Abstract

In the management of zakat is necessary for a clear legal umbrella in the form of regulations on zakat which is the foundation in the management of zakat. Along with the times, the existing regulations are sometimes considered no longer accommodate the issue of zakat management in the field, therefore the latest regulations on zakat management are needed. This study aims to try to discuss various legal updates regarding zakat, especially in zakat law. This study uses a juridical-normative approach, which is an approach based on legislation, theories, and concepts related to legal coverage of regulations in the field of zakat. The results showed that there are various regulations on zakat, ranging from ministerial regulations, presidential regulations, government regulations to laws.

Abstract

This article is motivated by the Dutch legal political policy, which is known as the bamboo splitting policy which brings together face to face between customary law, Islamic law and Western law. The Dutch East Indies policy received a response from Muslims, because the Muslim community was actually in direct contact with practices as religious activities in the implementation of their teachings. This article uses a qualitative descriptive approach which is more specifically on historical aspects and uses bibliographic data sources and the type of data is secondary data. In this paper the author results that the interaction of Islamic law with customary law is described in a variety of forms. First, customary law can substantially be accepted by Islamic law as a whole, so that in the future it becomes Islamic law. Second, Islamic law has completely changed customary law, so that the validity of customary law does not apply to the next. Third, Islamic law allows customary law to apply without any effort to inhale it, this is sometimes found in the field of muamalah.Keywords: Dutch East Indies, Islamic Law, Customary Law.

Abstract

This research was motivated by the birth of the job creation law in 2020 which regulates many things including Islamic banking in Article 79. This article adds to the long list of laws and regulations on Islamic banks that have existed since almost 30 years ago (1992). Researchers want to know whether there are significant changes contained by this article and whether the legal politics of Islamic banking has changed with the birth of this job creation law. This research is a type of literature study or in the legal world is called juridical-normative legal research. This study shows that Article 79 of the job creation Law No. 11 of 2020 has a combination of properties between responsive and elitist legal products, built on the desire to develop the Islamic economy as part of National Economic Development. This article contains changes to the maximum ownership of Islamic commercial banks by foreign parties, which was originally in law No. 21 of 2008 regulated by Bank Indonesia regulations, now following the laws and regulations in the field of investment. The legal politics behind the job creation law on aspects of Islamic banking is the same as other aspects, namely inviting investors not only from within but also from abroad to invest in Indonesia. This means that the government wants to open up investment space in the Islamic banking sector wider than ever.

Abstract

Indonesia adalah negara hukum, yang segala sesuatu harus berdasarkan hukum. Namun, dalam pemerintahan suatu negara, hukum kerap dikait-kaitkan dengan politk. Hingga muncul pernyataan “hukum sebagai produk politik”. Sekilas, pernyataan ini kerap menimbulkan persepsi negatif karena posisi hukum disini ditentuan oleh politik, sementara idealnya dalam tataran ideologi hukum, hukumlah yang seharusnya mempengaruhi politik. Tujuan penelitian ini adalah untuk melihat bagaimana hubungan antara politik dan hukum serta bagaimana konsep dan perkembangan politik hukum di Indonesia. Pendekatan penelitian yuridis-normatif, yang didasarkan pada peraturan perundang-undangan, teori-teori, dan konsep-konsep berhubungan dengan cakupan hukum mengenai regulasi dengan mencoba menggunakan metode politik hukum. Hasil penelitian, Pertama, berdasarkan perspektif bahwa hukum adalah produk politik, maka politik hukum dapat diartikan garis resmi yang menjadi dasar pijakan sekaligus cara untuk membuat hukum. Kedua, konsep politik hukum nasional Indonesia setidaknya memuat tiga unsur, yaitu; tujuan  negara yang bernafaskan pancasila dan UUD 1945, pembentukan hukum yang meliputi materi hukum, mekanisme yang sesuai prolegnas, dan peninjauan kembali melalui judicial review serta penegakan hukum baik di lingkungan masyarakat maupun aparat penegak hukum. Ketiga, dalam politik hukum suatu negara, tidak ada satu negara pun yang mengikuti bentuk teoritisnya secara mutlak, dengan kata lain sering terjadi variasi atau perbedaan tergantung tujuan dan keperluan pragmatisnya
