Abstract

Notaris adalah pejabat umum yang berwenang untuk membuat akta otentik sejauh pembuatan akta otentik tertentu tidak dikhususkan bagi pejabat umum lainnya. Tujuan penelitian adalah untuk mengetahui dan mendapatkan pengetahuan yang jelas terkait dengan Kedudukan Akta Notaris dalam pengikatan jual beli hak atas tanah dan Perlindungan hukum terhadap pemenuhan hak para pihak apabila salah satu pihak melakukan wanprestasi dalam perjanjian pengikatan jual beli. Manfaat Penelitian untuk memperoleh pembahasan dari hasil yang sistematis, sehingga sejalan dengan permasalahan yang dibahas, maka yang menjadi titik berat pembahasan dalam penelitian ini untuk mengetahui bersangkut paut dengan kedudukan akta Notaris dalam pengikatan jual beli ha katas tanah. Hasil dalam penelitian ini Dengan adanya undang-undang sebagai kepastian hukum yang melindungi nilai-nilai keadilan terutama bagi pihak yang dirugikan dan bisa diterima sebagai ganti kerugian akibat kelalaian salah satu pihak. Perlindungan hukum terhadap pemenuhan hak para pihak apabila salah satu pihak melakukan wanprestasi dalan pengikatan jual beli sesuai Pasal 1267 KUHPerdata juga menyebutkan mengenai upaya yang dapat dilakukan yaitu, dengan memaksakan pihak untuk memenuhi perjanjian atau membatalkan perjanjian disertai dengan biaya ganti rugi.

Abstract

This study aims to analyze the forms of legal protection provided to copyright holders of batik motifs under Law Number 28 of 2014 concerning Copyright and to examine the effectiveness of dispute resolution through alternative dispute resolution (mediation) in providing legal protection for copyright holders of batik motifs. This research employs a normative legal research method using both a statutory approach and a conceptual approach. The data used in this study consist of secondary data derived from primary, secondary, and tertiary legal materials. Data were collected through library research and analyzed using a qualitative method. The results of the study indicate that Law Number 28 of 2014 concerning Copyright has established a comprehensive legal protection framework for batik motifs as copyrighted works with both cultural and economic value. Such protection is provided through preventive measures in the form of automatic copyright protection upon the creation of a work and copyright registration facilities that serve as important legal evidence. In addition, repressive protection is available through civil lawsuits, criminal sanctions, and out-of-court dispute resolution mechanisms. The study further finds that mediation, as regulated under Article 95 of Law Number 28 of 2014 concerning Copyright, constitutes an effective dispute resolution mechanism in protecting the rights of copyright holders of batik motifs. Mediation not only ensures legal certainty and the restoration of the creator’s economic and moral rights but also preserves harmonious relationships between the parties and supports the protection of cultural values embodied in batik motifs. Therefore, mediation serves as a dispute resolution instrument that is consistent with the principles of justice, legal certainty, and legal benefit in copyright protection for batik motifs.

Abstract

This study aims to analyze the legal protection provided in the implementation of online mutual fund investment services by Digital Mutual Fund Selling Agents (APERD Digital) for investors in the event of system failure or losses caused by technological malfunctions. It also examines the synchronization of regulations governing online mutual fund investment activities to ensure legal certainty for all parties involved. This research employs a normative legal research method using secondary data consisting of primary, secondary, and tertiary legal materials. Data were collected through library research and analyzed using a qualitative approach. The results indicate that the implementation of online mutual fund investment through APERD Digital has expanded public access to investment opportunities while simultaneously creating more complex legal relationships due to the use of electronic systems. Investor protection has been normatively regulated through various legal instruments, including the Capital Market Law, the Electronic Information and Transactions Law, the Consumer Protection Law, the Personal Data Protection Law, and regulations issued by the Financial Services Authority (OJK), which provide both preventive and repressive legal protection. However, this study finds regulatory inconsistencies in the form of overlapping authorities, differences in the regulation of electronic system operators' liabilities, and the absence of explicit provisions governing the liability of APERD Digital for investor losses resulting from system failures. These conditions have the potential to create legal uncertainty, obscure the rights and obligations of the parties involved, and weaken investor protection. Therefore, comprehensive regulatory synchronization is necessary through the harmonization of legal norms, clarification of responsibilities, and strengthening of supervisory and dispute resolution mechanisms in order to establish legal certainty and effective legal protection for investors while supporting the development of a fair and sustainable digital capital market.
