Abstract

Marriage has rules and regulations its implementation. According to Jambi Malay customary law, there are several stages in marriage custom, especially in subdistrict of Muara Tembesi, first introduction period, second preparation period. thirth day scales, fourth betel tanyo Pinang tanyo, fifth tand fill custom lumbago, sixth take delivery customs lumbago, seventh marriages marry, eight old gather, memulang lek pado penangga, ninth Berelek Berkenduri, complain Gather tuo. Next custom marriage is absolutely must be followed by all society of jambi because of the moral sanction if someone doesn’t follow applicable law. The purpose of research is to know the custom marriage of Jambi Malay and position of custom law, especially in subdistrict of Tembesi. research method is Islamic law research, research type used is field research. The research approach used is a normative approach, the problems studied under Islamic law, to underestand the Qur'an, Hadith, and 'Urf in Ushul Fiqh. The research method used is observation, interview, and documentation. Data analysis used is qualitative analysis. Based on the research has done, it can be concluded the marriage custom of Jambi Malay in Muara Tembesi Subdistrict, the analysis of `Urf is shohih custom.

Abstract

Abstract: Being a Muslim who lives in a limited situation is not expected by anyone. However, the reality today is that many Muslims have begun to migrate from one Muslim-dominated area to another non-Muslim-dominated area, either for the sake of continuing their studies or working to support their families. The challenges faced by Muslims in Indonesia are not as complex as Muslims living in Western (non-Muslim) countries, where they are a minority group. They often face various challenges to practice their faith. It takes a full struggle to remain continuous in practicing the teachings of Islam. This paper wants to examine the challenges and problems of Muslim minorities living in Western countries. In addition, it wants to re-examine how the fiqh response provides a solution to the problems that befall Muslim minorities living amid a non-Muslim majority group. There should be someone who pays special attention to this minority problem. On that basis, contemporary scholars think that Muslim minorities get special treatment from the point of view of fiqh. This is because relying on classical fiqh will actually complicate the position of Muslims in Western countries. Therefore, a progressive solution is needed by compiling a new fiqh specifically for Muslim communities in Western countries, namely fiqh al-aqalliyat. Keywords: Minority Jurisprudence, Minority Muslims, and Non-Muslims. Abstrak: Menjadi seorang muslim yang hidup dalam situasi serba terbatas tidaklah diharapkan oleh siapapun. Namun, realitanya dewasa ini banyak sekali umat Islam yang mulai hijrah dari satu wilayah yang didominasi umat Islam ke wilayah lain yang didominasi non muslim, baik untuk kepentingan melanjutkan studi ataupun bekerja mencari nafkah keluarga. Tantangan yang dihadapi oleh umat Islam yang ada di Negara Indonesia tidaklah serumit umat Islam yang hidup di Negara Barat (non muslim), di mana mereka menjadi kelompok minoritas. Mereka sering kali menghadapi berbagai macam tantangan untuk menjalankan keyakinannya. Butuh perjuangan penuh untuk tetap kontinu dalam menjalankan ajaran agama Islam. Tulisan ini ingin mengkaji tentang tantangan dan persoalan muslim minoritas yang menjalani kehidupan di Negara Barat. Selain itu, ingin menelaah kembali bagaimana respons fikih memberikan solusi atas persoalan yang menimpa muslim minoritas yang hidup di tengah-tengah kelompok mayoritas non muslim. Sudah semestinya harus ada orang yang memberikan perhatian khusus terhadap problem minoritas yang demikian ini. Atas dasar itu, para ulama kontemporer berpikir agar muslim minoritas mendapatkan penanganan khusus dari sudut pandang fikih. Sebab, bertumpu pada fikih klasik justru akan merepotkan posisi umat Islam di Negara Barat. Karenanya, dibutuhkan solusi progresif dengan menyusun fikih baru khusus komunitas muslim di Negara Barat, yaitu fiqh al-aqalliyat. Kata Kunci: Fikih Minoritas, Muslim Minoritas, dan Non Muslim.

Abstract

The purpose of this research is to find out about the institutional and operational system of BUMDes based on sharia. This research is also called normative-empirical research, because the focus of this research study is in the form of the concept of economic fiqh law/sharia economic law regarding BUMDes, rules and norms that are backgrounded by observations of phenomenology and field facts that occur. Phenomenology is an approach that seeks to enter into the world of meaning conceptualized in individuals or groups which is then manifested in the form of phenomena. The results of the study show that: 1) in carrying out the sharia-based BUMDes institutions, the thing that is considered by the village government and the community is maslahah al-mursalah which pays more attention to human welfare, especially the village community where the BUMDes is established in order to improve the quality of life of the community. 2) Operationalization of sharia-based BUMDes which is carried out on this sharia-based BUMDes is by using shirkah, ba'i, and mudharabah contracts. This is applied to every existing unit, and is very good to be a model for businesses that want to follow the sharia system in their operations.

Abstract

The background idea for this article arises from the complexity of the Baduy inheritance system which includes elements of custom, tradition and religion in the dynamics of inheritance. Therefore, this article aims to understand how Baduy inheritance law interacts with Islamic law, as well as how changes and adaptations occur in this system. This research methodology uses relevant legal theories, including the Theory of Unwritten Law or Urf theory, the Objectification Theory of Islamic Law by Kuntowijoyo, and Legal Change from Ibn al-Qayyim al-Jauziyah. Data was collected through in-depth interviews with members of the Baduy community, participant observation, and analysis of documents related to positive law and Islamic law. Data were analyzed using an interpretive approach. The research results show that Baduy inheritance law reflects their traditional and religious values, while also interacting with Indonesian positive law in certain respects. The conclusion of this research is that Baduy inheritance law is a real example of legal pluralism in Indonesia. The importance of recognizing and respecting Baduy inheritance law in reviewing Islamic law needs to be considered to maintain cultural and religious diversity in Indonesia.
