Abstract

Street children are one of the complex social issues that demand attention from the government and society. The Social Service has a crucial role in efforts to foster street children to help them overcome the challenges and difficulties faced and provide opportunities for a better life. policies and the role of the Social Service in fostering street children. This research uses the Empirical method to analyze data and information related to policies and programs that have been implemented by the Social Service in an effort to foster street children. The results of the analysis show that the Social Service has several important roles in fostering street children. First, the Social Affairs Office is responsible for collecting data and identifying street children in its area. This data collection aims to determine the number, characteristics, and problems faced by street children in order to design targeted programs. Second, the Social Services Office must organize a rehabilitation program for street children. This program includes care, education, skills training, and psychological support. The main goal of this rehabilitation program is to help street children overcome traumatization, develop their potential, and reintegrate back into society.

Abstract

Tujuan penelitian ini adalah untuk mengetahui perbandingan putusan hakim terhadap putusan indra kenz dan doni salmanan. Untuk mengetahui pengaturan investasi bodong melalui bitcoin dalam hukum pidana. Dalam penelitian ini penulis menggunakan sifat penelitian Deskriptif yaitu penelitian yang bersifat pemaparan, dan bertujuan untuk memperoleh gambaran (deskripsi) lengkap tentang keadaa hukum yang berlaku di tempat tertentu, atau mengenai gejala yuridis yang ada, ada suatu peristiwa hukum tertentu terjadi dalam masyarakat. Metode pendekatan yang digunakan dalam peraturan perundangan-undangan, konseptual dan kasus penelitian ini adalah metode normatif yaitu pengumpulan materi atau bahan penelitian yang ditujukan pada dokumen tertulis, Teknik pengumpulan data yang dilakukan adalah studi kepustakaan kemudian bahan hukum yang digunakan dalam penelitian dikumpulkan dengan melakukan penelusuran dan studi dokumentasi, perpustakaan dan media internet, serta media dan tempat-tempat (lembaga) lainnya yang mengeluarkan serta menyimpan arsip (dokumen) yang bekenaan permasalahan penelitian. Analisis data yang digunakan merupakan analisis secara kualitatif, hasil riset ini menemukan bahwa hukum terhadap investasi bodong dengan skema ponzi di Indonesia. Pelaku dari dari perbuatan tersebut dalam hal ini dapat dijerat dalam beberapa pengaturan yang berlaku di Indonesia yang kemudian berkaitan dengan investasi bodong dengan skema ponzi, yang mana salah satunya dapat dijerat dengan menggunakan Pasal 378 KUHP tentang penipuan dengan pidana paling lama 4 (empat) tahun penjara. Karena dalam putusan tersebut terdapat disparitas dalam penentuan peraturan perundangan terkait dengan putusan 2740 terdapat unsur pencucian uang sedangkan dalam putusan 576 usur pencucian uang tidak ada sehingga menimbulkan perbedaan hukuman dengan kasus yang sama. Disisi lain dalam pertimbangan untuk hal yang memberatkan pada putusan 2740 terdakwa mengajak orang untuk bermalas-malasan untuk mencari uang. Subjektifitas hakim dalam memberikan gambaran terhadap binomo dan quotex terdapat perbedaaan penafsiran (judi dan non judi).

Abstract

Formation of community activity managers of the former national program for rural independent community empowerment into joint village-owned enterprises. To what extent is the effectiveness of the technical guidelines for the formation of joint village-owned enterprises (BUMN Desma) from the community revolving fund activity manager of the former national program for rural independent community empowerment (PNPM Mpd) in its implementation. The results of this study indicate that local governments have not utilized regional autonomy as widely as possible as explained in Law No. 23 of 2014 concerning Regional Government, as evidenced by the absence of appeals or regulations from both provincial and district governments. The elements involved in carrying out their roles according to their respective duties and functions based on the Letter of the Directorate General of Economic Development and Investment for Villages, Disadvantaged Areas, and Transmigration, Number 191/PRI.02/IV/2022 Dated April 06, 2022. There is no common understanding regarding regulations ranging from Law no 11 of 2020 concerning Job Creation, Government Regulation number 11 of 2021 concerning BUM Desa, Regulation of the Minister of Villages, Development of Disadvantaged Regions and Transmigration number 15 of 2021 concerning Procedures for the Establishment of Community Revolving Fund Activity Managers of the National Program for Rural Independent Community Empowerment into Joint Village-Owned Enterprises and Directorate General Letter of Economic Development and Investment for Villages.
