy family. Because sirri marriage contains more harm than benefit. One of the disadvantages is that the wife and children will not get inheritance from the husband. Thus, this sirri marriage is very detrimental to the woman. Therefore, carry out the marriage in accordance with the rules in Islamic law and the Marriage Law.
