Abstract

Tujuan penulisan makalah ini adalah untuk membahas tinjauan hukum Islam dan hukum positif tentang perlindungan ketenagakerjaan bagi pegawai pemerintah yang memiliki perjanjian kerja (PPPK) dan untuk berbagi ilmu dan memberikan pandangan tentang hal tersebut. Aparatur (ASN), Undang-Undang Nomor 5 Tahun 2014 mengatur dalam pasal 1 angka 4 bahwa PPPK adalah warga negara Indonesia yang memenuhi persyaratan tertentu dan diangkat berdasarkan perjanjian kerja untuk waktu yang telah ditentukan dalam rangka melaksanakan tugas kedinasan. Dan dialam Hukum Islam ASN bisa disamakan dengan tabi’in atau pengikut terhadap ulil amri (pemerintah). Yang dimana pengikut atau pekerja harus selalu patuh kepada pemimpinnya namun jika hal itu tidak sesuai dengan syariat yang ada maka boleh tidak diikuti. Dan dalam hal ini seorang pemimpin juga harus memenuhi hak dari pengikutnya dan menyamakan seluruh hak-hak dari setiap pengikutnya tanpa membeda-bedakannya. Hal ini berlaku juga kepada PPPK yang ada beberapa poin yang berbeda haknya dengan PNS. PPPK memiliki perbedaan dengan PNS yaitu PPPK tidak memiliki hak pensiun, tidak mendapat pola kenaikan pangkat serta bisa diberhentikan sewaktu-waktu oleh instasi terkait. Maka hal inilah yang menjadi permasalahan didalam pengadaan PPPK ini yaitu belum ada perlindungan ketenagakerjaan yang lebih pasti untuk melindungi keberadaan PPPK ini. Permasalahan yang dikaji didalam tulisan ini yaitu mengenai status keberadaan PPPK dan mengenai perlindungan ketenagakerjaan bagi bagi pegawai pemerintah dengan perjanjian kerja (PPPK). Adapun metode penelitian yang penulis gunakan yaitu yuridis normatif, dengan menggunakan pendekatan undang-undang atau statute approach. Adapun hasil dari kajian ini yaitu bahwa perlindungan hukum terhadap PPPK masih belum memadai sehingga baik itu didalam PP No.49 Tahun 2018 maupun didalam UU No. 5 Tahun 2014 masih belum dirincikan mengenai jaminan masa depan dari PPPK ini. Seperti yang diketahui PPPK hanya memiliki hak jaminan hari tua namun tidak ada hak pensiun, dan juga mengenai masa kerja yang sewaktu-waktu bisa dilakukan pemutusan kerja. The purpose of writing this paper is to discuss an overview of Islamic law and positive law on labor protection for government employees who have an employment agreement (PPPK) and to share knowledge and provide views on this matter. Apparatus (ASN), Law Number 5 of 2014 stipulates in article 1 number 4 that PPPK is an Indonesian citizen who meets certain requirements and is appointed based on a work agreement for a predetermined time in order to carry out official duties. And in Islamic law ASN can be equated with tabi'in or followers of ulil amri (government). Which is where followers or workers must always obey their leaders but if it is not in accordance with the existing Shari'a then it may not be followed. And in this case a leader must also fulfill the rights of his followers and equalize all the rights of each of his followers without discriminating between them. This also applies to PPPK, where there are several points that have different rights from civil servants. PPPK differs from PNS in that PPPK does not have pension rights, does not get a promotion pattern and can be dismissed at any time by the relevant agency. So this is the problem in the procurement of this PPPK, namely that there is no more definite labor protection to protect the existence of this PPPK. The problems studied in this paper are regarding the status of the existence of PPPK and regarding labor protection for government employees with work agreements (PPPK). The research method that the author uses is normative juridical, using a law or statute approach. The results of this study are that legal protection for PPPK is still inadequate so that both in PP No. 49 of 2018 and in Law No. 5 of 2014 has not yet detailed the future guarantee of this PPPK. As is well known, PPPK only has the right to old-age security but no pension rights, and also regarding the period of work that can be terminated at any time.

Abstract

Mosques have strategic potential not only as places of worship but also as centres for community economic empowerment. This study aims to analyze the potential, solutions, and strategies for strengthening mosque management in supporting the economic empowerment of surrounding communities through social and cultural approaches. The method used is the Analytic Network Process (ANP), which integrates both qualitative and quantitative approaches, including in-depth interviews, participatory observations, and questionnaires involving religious leaders, cultural experts, mosque administrators, and local business actors. The findings show that the social approach is effective in building trust and community participation, with programs such as charity distribution, healthcare services, economic training, and guidance for converts strengthening solidarity and self-reliance. The cultural approach plays a crucial role in enhancing community identity and acceptance of the mosque. The acculturation of local culture with Islamic values increases the mosque’s relevance in daily life. A successful mosque management model involves visionary leadership, financial transparency, and productive community activities such as cooperatives and MSME bazaars. This study contributes to mosque management by integrating social and cultural approaches through ANP and provides strategic guidance for mosque managers to optimize the mosque’s social, cultural, and economic functions to improve public welfare.
