Abstract

Restorative justice concept may refer to an alternative process for solving disputes including criminal law violation has been well known in Indonesia. The Act Number 11, 2012 on Juvenile Justice System has acknowledged restorative justice approach as a part of criminal justice system in dealing with a child in conflict with the law. It has become an essential provision in the Act as it provides option for law enforcers to avoid punishing juvenile offenders through traditional criminal approach. This research aims to examine restorative justice for juvenile offenders in Indonesia based on the Juvenile Justice System Act Number 11, 2012 as a form of alternative dispute resolution for juvenile crimes and other related laws and to provide a brief of the implementation of restorative justice in Indonesia that is integrally enforced in Indonesian criminal justice system dealing with a child in conflict with the law. It divides the discussion into two parts restorative justice in the juvenile justice system act 2012 and the implementation of restorative juvenile justice in Indonesia. In order to response to these research aims, this paper employs doctrinal legal research.

Abstract

Since the attack to the World Trade Centre in 11 September 2001, the world has raised their awareness to any of serious allegation of terrorist activities. Many steps have been taken by the United Nations and the states to make such legislatives in their national and international level in order to prevent and combat terrorism. The world really condemns what the terrorist have done and put their maximal effort to punish them as well as to protect the innocence from experiencing such dangerous cause of such activity. The hatred of terrorists brings many actions brought by the nations, especially the United States, as a revenge of the painful feeling of those who were left by the victims. It often leads to the act of torture and inhuman treatment done by the official to the terrorist detainees. This paper will focus on the prohibition of torture and inhuman treatment both in the United States and the United Kingdom and the United States extra-territorial actions in Guantanamo Bay and Abu Ghraib prisons and also the United Kingdom’s extra-territorial conducts in treating prisoners in Iraq in relation to Al-Skeini case. Both actions of the states might be considered as a violation of national and international human rights rules because of the existence of torture in treating the terrorist detainees during their military operations. Therefore, it is important to examine whether human rights law applies extra-territorially to such violations. This study would apply the Convention Against Torture and Other Cruel Inhuman, or Degrading Treatment or Punishment (CAT) 1984, the International Covenant on Civil and Political Rights (ICCPR) 1966 and the Inter-American Commission of Human Rights (IACHR) with respect to the United States actions and the European Convention on Human Rights (ECHR) 1950, the CAT and the ICCPR for the United Kingdom’s actions.

Abstract

Both the GATT and the GATS provisions have the same points of view on defining discrimination as an unequal treatment given to foreign providers compared to treatment given to domestic providers. Discrimination under the national treatment of the GATT and the GATS is considered as a practice that prevents foreign providers from enjoying all comfortable facilities that are given to domestic providers. Non-discriminatory application in both provisions might also be interpreted in the market access issue. Moreover, it is not considered as discrimination of national treatment of both provisions if it concerns on laws, regulations, or requirement regulating the procurement by government agencies. Both provisions use likeness and treatment no less favourable test in order to determine whether or not there is a discrimination against foreign products or services or services suppliers. There are several distinctions of discriminations between the principle of national treatment under the GATT and the GATS. The discrimination under the principle of national treatment of the GATT has general application to all trade in goods. On the other hand, the discrimination under national treatment obligation for trade in services under the GATS only applies if commitments have been scheduled. It can be concluded that the discrimination of national treatment under the GATT and the GATS seems to be de facto discrimination because both provisions do not provide the sufficient measures in order to find a violation. It results from; the GATS national treatment is derived from traditional concepts of the GATT that the application of the national treatment of the GATT is adduced by the GATS.

Abstract

Indonesia has introduced justice collaborator protection as a perpetrator who iscooperating with the law enforcers to probe certain cases. However, the protection of justice collaborator has not been optimal yet including who involved in narcotic cases. This Article aims to review the kinds of law protection for them in Indonesian narcotic cases. This is normative legal research by exploring books, laws, and relevant scientific articles. The protection that are provided are guarantees from physical, soul, and property from the beginning till the end of criminal processes with the conditions that the perpetartor has admitted that he comitted the crime, he is not the principal perpetartor and he agrees to provide information in the trial process. It is suggested that they are comprehensively protected and punished with the probation and the LPSK should be granted wider power and to be more independent body.

Abstract

Even though Law Number 23 of 2004 concerning on the Elimination of Domestic Violence was promulgated fifteen years ago, the number of domestic violence against women has not significantly decreased. The Law has not set concrete actions that may fall under the domestic violence that can be punished, particularly in terms of sexual abuse psychological violence, and negligence in household towards women. This research aims to analyze domestic violence against women in this Law and the conducts that are considered to be domestic violence which is commonly found in daily life in Indonesia. A   purely qualitative research method encompassing document analysis of key documents in Indonesia and the Anti-Domestic Violence Law 2004 is adopted in this paper. The research reveals that This Law is particularly protecting women from household violence in Indonesia. The law has recognized physical violence, sexual violence, psychological violence, and negligence as sorts of domestic violence against women in household although it might find difficult to enforce the law when dealing with marital rape regarding lack of reports from victims and polygamy concerning circumstances that can be used to criminalize the perpetrators.

Abstract

The Declaration of Basic Principles of Justice for Victims of Crime and Abuse of Power (1985) ensures the protection of victims of crime. Basically, the implementation of this international declaration depends on the domestic law of each state. Indonesia has promulgated Act No. 13 of 2006 concerning Witness and Victim Protection (Witness and Victim Protection Act) and its Amendment (Act No. 31 of 2014) to give protection of the victim, although not fully adopted the principles contained in the declaration. This article aims to analyze the protection of the victims under the recent Indonesian victim protection Acts and to examine to what extent the Acts in line with the declaration. It is a normative legal research that collects sources from libraries, databases, and archives. This research suggested that Witness and Victim Protection Act has provided the protection to the victim that is limited to victims of a grave violation of human rights, terrorism, trafficking, torture, sexual crime, and serious assaults in the form of compensation (only for a grave violation of human rights and terrorism), restitution and certain assistances under the auspices of the Witness and Victim Protection Agency (LPSK). However, this Act is not yet fully in line with the Declaration, particularly with regard to the right of victims to be present in the criminal justice process to express their views when it comes to their personal interests.

Abstract

Penulisan ini bertujuan untuk menjelaskan faktor penyebab ketentuan pidana Undang-Undang Nomor 9 Tahun 1961 tentang Pengutipan Uang dan Barang dijalan raya Kota Banda Aceh tidak berjalan sebagaimana ketentuan, faktor penghambat Dinas Sosial dalam menanganai pengutip uang dan Upaya Penanggulangannya. Data dalam penulisan artikel ini diperoleh secara yuridis empiris yaitu dengan cara meneliti bahan kepustakaan atau penelitian terhadap data sekunder dan meneliti dilapangan atau penelitian terhadap data primer. Penelitian Lapangan dilakukan dengan cara melalui wawancara responden dan informan, penelitian kepustakaan dilakukan dengan menelaah buku-buku dan peraturan perundang-undangan. Keseluruhan data kemudian dianalisis dan disajikan dalam bentuk deskriptif. Hasil penelitian menunjukkan bahwa alasan utama Undang-Undng Nomor 9 Tahun 1961 tentang Pengutipan Uang dan Barang tidak berjalan sebagaimana mestinya karena faktor kegiatan pengutipan uang tersebut sudah dianggap biasa oleh pelaku, lambatnya pejabat yang berwenang dalam melakukan pendataan dan dalam menangani pengutip uang, masih rendahnya pengetahuan masyarakat akan hukum, adanya rasa tidak ingin repot dari pelaku atau masyarakat dalam melakukan pengurusan surat izin, faktor datangnya pelaku penngutip uang dari luar Kota Banda Aceh serta faktor adanya pengutipan uang demi kepentingan pribadi.Disarankan kepada Dinas Sosial untuk lebih sering melakukan sosialisasi atas eksistensi Undang-Undang tersebut dan untuk segera memilih Pejabat Penyidik Pegawai Negeri Sipil (PPNS) yang selama ini kosong dan terbatas jumlahnya.

Abstract

Penelitian ini diadakan bertujuan untuk mengetahui perbuatan pornografi terhadap pelaku penggunaan aplikasi streaming bigo live memenuhi unsur tindak pidana pornografi dalam UU ITE dan UU Pornografi dan pertanggungjawaban pelaku tindak pidana pornografi terhadap penyalahgunaan aplikasi streaming bigo live dalam UU Pornografi dan UU ITE. Penelitian ini menggunakan metode normative, dimana data-data diperoleh dengan studi kepustakaan/data sekunder, yaitu dengan membaca dan menelaah buku-buku, peraturan perundang-undangan dan hasil-hasil penelitian sebelumnya. Berdasarkan hasil penelitian yang didapatkan bahwa perbuatan yang ditampilkan penyiar dalam aplikasi streaming bigo live termasuk dalam muatan yang melanggar kesusilaan dan dapat dikelompokkan dalam tindak pidana pornografi, yang mana aksi yang ditampilkan penyiar dalam apikasi bigo live memenuhi unsur-unsur pornografi yang tertuang dalam Pasal 4 ayat (1) UU Pornografi, dan Pasal 27 Ayat (1) UU ITE sebagai pelanggaran terhadap penyiar yang mempertontonkan unsur pornografi. Pertanggungjawaban pelaku dalam UU ITE dan UU Pornografi didasarkan pada asas culpabilitas “tidak dipidana apabila tidak terdapat kesalahan”. Namun hal ini pelaku penyalahgunaan bigo live telah memenuhi unsur kesalahan sehingga pelaku dapat dibebankan pertanggungjawaban pidana padanya. Disarankan kepada pemerintah untuk dapat memperhatikan media sosial yang disalahgunakan masyarakat dan harus memberikan sanksi tegas bagi para pengguna aplikasi bigo live yang melakukan siaran yang mengandung unsur pornografi.

Abstract

Abstrak - Tujuan penelitian ini untuk menjelaskan faktor-faktor terjadinya tindak pidana kejahatan terhadap asal usul perkawinan di Wilayah Hukum Pengadilan Negeri Banda Aceh, alasan hakim memutuskan hukuman yang relatif ringan dan upaya hukum yang dilakukan untuk mencegah terjadinya tindak pidana kejahatan terhadap asal usul perkawinan.Hasil penelitian diketahui bahwa, faktor-faktor terjadinya tindak pidana kejahatan terhadap asal usul perkawinan di Wilayah Hukum Pengadilan Negeri Banda Aceh adalah faktor keluarga yang tidak rukun, faktor internal, faktor pemahaman agama yang kurang, faktor jarak tempat tinggal dan ketidakpahaman hukum.Alasan hakim memutuskan hukuman yang relatif ringan adalah pidana tersebut telah cukup memberikan efek jera, pertimbangan rasa keadilan dan opini masyarakat, pemidanaan bukan semata-mata sebagai pembalasan saja tapi juga bersifat mendidik, efektifitas dan kemanfaatan dari penjatuhan, adanya perdamaian antara pihak, si pelaku baru pertama kali melakukan tindak pidana dan fakta-fakta lain dalam persidangan. Upaya hukumyang dilakukan untuk mencegah terjadinya tindak pidana kejahatan terhadap asal usul perkawinan adalah upaya preventif dan upaya represif. Disarankan kepada masyarakat dapat proaktif ikut dalam penanggulangan masalah tersebut, aparat penegak hukum dapat lebih sering melakukan sosialisasi,pegawai Kantor Urusan Agama diharapkan lebih teliti dalam memriksa data para calon mempelai, dalam pertanggungjawaban pidana terhadap pelaku dijatuhkan lebih berat agar efek jera terhadap si pelaku bisa dirasakan.Kata Kunci : kejahatan, asal-usul perkawinan. Abstract - The purpose of this study to explain the factors the occurrence of a crime against the origin of marriage in the District Court Jurisdiction of Banda Aceh, the reason the judge memetuskan relatively mild punishment and legal efforts are being made to prevent the occurrence of a crime against the origin of marriage.The survey results revealed that, factors of the crime against the origin of marriage in the District Court Jurisdiction Banda Aceh are not pillars of family factors, internal factors, factors that are less religious understanding, the distance factor and the lack of legal residence. The reason the judge memetuskan a relatively light sentence because the judge considers the criminal punishment is adequate to provide a deterrent effect, the judges look at and consider the sense of justice and public opinion, punishment not merely retaliation but also didactic, effectiveness and usefulness of the imposition, the peace between the parties, that the first-time offender with a criminal offense and other evidence in the trial. Legal efforts to prevent crimes against the origin of marriage is the preventive and repressive efforts.Suggested to the society can proactively participate in the response to the problem, law enforcement officers can more often socialize, employees of the Office of Religious Affairs is expected to be conscientious and double check the data of the prospective bridegroom, the criminal responsibility of the perpetrators imposed heavier so that the deterrent effect against the perpetrator could be felt.Keywords : the origin of marriage, crime.

Abstract

Sarang Burung Walet adalah hasil Burung Walet yang sebagian besar berasal dari air liur yang berfungsi sebagai tempat untuk bersarang, bertelur, menetaskan dan membesarkan anak Burung Walet baik yang berada dalam habitat alami maupun di habitat buatan/penangkaran yang potensinya cukup besar diwilayah Kabupaten Aceh Besar dan diharapkan dapat menjadi salah satu sumber pendapatan asli daerah. Tujuan penulisan artikel ini adalah menjelaskan pelanggaran terhadap Qanun Nomor 8 Tahun 2011 Tentang Pajak Sarang Burung Walet di Aceh Besar, faktor penghambat terhadap pelanggaran pemungutan pajak sarang burung walet dan serta upaya yang dilakukan dalam pelaksanaan pemungutan pajak sarang burung walet di Kabupaten Aceh Besar. Metode yang dilakukan menggunakan penelitian kepustakaan dan lapangan. Penelitian kepustakaan dilakukan dengan cara membaca buku-buku teks, peraturan perundang-undangan. Sedangkan penelitian lapangan dilakukan dengan cara mewawancarai responden dan informan. Berdasarkan hasil penelitian dari penulisan artikel ini diketahui bahwa penyelenggaraan pajak sarang burung walet dikabupaten Aceh Besar terdapat wajib pajak yang menunggak pembayaran pajak. Dimana setiap orang yang memeliki usaha sarang burung walet dalam Kabupaten Aceh Besar sudah semestinya membayar iuran pajak usaha sarang burung walet. Hal ini akan menambah manfaat bagi peningkatan perekonomian masyarakat yang berkelanjutan. Disarankan seharusnya dalalm proses penanganan pemungutan pajak sarang burung walet, Diperlukan partisipasi instansi-instansi terkait tidak hanya ada di dalam pelaksanaan penertiban. Hal inidapat membantu penertiban pajak sarang burung walet sesuaidengan tujuan yang ingin dicapai dan selaku instansi yang bertanggung jawab Dinas Pengelola Keuangan dan Aset Daerah membentuk tim lapangan untuk memberikan sosialisasi kepada pemilik usaha-usaha sarang burung walet di Kabupaten Aceh Besar, agar dapat membayar pajak serta menghimbau pemilik sarang burung walet akan denda yang dikenakan apabila tidak dapat membayar pajak dengan tepat waktu.
