<![CDATA[Abstrak – Penelitian ini bertujuan menjelaskan upaya dan faktor-faktor apa saja yang mempengaruhi penerapan keadilan restoratif terhadap kasus kecelakaan lalu lintas di Kepolisian Satlantas Aceh Tamiang. Hasil penelitian bahwa penerapan keadilan restoratif dalam penyelesaian perkara kecelakaan lalu lintas dilakukan oleh penyidik setelah adanya perdamaian antara pelaku dan keluarga korban. Yang dilakukan sebelum Penyidik mengirim Surat Pemberitahuan Dimulainya Penyidikan (SPDP) ke Jaksa Penuntut Umum sehingga perkara tidak dilanjutkan. Faktor yang mempengaruhi penerapan keadilan restoratif terdiri dari dua faktor yaitu penegak hukum dam hukum budaya masyarakat. Adapun faktor penegak hukum yaitu kurangnya pengetahuan dan pemahaman Penyidik terhadap peraturan perundang-undangan yang berlaku. Faktor budaya hukum masyarakat itu berkaitan dengan nilai-nilai, sikap dan prilaku dalam kehidupan masyarakat sehingga mempengaruhi pengambilan keputusan untuk menyelesaikan perkara kecelakaan lalu lintas yang dialaminya melalui keadilan restoratif. Kepada Penyidik Unit Laka Lantas Satuan Lalu Lintas Kabupaten Aceh Tamiang kiranya dapat meningkatkan pengetahuan dan pemahaman terhadap tata cara penangangan kecelakaan lalu lintas melalui keadilan restoratif. Sehingga penerapan keadilan restoratif dalam penyelesaian perkara kecelakaan lalu lintas dapat dilaksanakan sesuai dengan tata cara penyelesaian perkara berdasarkan ketentuan peraturan perundang-undangan yang berlaku.Kata Kunci: Keadilan Restoratif, Kecelakaan Lalu Lintas. Abstract - This research aims to analyse the efforts and factors that influence the implementation of restorative justice to traffic accident cases at the Aceh Tamiang Police Traffic Unit. The results of this research showed that the implementation of restorative justice in the settlement of traffic accident cases is conducted by the investigators after the initiation of settlement from the perpetrator and the victim's family. This is conducted before the investigator sends the Notification of the Commencement of Investigation (SPDP) to the Public Prosecutor in order to make the case will not be proceded anymore. Several factors that influence the application of restorative justice consist of two factors, namely law enforcement and community culture. The law enforcement factor is the investigator's lack of knowledge and understanding of the applicable laws and regulations. The legal culture factor of the community is related to the values, attitudes and behavior in people's lives so that it influence the decision making to resolve traffic accident cases they encountered through restorative justice. To the investigators of the Traffic Accident Unit, the Aceh Tamiang District Traffic Unit, it is recommended that they should increase their knowledge and understanding in regards of the procedures for managing traffic accidents through restorative justice. So that the application of restorative justice in the settlement of traffic accident cases can be carried out in accordance with the procedure for resolving cases based on the provisions of the applicable laws and regulations.Keywords: Restorative Justice, Traffic Accident.]]>
