Abstract

The purpose of this paper is to find out more clearly about the position of customary law for the Malay community, which can be said to be all Muslim, by analyzing it through the study of ‘urf in Islamic law. This research is categorized as qualitative research. Qualitative research intends to understand the phenomenon of what is experienced by the research subject, for example, behavior, perception, motivation, action, and others, thoroughly and descriptively in a special natural context by utilizing the scientific method. The findings in this paper are that Malay customary marriage law, which has been practiced so far in Malay countries, is in accordance with Islamic law. The Malay customary marriage law that may be applied is a law that does not conflict with Islamic values, or 'urf al-sahih. Meanwhile, Malay customary marriage law that cannot be applied is a law that is contrary to Islamic values, or 'urf al-fasid, because it can damage the purpose of the shari'a to be passed down (maqashid shari'ah).

Abstract

Islamic Civil Law plays a significant role in regulating social, economic, and religious relations in Indonesia. In the context of rapid social transformation, the application of Islamic civil law within Indonesia’s pluralistic society requires critical examination from both juridical and philosophical perspectives. One of the main challenges lies in ensuring that Islamic civil law remains responsive to dynamic social change while preserving its foundational religious and moral principles. Accordingly, this study aims to analyze the relevance of Islamic civil law in addressing social change in Indonesia and to examine its application through juridical and philosophical approaches. This research employs a qualitative library-based method with normative analysis, drawing on legal literature, scholarly books, academic journals, and other relevant sources related to Islamic civil law and social change in Indonesia. The findings indicate that Islamic civil law remains highly relevant in responding to social change, particularly in the regulation of family relations, economic activities, and social interactions. From a juridical perspective, Islamic civil law demonstrates adaptability in accommodating evolving societal conditions. Philosophically, it maintains a balance between adherence to religious values and responsiveness to contemporary social needs. This combination of juridical flexibility and philosophical consistency is essential to sustaining the effectiveness and relevance of Islamic civil law within Indonesia’s continually evolving social context.

Abstract

The high rate of child marriage in Indonesia and its impact on education, reproductive health, and children’s welfare highlight the importance of regulating the minimum age of marriage based on the principle of child protection. Debates concerning the minimum marriage age also arise due to differing perspectives between Islamic law and national law in determining an individual’s maturity for marriage. This study aims to analyze the minimum age of marriage from the perspectives of Islamic law and national law and to examine its relevance to the principle of child protection. The research employs a normative approach with a qualitative research design through the examination of primary and secondary legal sources, including the Qur’an, hadith, Marriage Law, Child Protection Law, and various international standards and scholarly literature related to children’s rights. The findings indicate that Islamic law does not explicitly determine a specific minimum age for marriage but emphasizes the concepts of baligh (puberty) and rusyd (maturity), which in the contemporary context can be interpreted in line with the objectives of Islamic law (maqāṣid al-syarī‘ah), particularly the protection of life, intellect, and progeny. Meanwhile, national law establishes the minimum marriage age at 19 years for both men and women as a form of child protection and gender equality. This study concludes that the harmonization between Islamic law and national law in determining the minimum marriage age reflects a shared objective of prioritizing the best interests of the child, although its implementation continues to face social and cultural challenges within society. [Tingginya angka perkawinan usia anak di Indonesia serta dampaknya terhadap pendidikan, kesehatan reproduksi, dan kesejahteraan anak menunjukkan pentingnya pengaturan batas usia nikah yang berorientasi pada prinsip perlindungan anak. Perdebatan mengenai batas usia perkawinan juga muncul karena adanya perbedaan pemahaman antara hukum Islam dan hukum nasional dalam menentukan kedewasaan seseorang untu[s5.1]k menikah. Penelitian ini bertujuan untuk menganalisis batasan usia nikah dalam perspektif hukum Islam dan hukum nasional serta mengkaji relevansinya terhadap prinsip perlindungan anak. Penelitian ini menggunakan pendekatan normatif dengan jenis penelitian kualitatif melalui kajian terhadap sumber hukum primer dan sekunder, seperti Al-Qur’an, hadis, Undang-Undang Perkawinan, Undang-Undang Perlindungan Anak, serta berbagai literatur dan standar internasional terkait hak anak. Hasil penelitian menunjukkan bahwa hukum Islam tidak menetapkan batas usia nikah secara eksplisit, tetapi menekankan aspek baligh dan rusyd yang dalam konteks kontemporer dapat dipahami sejalan dengan maqāṣid al-syarī‘ah, khususnya perlindungan jiwa, akal, dan keturunan. Sementara itu, hukum nasional menetapkan usia minimal 19 tahun bagi laki-laki dan perempuan sebagai bentuk perlindungan anak dan kesetaraan gender. Penelitian ini menyimpulkan bahwa harmonisasi antara hukum Islam dan hukum nasional dalam penetapan usia perkawinan memiliki tujuan yang sama, yaitu mengedepankan kepentingan terbaik bagi anak, meskipun implementasinya masih menghadapi tantangan sosial dan budaya di masyarakat]
