Abstract

Mahar merupakan kewajiban suami kepada isteri yang diperintahkan dengan jelas dalam Al-qur’an, hadits, ijma’ dan ketentuan hukum di Indonesia. Ayat al-Quran maupun hadits Nabi tidak menjelaskan batasan minimal mahar. Dalam ketentuan hukum di Indonesia, juga tidak diatur batasan terendah mahar. Pasal 30 Kompilasi Hukum Islam (KHI) menegaskan bahwa bentuk dan jenis mahar disepakati oleh pihak calon mempelai laki-laki dan calon mempelai wanita. Dalam praktiknya, sangat banyak yang memberi mahar sangat murah, bahkan hanya yang membayar mahar berupa sendal jepit ataupun uang Rp100.000,00. Setelah pernikahan berlangsung, pernikahan dengan mahar sangat rendah ini rentan untuk mengalami perceraian,bahkan tak jarang hanya dalam hitungan bulan. Oleh sebab itu, perlu diatur batasan minimal mahar, agar bisa menjadi pengikat tidak terjadinya perceraian dengan mudah. Hal ini tentunya menjadikan maqashid syariah mahar dan pernikahan tidak terwujud. Oleh sebab itu, perlu diatur batasan minimal mahar dalam peraturan perundang-undangan di Indonesia. Penulis menggali ketentuan dan ideal mahar dalam penelitian ini dengan menggunakan metode penelitian hukum normatif. Dapat disimpulkan bahwa sangat perlu ditetapkan standar minimal mahar dalam Undang-undang Pernikahan bagi umat Islam, karena dalam Kompilasi Hukum Islam (KHI) tidak mengatur batas minimal mahar. Namun, KHI sendiri tidak relevan lagi untuk dijadikan dasar memutuskan hukum di Pengadilan Agama termasuk mengatur tentang mahar, karena KHI merupakan Inpres, sedangkan Inpres tidak termasuk dalam produk perundang-undangan yang diatur dalam Pasal 7 ayat (1) Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-Undangan. Untuk itu perlu kajian lebih lanjut dari para ahli untuk menetapkan batasan minimal mahar dengan mempertimbangkan maqashid syari’ah mahar.

Abstract

Abstract This research discusses the regulation of child custody (hadhanah) after divorce in Islamic family law in Indonesia and Malaysia. The main focus lies on the juridical comparison and implementative practices in the two countries that have a background of Islamic law as part of their national legal systems. In Indonesia, child custody arrangements are regulated in the Compilation of Family Law, while in Malaysia it is regulated in the Islamic Family Law Act applicable in each state. This research uses a qualitative approach with a comparative law method and document analysis. The results of this study show that both countries recognize the principle of the best interests of the child as the main basis in determining custody, but there are differences in the decision-making mechanism, the role of Islamic courts, and the implementation of decisions in the field. This research recommends harmonizing the principles of child protection in the Islamic legal system with the development of international child rights to ensure optimal protection for children after divorce. Abstract

This research aims to analyze the phenomenon of divorce triggered by online infidelity (cyber infidelity) or emotional involvement (emotional affairs) within the framework of positive law and Islamic law in Indonesia. In the era of digital disruption, the paradigm of domestic betrayal has shifted from mere physical relations to cyber interactions that violate the principle of loyalty. The research method used is normative legal research with a qualitative approach through library research. The results indicate that although online infidelity often does not reach the stage of physical adultery (intercourse), judges tend to interpret it as a form of continuous dispute and disagreement as regulated in Article 116 letter (f) of the Compilation of Islamic Law (KHI) and Article 19 letter (f) of Government Regulation No. 9 of 1975. The validity of digital evidence, such as WhatsApp screenshots and social media activity, is recognized as legitimate legal evidence under the ITE Law, provided it is not obtained through illegal wiretapping. Regarding the legal implications, online infidelity can influence the determination of child custody (hadhanah) in the best interest of the child; however, it generally does not automatically alter the division of marital property unless there is proof of asset misappropriation for the sake of the affair. This research concludes that there is a need for more specific regulations regarding digital evidentiary procedures in family cases to maintain family resilience in the digital age.
