Abstract

This article discusses the Constitutional Court's Decision No. 22/PUU-XV/2017 which equalizes the age limit for marriage in Indonesia. The article employs a normative legal research method with a focus on legislation, analytical, conceptual, and maslahah approaches. The research findings indicate that Constitutional Court Decision No. 22/PUU-XV/2017 is based on philosophical, juridical, and sociological considerations, emphasizing the importance of equal age limits for marriage in Indonesia. Consequently, the phrase "age 16" in Article 7, Paragraph (1) of Law No. 1 of 1974 concerning Marriage is deemed inconsistent with the 1945 Constitution. The equalization of age limits for marriage in Constitutional Court Decision No. 22/PUU-XV/2017 encompasses aspects of maslahah, such as protecting the rights of women who have been marginalized due to differing age limits for marriage between men and women. Moreover, Constitutional Court Decision No. 22/PUU-XV/2017 also promotes the maslahah of gender equality in the legal regulation of marriage in Indonesia.

Abstract

Penelitian ini membahas problematika affirmative action mengenai keterwakilan Perempuan paling sedikit 30% dalam pencalonan anggota legislatif di Indonesia. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan (statue approach), pendekatan analitis (analytical approach), dan pendekatan konseptual (conceptual approach). Hasil penelitian ini menunjukkan bahwa affirmative action dalam keterwakilan Perempuan paling sedikit 30% dalam pencalonan anggota legislatif tidak relevan lagi diterapkan di Indonesia, karena sistem hukum Indonesia telah mengakomodasi hak politik Perempuan dalam pencalonan anggota legislatif. Pada pelaksanaannya, keterwakilan Perempuan paling sedikit 30% dalam pencalonan anggota legislatif justru menimbulkan kompleksitas permasalahan seperti: (1) adanya disparitas dan diskriminasi berbasis gender karena Perempuan diberikan special treatment dalam pencalonan anggota legislatif; (2) melanggar prinsip keadilan, kesetaraan, dan persamaan yang diamanatkan Pancasila dan UUD NRI 1945; serta (3) Partai Politik peserta pemilu hanya mencalonkan perempuan untuk memenuhi syarat prosedural keterwakilan perempuan paling sedikit 30% dalam pencalonan anggota legislatif. Sehingga pengaturan keterwakilan perempuan paling sedikit 30% dalam pencalonan anggota lagislatif idealnya dihapuskan, karena tanpa adanya ketentuan affirmative action tersebut Perempuan tetap memperoleh kesempatan yang sama dengan laki-laki dalam pencalonan anggota legislatif.

Abstract

Sexual rights are fundamental human rights that must be protected and upheld by the state. The state's responsibility in this regard faces specific challenges because the Family Visit Leave (Cuti Mengunjungi Keluarga-CMK) mechanism has not been sufficient to meet the sexual needs of married inmates. Therefore, an alternative mechanism is needed to fulfill the sexual rights of inmates, in the form of providing love rooms (bilik asmara). This research aims to explore the urgency of establishing love rooms for married inmates. The study employs a normative research approach with juridical and conceptual approaches. The findings indicate that establishing love rooms in correctional facilities is urgent to fulfill the sexual rights of married inmates. The provision of love rooms aligns with the second principle of Pancasila, which emphasizes the fulfillment of sexual rights as a commitment of the state to humanize its citizens. Establishing love rooms is also crucial to fulfill constitutional rights of citizens and the state's responsibilities concerning marriage. Ultimately, the provision of love rooms will contribute to maintaining family harmony and meeting the sexual needs of inmate couples.

Abstract

This study examines the influence of data protection regulations in the UU ITE on the collection and use of tax data in Indonesia. The provisions for personal data protection regulated in the IUU ITE, such as the obligation to obtain taxpayer approval and ensure data security, have a significant impact on the process of collecting and managing tax data. Despite the challenges of implementation, strong data protection can increase taxpayer trust and compliance, thereby optimizing state revenue. The study suggests steps that tax authorities can take to collect data effectively while still protecting individual privacy

Abstract

This article discusses the role of attorneys in the process of mediating divorce cases at the Sidrap Religious Court. This study aims to determine the role of attorneys in providing legal assistance in the mediation process of divorce cases so that mutually beneficial agreements are reached for both parties. This study used field research methods with descriptive qualitative through observation, interviews, and documentation studies. The results of this study indicate: First, the role of attorneys in the mediation process of divorce cases at the Sidrap Religious Court is to assist/represent and protect the interests of clients, facilitate effective communication, provide appropriate legal advice, and assist in reaching mutually beneficial agreements for both side. Second, the factors that influence the role of legal counsel in the Mediation Process of Divorce Cases at the Sidrap Religious Court are influenced by two factors, 1). Supporting factors that can influence the role and effectiveness of legal counsel are the legal factors themselves (laws), law enforcement factors, facilities or facilities that support law enforcement, community factors, and cultural factors. 2). Inhibiting factors that influence attorneys in the process of mediating divorce cases at the Sidrap Religious Court, namely community factors or the client itself. Third, the role of attorneys in the mediation process of divorce cases at the Islamic Religious Courts is based on the principles of Islamic family law, namely by understanding and applying the principles of Islamic family law in the mediation process.
