Abstract

Adanya Undang-undang Republik Indonesia Nomor 14 Tahun 2008 tentang Keterbukaan Informasi Publik untuk mengetahui dan menganalisis asa transparansi penggunaan dana ress anggota DPRD Kota Kupang maka diharapkan agar masyarakat luas dapat mengetahui apa itu reses dan apa saja yang dilakukan oleh para Anggota Dewan pada masa reses tersebut. Untuk apa dan bagaimana pelaksanaan reses dilakukan dan bagaimana agar masyarakat memahami dan mengerti tentang reses. Metode penelitian ini menggunakan metode penelitian ini adalah kualitatif dengan pendekatan fenomenologi dan sifat deskriptif yang menggambarkan fenomena yang ada berdasarkan kenyataan dalam hal ini menyangkut transparansi penggunaan dana reses anggota DPRD Kota Kupang periode 2019-2024. Hasil penelitian adalah Melalui Pelaksanaan kegiatan reses anggota DPRD Kota Kupang periode 2019-2024 Dapil Maulafa cukup efektif, pertanggungjawaban penggunaan dana reses dan pengawasan pelaksanaan kegiatan reses. Merupakan suatu hal yang bersifat wajib yang telah diatur dalam peraturan perundang-undangan maupun peraturan daerah tidak diatur secara tehnis hanya diatur tentang masa dan batas pelaksanaan reses dan reses dilakukan tiga kali dalam satu tahun. Dampak dari asas transparansi menunjukkan bahwa hasil dan realisasi reses anggota DPRD sudah terakomodir sehingga masyarakat sudah merasakan realisasi dari reses sebagai wadah aspirasi mereka. Fenomena ini menjadikan tingkat kehadiran masyarakat semakin bertambah karena menganggap reses itu penting.

Abstract

Tujuan penelitian ini adalah untuk: pertama menjelaskan fungsi dokumen elektronik sebagai alat bukti oleh hakim dalam pertimbangan Putusan Perkara Pornografi Nomor: 16/Pid.Sus/2021/PN Kupang dan Nomor: 162/Pid.Sus/2021/PN Kupang. Kedua, untuk mengetahui pertimbangan hakim dalam Putusan Perkara Pornografi Nomor: 16/Pid.Sus/2021/PN Kupang dan Nomor: 162/Pid.Sus/2021/PN Kupang. Penelitian ini dilakukan di Pengadilan Negeri Kupang, menggunakan metode literature review yaitu pengumpulan intisari dari dokumen, buku jurnal, majalah, surat kabar, dan sumber yang berasal dari media elektronik atau laporan-laporan yang berhubungan dengan topik yang diteliti di mana teknik analisis bahan yang penulis gunakan adalah teknik analisis deskriptif. Hasil penelitian yang dilakukan penulis menunjukan bahwa: (1) Alat bukti berupa Informasi elektronik dan/atau dokumen elektronik, bisa berdiri sendiri sebagai alat bukti sebagaimana tercantum dalam Pasal 5 Undang-undang Nomor 19 tahun 2016 tentang ITE dan alat bukti yang tidak berdiri sendiri (pengganti surat dan perluasan bukti petunjuk) Pasal 184 ayat (1) KUHAP. (2) Disparitas dalam perkara pornografi Putusan Nomor: 16/Pid.Sus/2021/PN.Kpg di pidana penjara selama 1 (satu) tahun sedangkan Putusan Nomor: 162/Pid.Sus/2020/PN.Kpg dipidana penjara selama 9 (sembilan) bulan. Perbedaan putusan tersebut merupakan pertimbangan hakim dilatar-belakangi oleh rasa keadilan yang berbeda yang kemudian dapat dibedakan sebagai pertimbangan yuridis dan non yuridis.

Abstract

This research analyzes the role of the Kupang Class II Correctional Center (BAPAS) in guiding and developing children in conflict with the law. Using an empirical legal method, the study relies on primary and secondary data. The issue of juvenile delinquency in Indonesia is escalating, with 1,885 cases reported in 2018 and 1,098 in 2020. Notably, children are involved in physical violence (58 cases), sexual violence (44 cases), and theft (22 cases). This highlights the urgent need for institutions like BAPAS to support, develop, and supervise these children. The research addresses two main questions: (1) What is the role of BAPAS in guiding and mentoring children in conflict with the law? and (2) What challenges does BAPAS face in the juvenile justice system? The findings reveal that BAPAS's role is divided into three stages: (a) pre-adjudication guidance and development, (b) support during the trial process (adjudication), and (c) assistance post-trial. BAPAS encounters challenges primarily related to the families of the children, as well as difficulties faced by community guidance officers in providing effective assistance. It is crucial for BAPAS to develop persuasive communication skills to engage families and encourage active participation in the rehabilitation process. This includes involvement in training and understanding the community's role in supporting children in conflict with the law.

Abstract

The purpose of this research is to analyze the return of the examination report (BAP) of the astrid manafe and lael maccabe murder case in the pre-prosecution stage at the East Nusa Tenggara Regional Police of the Republic of Indonesia. This writing is carried out at the Office of the Indonesian National Police of the East Nusa Tenggara Region, related to the topic discussed in this writing. This writing is empirical which uses primary data by conducting interviews with Investigators or Assistant Investigators who handle the murder case. The results of this research show that: (1) The unlimited return of case files from the public prosecutor to the investigator in its regulation by KUHAP, and the absence of sanctions and or legal consequences if the regulated provisions are violated by the investigator causes the slow handling of the case. (2) The lack of adequate support or facilities in the form of highly educated and skilled human resources, good organization, adequate equipment, sufficient finance is the cause of the obstruction of handling these cases.

Abstract

Sexual violence is one form of human rights violations, every degrading, insulting, harassing, and / or attacking the body of the body, and / or a reproductive function of a person is considered a criminal deed. Criminal acts against children become characteristic as a child as a subject that became the focus of the perpetrator in achieving criminal goals. Where the child is part of the young generation that must be protected and expected for the progress of the nation. The purpose of this research: 1. To find out the rights of the rape victim's child in the court of waingapu, 2. To learn legal protection against the rights of the child as a rape victim in waingapu district court. The study was an empirical juxtapossion study involving legal protection against child rape and judicial proceedings at waingapu. The results of this study indicate: 1. Judge's consideration in deciding for the child rape suspect based on ruling number: 79/ pid. SUS /2023/ pn WGP. The two main points for judgment of the judge were, first juridical, in the trial of the law that should be the focus in the verdict of the prosecution's prosecution of the accused, the judgment of the non juridical judge, the judge referring to the conditions of the defendant as referencing the verdict. Two. The kind of protection the rape victim had based on ruling number: 79/ pid. SUS /2023/ pn WGP. Victims have obtained protection such as obtaining a legal escort, during the trial a trial mechanism that guards the child's identity, in addition to child's home-provided child services as a psychic escort. But there are also no optimal countries in providing such protection as access to facilities that should be fast and simple for children.

Abstract

Discipline in education is necessary for students to understand moral and social boundaries. The practice of disciplining (corporal punishment) against students is still debatable. Some people consider it a form of violence against children that contradicts the principles of child protection in Law Number 35 of 2014 concerning Child Protection. A dilemma arises regarding the limits of the teacher's authority in disciplining students and whether these actions can be categorized as criminal acts or are still included in the realm of education. Article 14 of Law No. 14/2005 on Teachers and Lecturers states that teachers have the right to impose sanctions on students who violate norms, rules, and academic ethics. This research is normative research. The results of this research are: (1) The provision of corporal punishment by teachers against students who violate religious norms, norms of decency, norms of politeness, written and unwritten rules set by teachers in the learning process cannot be categorized as acts against criminal law if the corporal punishment carried out by the teacher does not exceed the limits of reasonableness or punishment that is educational in nature in accordance with the teacher's code of ethics. (2) The application of mediation as a form of protection for teachers regulated in Article 4 paragraph 2 of Permendikbud Number 10 of 2017, where mediation is a form of implementation of restorative justice values creating a space for peaceful problem solving that considers the interests of students, teachers and students. Abstract

Tackling pedophilia crimes often faces serious obstacles, especially when the perpetrator has a high social status or strong influence in society. This condition often hampers the law enforcement process, because it is difficult to hold the perpetrator criminally accountable fairly. This research is an empirical legal research by conducting interviews and observing examination files and related documents.The results of this study indicate that: (1) efforts to combat pedophilia crimes that occurred in Oesena Village have not been optimal due to weak coordination between parties. The police are overwhelmed in handling similar cases, while legal aid institutions can only provide assistance without full legal authority, even though they try through social media. As a result, the victims have not received legal justice. (2) the accountability of perpetrators of pedophilia crimes seen from the aspect of justice has not been fulfilled, both legally and socially. Legally, the perpetrators have not received appropriate punishment. This shows that the perpetrators have not been truly held accountable for their actions fairly.

Abstract

The application of restorative justice in cases of sexual violence in Indonesia actually has the potential to cause major losses for victims, resulting in victims not getting the right to recovery for what they experienced and the perpetrators being free from responsibility for the criminal punishment they should receive. This research aims to find out and explain efforts that can be made to prevent and overcome the recurrence of gang rape cases whose investigations have been stopped for reasons of restorative justice. The research method used is Normative Law research which obtains data from secondary data consisting of primary legal material, secondary legal material and tertiary legal material, with systematic identification of Legal Norms. The research results show that the practice of marrying the perpetrator to the victim in rape cases is often considered a form of restorative justice. In fact, the application of restorative justice in cases of sexual violence in Indonesia actually has the potential to cause major losses for the victim. As a result, victims do not get the right to recovery for what they experienced and the perpetrators are free from responsibility for the criminal punishment they should receive. Using crime prevention theory, it was found that the criminal justice process is the key to providing a deterrent effect to criminals or to people who have the potential to commit the same crime, so this process must be carried out well so that the application of criminal law can have an impact on not repeating the same criminal act. by the perpetrator. Settlement of sexual violence cases using peace mechanisms or marrying the victim to the perpetrator is completely unjustified and will always be detrimental to the victim. If victims do not receive the justice they hope for, more victims of sexual violence will be reluctant to resolve their cases through law enforcement mechanisms. It is hoped that the government, especially law enforcement officials, will need to evaluate the provisions for implementing restorative justice in cases of sexual violence and revise technical regulations that strengthen protection and recovery for victims.
