Abstract

Penelitian ini mengkaji tentang Tinjauan Hukum Kinerja Ombudsman Republik Indonesia dan Pelayanan Publik (Studi Kasus Analisis Putusan Rekomendasi Ombusdman RI). pengawasan pelayanan yang diselenggarakan oleh penyelenggara negara dan pemerintahan merupakan unsur penting dalam upaya menciptakan pemerintahan yang baik, bersih, dan efisien serta sekaligus merupakan implementasi prinsip demokrasi yang perlu ditumbuhkembangkan dan diaplikasikan guna mencegah dan menghapuskan penyalahgunaan wewenang oleh aparatur penyeleggara negara dan pemerintahan. Masalah penelitian ini berbicara bagaimana peran Ombusdman RI dalam penyelesaian sengketa pelayanan publik di Indonesia dan bagaimanakah Rekomendasi Ombusdman RI dalam penyelesaian sengketa pelayanan publik di Indonesia. Metode penelitian yang digunakan adalah yurisdis normatif analisi kualitatif. Hasil Penelitian menunjukan bahwa Peran Obudsman RI dalam UU Nomor 37 Tahun 2008 begitu jelas melakukan pengawasan Pelayanan Publik di Indonesia sesuai yang diharapkan. Berdasarkan data yang diperoleh di lapangan baik berupa studi pustaka, hasil observasi dan hasil wawancara terkait peran Obudsman RI dalam pengawasan pelayanan Publik maka selanjutnya data tersebut di analisis sesuai klasifikasi data dengan pertanyaan penelitian dengan tujuan untuk memberikan deskripsi mengenai peran Obudsman RI pengawasan pelayanan public di Indonesia. Sementara itu, Rekomendasi sebagai saran (suggestion). dapat juga berarti nasihat. Hubungan rekomendasi dengan tugas dan wewenang Ombudsman adalah sebagai saran atau nasihat kepada pejabat pemerintahan atau penyelenggara negara tentang apa yang harus dilakukan guna memperbaiki pelayanan yang dikeluhkan masyarakat, baik itu yang sifatnya kasus demi kasus maupun yang sifatnya sistemik. Kata Kunci: Tinjauan Hukum, Ombusdman RI, Pelayanan Publik. Abstract This study examines the Legal Review of the Republic of Indonesia's Ombudsman Performance and Public Services (Case Study of the Decision of the Indonesian Ombusdman Recommendation). supervision of services carried out by state and government administrators is an important element in the effort to create good, clean, and efficient government and at the same time is an implementation of democratic principles that need to be developed and applied in order to prevent and eliminate the abuse of authority by state and government officials. The problem of this research is talking about the role of the Ombusdman RI in the resolution of public service disputes in Indonesia and how the Ombusdman Recommendation RI in resolvingĀ public service disputes in Indonesia. The research method used is a normative jurisdiction of qualitative analysis. The results of the study showed that the role of the Indonesian Obudsman in Law No. 37/2008 was so clear that he carried out public service supervision in Indonesia as expected. Based on data obtained in the field in the form of literature studies, observations and interviews with regard to the role of the Indonesian Obudsman in the supervision of public services, then the data is analyzed according to the classification of data with research questions in order to provide a description of the role of the Indonesian Obudsman in supervising public services in Indonesia. Meanwhile, Recommendations as suggestions. it can also mean advice. The relationship between recommendations and the duties and authority of the Ombudsman is as advice or advice to government officials or state administrators on what needs to be done to improve services that are complained of by the community, both case by case and systemic in nature. Abstract

People's representative institutions in the Indonesian constitutional systemconsist of the People's Consultative Assembly (MPR), the People's RepresentativeCouncil (DPR), the Regional Representatives Council (DPD), the RegionalPeople's Representative Council (DPRD) both provincial and district/city. As apeople's representative institution, members of the MPR, DPR, DPD, ProvincialDPRD and Regency/Municipal elected by the people through general elections.General elections are held in a direct, general, free, secret, honest and fair mannerevery five years. The objectives to be achieved in writing this dissertation are toanalyze and determine the regulation of the tenure of legislative members in theconstitutionalism system in Indonesia and to analyze and find the concept of theterm of office of legislative members in Indonesia in order to enforce theConstituent Principles.This study uses a normative juridical approach that emphasizes libraryresearch. In this research, the Legislation approach, conceptual approach,comparative approach, case approach, historical approach, and philosophicalapproach are used. Types of legal materials used are primary, secondary, andtertiary legal materials. The analysis used is qualitative descriptive analysis.The results show that the House of Representatives is neededlimitation ofterm of office, because the term of office is the same as the term of office of thePresident as stated in Article 7 of the 1945 Constitution. The limitation ofperiodization is meant by considerations: guaranteeing human rights, avoidingarbitrariness of members of the people's representative institutions, creatingthought innovation institutions in institutions people's representatives. The idealconcept of limiting the term of office of the DPR and DPD, it is advisable to revisethe MD3 Law; second, to propose the concept of limiting the term of office ofmembers of the DPR and DPD based on a constitutional democracy perspective, itis advisable to revise the addition of paragraphs in Articles 76 and 252 of the MD3Law, regarding the affirmation of how many years in office are considered one termfor both DPR and DPD. It is also necessary to revise Article 76 Paragraph (4) andArticle 252 Paragraph (5) of the MD3 Law, relating to the concept of limiting theterm of office to only two terms.
