Abstract

Haryono No. 169 Malang e-mail: hafiyyandaffa@student.ub.ac.id Abstrak Permasalahan yang dikaji dalam skripsi ini dilatarbelakangi dengan permasalahan yang belakangan banyak ditemukan pengguna jejaring sosial yang menceritakan alur sebuah film atau storytelling film. Berdasarkan hal tersebut. Skripsi ini mengangkat 2 (dua) rumusan masalah, yaitu : (1) Apakah konten video storytelling film yang berisikan potongan film milik orang lain dapat diberikan perlindungan hak cipta sebagai karya yang dilindungi dalam Pasal 40 Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta, (2) Bagaimana Akibat Hukum pada konten video storytelling film yang berisikan alur cerita dalam film milik orang lain menurut ketentuan Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta. Kemudian penulisan skripsi ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan dan pendekatan analisis. Bahan hukum primer, sekunder, dan tersier yang diperoleh penulis akan dianalisis dengan menggunakan metode penafsiran sistematis dan gramatikal. Berdasarkan rumusan masalah diatas, penulis berkesimpulan dengan disebutkannya karya sinematografi dalam Pasal 40 ayat (1) huruf m sebagai suatu karya cipta yang dilindungi, dengan dibuatnya konten video storytelling atas alur sebuah film, perbuatan tersebut dikatakan sebagai menyalahi hak-hak pemilik hak cipta atas ciptaannya. Kata Kunci: Jejaring social, film, storytelling, hak cipta Abstract This research topic departs from the rising tendency of sharing plots of movies online on movie storytelling, delving more into (1) whether the content of storytelling video involving movie clips owned by others can be protected in terms of copyrights under Article 40 of Law Number 28 of 2014 concerning Copyrights and (2) what is the legal consequence of the video content of movie storytelling containing the plots of movies of others according to Law Number 28 of 2014 concerning Copyrights. This research employed normative-juridical methods and statutory and analytical approaches. Primary, secondary, and tertiary data were analyzed using systematic and grammatical interpretations. The research results reveal that cinematography outlined in Article 40 Paragraph (1) letter m is categorized as a protected creation. Thus, a storytelling video about a plot of a movie is considered to violate the right of the copyright holder. Keywords: social network, movie, storytelling

Abstract

The main function of a brand is to differentiate a company's products. A brand can create a reputation regarding quality, quantity and distinctiveness that is only owned by the party attached to the brand rights which are exclusively owned by the brand holder. However, it cannot be denied that later it was discovered that there were two brands that were fundamentally similar, causing disputes. The aim of this research is to explore the legal certainty of fulfilling a company's registered trademark rights for the existence of substantially similar brands by examining the concept of the element of "substantial similarity" in brands and efforts to overcome the existence of essentially similar brands. The research method used is normative juridical, with a statutory, legal conceptual and case approach. Data comes from secondary data, including primary legal materials, secondary legal materials and tertiary legal materials. Data analysis is descriptive analytical. The results of the research found that the concept of the element of "substantial similarity" in a brand has been regulated in statutory regulations, which shows that legal certainty has been sought. Efforts to overcome legal enforcement of trademark disputes based on similarities in essence which actually injure the actual rights of brand owners can be realized by standardizing law enforcement procedures, strengthening laws and regulations, supervision and outreach. Efforts to overcome this require synergy between the government, law enforcement, brand owners, and even the general public.
