Abstract

Penelitian ini, bertujuan untuk mengetahui praktik Sembeq Senggeteng sebagai pencegahan perkawinan pada usia anak di Desa Wanasaba Daya Kecamatan Wanasaba Kabupaten Lombok Timur. Jenis penelitian ini merupakan jenis penelitian lapangan dengan menggunakan metode penelitian kualitatif, sehingga peneliti terjun langsung ke masyarakat dan diperoleh data-data yang valid. Prosedur penelitian ini adalah mengumpulkan data, reduksi data, penyajian data dan tahap verifikasi atau penarikan kesimpulan. Berdasarkan data yang terkumpul kemudian dianalisis dengan menggunakan pendekatan normative sosiologi, dengan menilai fakta dan realita yang terjadi di masyarakat atau nilai-nilai yang menjadi pegangan dalam masyarakat, apakah praktik Sembeq Senggeteng ini sesuai dengan ajaran agama Islam atau bahkan menyimpang. Instrument yang digunakan yakni observasi, wawancara dan juga dokumentasi terkait dengan praktik Sembeq Senggeteng di Desa Wanasaba daya tersebut.

Abstract

The minimum age limit for marriage in Islamic Family Law is a provision that regulates the minimum age limit that must be met by individuals before legally entering into a marriage according to the principles of Islamic law. This is intended to protect the parties involved and ensure the physical, mental and emotional maturity of prospective partners before entering into marriage. This research uses a qualitative descriptive approach using literature study methods to investigate differences in minimum age restrictions for marriage between Islamic law and state policy. Data collection was carried out through direct surveys and literature searches from trusted sources, including international journals, books and e-books. The literature study method involves three essential steps: Literature Inventory, Literature Description, and Literature Comparison. The research focus is focused on analyzing laws regarding minimum age limits for marriage in various countries, with an emphasis on comparisons between Islamic legal views and implementation of state policies. The research findings produced several conclusions, including: 1) Differences in approach between Islamic law which does not set a minimum age limit and state policies such as Indonesia (19 years) and Jordan (18 years); 2) Limiting the age of marriage as an effort to protect and mature individuals in living a married life; 3) Rearranged minimum standardization divergence to prevent misuse; 4) Marriage as an institution with noble purposes, interpreted by Islamic law and adopted by the state taking into account local, social and cultural aspects.

Abstract

This study aims to analyze the status of children born out of wedlock as addressed in Constitutional Court Decision Number 46/PUU-VIII/2010 and to evaluate the decision's alignment with the principles of maqasid al-shari'ah through the lens of the systems theory developed by Jasser Auda. This research employs a library research methodology with a normative-juridical approach. Primary data sources include Constitutional Court Decision No. 46/PUU-VIII/2010 and Jasser Auda’s works on maqasid al-shari'ah, while secondary data were gathered from relevant books, journals, articles, and research findings. Data analysis utilized the content analysis method, applying Jasser Auda’s six system features as the analytical framework: cognitive nature, wholeness, openness, interconnectedness, multi-dimensionality, and meaningfulness. The study finds that Constitutional Court Decision No. 46/PUU-VIII/2010 represents a progressive legal ruling that breaks away from the positivist-legalistic paradigm in marriage law. Based on the analysis using Jasser Auda’s six system features, the decision satisfies all maqasid al-shari'ah criteria: (1) it is grounded in the concept of istilhaq within Islamic law; (2) it provides protection and justice for children born out of wedlock; (3) it is responsive to changing times and avoids entrapment in binary classifications; (4) it considers maqasid 'ammah (general), khassah (specific), and juz'iyyah (partial) objectives; (5) it transcends binary opposition paradigms; and (6) it restores the objective of Islamic law to the public interest (maslaha). This research offers theoretical contributions to the development of contemporary Islamic law and provides practical insights for legal practitioners, policymakers, and legislators in formulating regulations that protect the rights of children born out of wedlock without conflicting with religious principles.
