Abstract

The element of "obstructing or interfering with mining business activities" is the focus of this article, because the editorial has multiple interpretations. Its existence derives two problem formulations, namely (1) What are the problems with elements hindering or interfering with mining business activities?: (2) What is the reformulation that reflects democratic principles? The analytical knife used to examine existing problems through democratic principles. This study uses normative juridical research methods. There are several conclusions related to the problematic presence of elements hindering or interfering with mining business activities, including: first, elements hindering or interfering with mining activities can be directed to actions that can be interpreted differently. Second, these elements can be directed to certain interests. Third, these elements can be subjective. Fourth, it is counterproductive to provisions for environmental fighters who cannot be sued criminally or civilly. The reformulations that are expected to better reflect democratic principles include: first, providing a more detailed explanation regarding the redaction of elements hindering or disrupting mining activities. Second, changing the editorial elements hinders or disrupts mining business activities. Third, remove the redaction elements that hinder or interfere with this mining business activity.

Abstract

The socialization of the law with the theme of Anti-Corruption Character Building found that the participants, inthis case the Daarul Abror Islamic boarding school students, didnot fully know about anti-corruption. The positive impacts of theimplementation of this legal socialization include: (1) knowingthe attitude that is the driving element of anti- corruptionbehavior; (2) know the principles of anti-corruption behavior;(3) knowing the problems that may arise in eradicatingcorruption, so that the community in general and students inparticular can prevent this from happening. The methods usedare: (1) explaining attitudes which are the driving elements ofanti-corruption behavior; (2) Explaining the principles of anticorruptionbehavior; (3) explain the important elements in anticorruptioneducation; (4) The socialization of the law is carriedout in the form of in-depth interactive lectures and discussions atPondok Modern Daarul Abror Kace. The above was done faceto-face at the Daarul Abror Kace Modern Pondok Mosque. Theindicator that we use to measure the success of this outreach is aquestionnaire that we distribute to participants before thisactivity is carried out and immediately after this event.

Abstract

Problematika muncul ketika partai politik memiliki kewenangan yang cukup besar dalam menentukan calon presiden dan calon wakil presiden berdasarkan adanya presidential threshold. Hal ini mendorong terbentuknya koalisi besar antar partai politik yang sering kali tanpa tandingan. Identifikasi masalah yang diangkat dalam artikel ini adalah: Apakah penguatan presidential threshold berdampak pada polarisasi partai politik di Indonesia? dan Bagaimana keberlanjutan sistem check and balances dalam konteks ketatanegaraan Indonesia?, Metode yang digunakan dalam penelitian ini adalah yuridis normatif. Hasil penelitian menunjukkan bahwa presidential threshold memiliki dua sisi kepentingan yang saling terkait, dengan kadar kepentingan yang sama bagi partai politik. Sistem check and balances memerlukan penegasan yang lebih nyata melalui aturan yang ada, karena hal ini memiliki konsekuensi yuridis terkait hubungan timbal balik antar kekuasaan dalam sistem pemerintahan presidensial.
