Abstract

In the Indonesian constitution, children have a strategic role: "The state guarantees the right of every child to survival, growth, and development as well as protection from violence and discrimination". Children are an integral part of human survival and the survival of a nation and state. Therefore, children's best interests should be internalized as the best interests for the survival of mankind. The consequences of the provisions of Article 28B of the 1945 Constitution of the Republic of Indonesia need to be followed up by making government policies aimed at protecting children. To protect the interests of children, the state established Law Number 23 of 2002 concerning Child Protection, amended by Law Number 35 of 2014 concerning Child Protection. More specifically the state also regulates the protection of children who commit crimes. in Law Number 3 of 1997 concerning Juvenile Court which was replaced by Law Number 11 of 2012 concerning the Child Criminal Justice System; however, even though the law has been formed, especially in the settlement of criminal acts committed by children through diversion, there are still weaknesses and legal vacuum. The first formulation of the problem in this study is What are the requirements for a crime that can be diversified in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System? and the second formulation of the problem is What are the juridical consequences if diversion is not carried out by law enforcers in Law Number 11 of 2012 concerning the Child Criminal Justice System? To analyze these problems, the researcher used normative research by reviewing and analyzing laws and regulations related to the settlement of crimes committed by children through diversion in Law Number 11 of 2012 concerning the Child Criminal Justice System.

Abstract

Malpractice is an error or negligence committed by professional staff, such as doctors, lawyers, accountants, dentists or veterinarians, which do not comply with professional standards. In reality, malpractice still often occurs, both in hospitals and medical personnel, even though there are several legal instruments that regulate hospitals and medical practice with sanctions for violators of health laws. The aim of this research is to explore existing deficiencies in legal policies, and propose new legal policies in order to optimally prevent and overcome hospital malpractice. The research method used is a normative research method by examining aspects of criminal law in health law regarding malpractice, as well as theories and expert opinions for better legal policy proposals. From the qualitative analysis of data on primary and secondary legal materials, the following results were obtained: first, there are weaknesses in the health law policy so that it cannot prevent and deal with malpractice optimally, namely the lack of completeness and lack of clarity regarding the formulation of malpractice and its strict sanctions, and a turn towards acts of resistance. the law and limitations of the hospital's responsibility for malpractice committed by doctors or medical personnel. Second, a new legal policy that can be proposed is by formulating clearly and in detail the limits of hospital malpractice in health law, accompanied by strict sanctions or accountability both criminally, civilly and administratively, hospitals.

Abstract

This study examines the application of complaint offenses in copyright law enforcement under Law Number 28 of 2014 concerning Copyright. As part of intellectual property rights, copyright provides legal protection for creative works, enabling creators or rights holders to obtain both economic and moral benefits, and preventing violations such as piracy or unauthorized use. Based on Article 120 of the Copyright Law, most copyright violations are classified as complaint offenses, meaning that investigation and prosecution can only proceed if a complaint is filed by the creator, copyright holder, or an authorized party unless the violation harms the public interest, in which case it is treated as an ordinary crime. This study employs a descriptive-analytical approach to primary, secondary, and tertiary legal materials. The findings indicate that the regulation of complaint offenses offers flexibility for rights holders to choose between litigation and non-litigation resolution. However, implementation faces challenges such as proving ownership, lengthy legal processes, and the potential misuse of complaint withdrawals. In conclusion, applying the complaint offense mechanism to copyright law can balance the protection of individual rights with the public interest, but it requires stronger regulations and greater legal awareness to achieve more effective and equitable enforcement.

Abstract

Money laundering is a serious crime that has a major impact on the economic stability and integrity of the country's financial system. This crime is generally associated with predicate offenses, such as corruption, narcotics, and organized crime, to conceal the origin of illicit wealth. In law enforcement, the application of the reverse burden of proof principle is a crucial strategy for overcoming the difficulty of proof. This study examines the application of the reverse burden of proof principle in the Indonesian criminal justice system, particularly in money laundering cases, as outlined in Law Number 8 of 2010. The method used is normative juridical with a conceptual and statutory approach. The results of the study indicate that the application of the reverse burden of proof principle can strengthen efforts to eradicate money laundering, but must still uphold the principle of fair trial and protection of human rights, especially the presumption of innocence. Law Number 8 of 2010 has not comprehensively regulated the standards of proof, verification, and legal impact of this principle, thus creating a vacuum of norms and legal uncertainty. In practice, the accused is only burdened to explain the origin of the wealth, while the prosecutor proves the elements of the crime. However, this shifting burden of proof still raises concerns about violations of the presumption of innocence. Therefore, the application of the reverse burden of proof principle requires more detailed legal regulations and strict supervision so that it is not misused and continues to guarantee legal justice for the accused.

Abstract

The digital era has brought numerous positive impacts that significantly transform various aspects of human life. Information and communication technology, particularly the internet and social media, has opened up boundless spaces that enable freedom of expression, interaction, and the rapid and widespread dissemination of information. However, this digital transformation does not only bring positive effects. On the other hand, the digital sphere also presents new risks, such as the spread of false information (hoaxes), hate speech, cyberbullying, pornography, as well as cybercrimes such as fraud and hacking. Crimes committed in cyberspace are often more complex as they transcend national jurisdictions, are difficult to trace, and have wide-ranging impacts on public security and order. At the same time, its enforcement potentially restricts freedom of expression, which is a pillar of democracy. This tension between legal protection and freedom of expression raises the question: How have the development and dynamics of legal protection and the threats to freedom of expression under the Electronic Information and Transactions Law (ITE Law) evolved? This study aims to understand, analyze, and interpret the norms by employing a juridical-normative research approach, given the issues being addressed. Fundamentally, the ITE Law carries a noble purpose: to provide legal certainty, protect society from cybercrimes, and create a safe and healthy digital ecosystem. However, in practice, the implementation of the ITE Law is not free from problems. Several provisions, particularly those concerning defamation and hate speech, often spark controversy as they are considered to restrict freedom of expression.

Abstract

Procurement of Goods and Services (PBJ) within local governments is a vital instrument of development that is very vulnerable to abuse of authority practices and corruption crimes. This study aims to examine the limitations of the authority of local government apparatus from the perspective of State Administrative Law and analyze the triggering factors for these deviations using a criminological approach. This research is normative law using a statutory approach and a conceptual approach. The results of the study show that, administratively, the discretion in PBJ must be strictly limited by the General Principles of Good Governance (AAUPB) to prevent the occurrence of detournement de pouvoir, which is supported by the optimization of preventive supervision through probity audits by the Government Internal Supervision Apparatus (APIP). Meanwhile, criminological reviews classify these crimes as white-collar crimes which are analyzed using the Fraud Triangle theory. Corruption of the regional PBJ is triggered by local political pressure, gaps in supervision (opportunities), and normalization of corrupt behavior (rationalization).
