Abstract

Kegiatan jual beli semakin masif dilakukan selaras dengan meningkatnya kebutuhan hidup manusia. Dengan begitu timbul berbagai macam permasalahan yang dapat merugikan beberapa pihak dan menguntungkan pihak lainnya. Kegiatan jual beli ini ini tak terlepas dari peran hukum sebagai alat mencapai keadilan dan menciptakan rasa aman sesuai dengan hak konstitusional bernegara. Salah satu masalah yang sering ditemui adalah ketidak sesuaian informasi aktual yang di sertakan. Dalam kegiatan jual beli terdapat klasifikasi jasa dan produk, dalam penelitian kali ini akan menilik lebih jauh di bagian produk. Oleh karena itu tujuan penelitian ini untuk menilik lebih dalam terkait urgensi penyertaan informasi aktual pada produk yang nantinya akan digunakan oleh konsumen. Penelitian dilakukan dengan metode yuridis normatif, yaitu dengan melakukan penelitian terhadap bahan pustaka terkait, didasarkan pada bahan hukum primer seperti peraturan perundangundangan dan sekunder berupa artikel penelitian. Berdasarkan penelitian yang telah dilakukan, dapat disimpulkan bahwa banyak faktor yang mendorong keharusan produsen menyertakan informasi aktual pada kemasan produk. Hal ini juga guna melindungi hak konsumensesuai UU No. 8 Tahun 1999 tentang Perlindungan Konsumen.

Abstract

As the integration of artificial intelligence (AI) into Indonesia’s rapidly evolving financial sector accelerates, the country faces critical challenges in ensuring legal certainty and protecting personal security. The rise of AI technologies in banking, fintech, and investment platforms introduces new complexities in regulatory oversight, particularly in preventing crimes such as fraud, money laundering, and cybersecurity breaches. This study examines legal certainty in the regulation of AI-related crimes in Indonesia’s banking sector and its implicationsfor personal security. The increasing use of AI in financial services has created regulatory challenges, particularly regarding personal data protection, fraud, and accountability. This research employs a normative juridical method with a statutory approach, analysing relevant Indonesian laws, including the Personal Data Protection Law, the Banking Law, the Electronic Information and Transactions Law, and the Financial Services Authority regulations. The findings reveal a legal vacuum in addressing AI-facilitated crimes, particularly regarding the allocation of responsibility and preventive mechanisms. Although existing regulations provide partial protection, they do not yet accommodate the specific risks posed by AI technologies in banking. This regulatory lacuna threatens legal certainty and personal security, particularly the right to privacy. This study highlights the urgency of developing explicit AI-related criminal laws for the financial sector to balance innovation and protection. This research is limited to doctrinal legal analysis and does not include empirical data, which may be explored in future studies.

Abstract

This paper critically examines the climate justice implications of Indonesia’s decision to relocate its capital from Jakarta to East Kalimantan, exploring the potential risks and benefits through the lens of climate vulnerability and environmental justice. Jakarta has long been grappling with climate-related challenges such as flooding, land subsidence, and rising sea levels, prompting the government to propose a new capital that would be more resilient to climate impacts. However, this relocation raises significant concerns about the environmental and social consequences for the new region, particularly with regard to land use, biodiversity loss, and the displacement of local communities. Using a climate justice framework, this study assesses the equitable distribution of both the benefits and burdens of the capital relocation, questioning whether the needs of vulnerable populations—such as indigenous peoples and rural communities—are adequately addressed. Through policy analysis, interviews with stakeholders, and an exploration of local environmental challenges, the paper explores how the relocation plan may inadvertently exacerbate socio-environmental inequalities. Findings suggest that while the new capital may alleviate some climate pressures in Jakarta, it also presents new threats to the indigenous communities and ecosystems in East Kalimantan, raising concerns about the sustainability and fairness of the relocation. The paper calls for a more inclusive and climate-resilient approach to urban planning that considers long-term environmental impacts and prioritizes the rights of marginalized communities in both Jakarta and East Kalimantan.
