Abstract

Eksistensi marketplace dewasa ini diakui telah berhasil membantu pelaku Usaha Mikro dan Kecil (UMK) dalam memperluas jejaring bisnis, mendukung keberlangsungan usaha mereka terutama selama masa pandemi Covid-19, serta sekaligus membantu transformasi mereka menjadi UMK digital. Namun di sisi lain, aktivitas belanja daring nyatanya memiliki konsekuensi yang cukup membahayakan bagi lingkungan hidup yang bersumber dari limbah kemasan plastik sebagai dampak dari kegiatan belanja daring. Isu penanganan limbah plastik dari kegiatan belanja daring ini nyatanya masih menemukan banyak celah hukum, baik dari segi efektivitas substansi pengaturan yang ada, hingga implementasi dari peraturan itu sendiri. Penelitian ini akan dikaji dengan menggunakan spesifikasi deskriptif analitis yang akan dilakukan dengan menjabarkan peraturan perundang-undangan terkait, untuk kemudian dikaji bersama dengan teori hukum serta praktik hukum positif yang terjadi. Hasil dari penelitian menunjukkan bahwa bentuk pengaturan dan praktik pelaksanaan tanggung jawab terhadap lingkungan oleh Usaha Mikro dan Kecil (UMK) Digital di marketplace masih cenderung belum sejalan dan berlaku secara efektif. Sama halnya dengan kedudukan marketplace dalam menerapkan kebijakan Green Management kepada Usaha Mikro dan Kecil (UMK) digital yang masih abu-abu, di mana marketplace belum begitu memahami peran dan fungsi penting dari dirinya terhadap kesuksesan dari penerapan konsep manajemen hijau kepada para UMK digital, seperti konsep pertanggungjawaban mutlak (strict liability), dan lainnya. Oleh karena itu, diperlukan adanya aktualisasi nyata dari konsep green management melalui eksistensi regulasi yang memuat berbagai kebijakan untuk memperkuat kedudukan marketplace dalam menginternalisasi konsep manajemen hijau kepada UMK digital

Abstract

Law Number 32 of 2009 concerning Environmental Protection and Management regulates the government has the right to file claims for compensation and certain actions. Minister of the Environment Regulation Number 7 of 2014 concerning Compensation for Environmental Pollution and/ or Damage regulates that environmental compensation costs that have been paid are entered into the Treasury Fund as Non-Tax State Revenue (PNBP). This research identifies the mechanism for using environmental compensation costs, the implementation of Court Decitions containing environmental compensation before Supreme Court Regulation Number 1 of 2023 concerning Guidelines for Adjudicating Environmental Cases, and how this can be a solution to the problem of environmental compensation costs in Indonesia. This research applies a normative juridical approach method using several approaches. The research results show that the environmental compensation costs that have been paid are included in the PNBP, making it difficult to disburse these funds because the long process and the absence of a recovery plan means that the compensation costs charged to the defendant do not have a detailed calculation basis. Supreme Court Regulation Number 1 of 2023 regulates environmental compensation costs are managed in the court clerk's account and lawsuits are required to include a recovery plan.
