Abstract

This research aims to explain the perspective of legal verses in the Qur'an and national positive law against corruption. The type of research is normative juridical with a comparative approach between Islamic law and national positive law which is analyzed using prescriptive analysis. The results of the research show that the Qur'an and national positive law have the same perspective on corruption as a prohibited position-related act. There are several derivations used in the Qur'an that have a connection with corrupt practices, for example ghulul (fraudulent acts), sirqah (theft), betrayal, risywah (bribery), and even hirabah (destroyer of order). According to positive law, corruption is an act against the law with the intention of enriching oneself, others, or which results in harm to the state or the country's economy.

Abstract

This study aims to explain the concept of the Islamic family which is linked to the discourse of gender equality. The type of research is normative juridical with a fiqh approach and statute approach which is analyzed by means of prescriptive analysis. The results of the research found that Islamic family law (both in Islamic fiqh and the Compilation of Islamic Law) has a concept of gender relations that is different from the paradigm built by gender equality activists. This can be seen from the relationship between husband and wife and their respective rights and obligations (including polygamy), the existence of a marriage guardian for female brides (but not vice versa), the requirement of witnesses who count one man to two women, the provision of iddah for a woman whose marriage has ended, to the unequal share of inheritance between men and women where men get a share of two to one compared to daughters.

Abstract

This research aims to explain the perspective of Islamic and national law on pornography. This is a normative juridical research with a comparative approach which is analyzed by prescriptive analysis. The results of the research show that Islamic and national law have the same paradigm towards pornography as a despicable act which is prohibited by sharia and the constitution. There are at least two terms in Islamic law that have intersections with pornography; first, the term aurat, which is a part of the human body that should not be shown or must be covered because it can cause shame (QS.24: 58) and arouse the sexual desires of others who see it (QS.33: 59). Secondly, tabarruj, which describes a person in a dress that tends to be indecent or characterizes the appearance of a dishonorable person. Meanwhile, national law regulates this pornography in several regulations such as Law No. 44/2008 on Pornography; several articles in the Criminal Code; Law No. 32/2002 on Broadcasting; Law No. 8/1992 on Film; Law No. 40/1999 on Press; Law No. 36/1999 on Telecommunications; and Law No.11/2008 on Information and Electronic Transactions.

Abstract

Permasalahan corona virus disease 2019 atau yang dikenal dengan istilah covid 19 masi menjadi sebuah permasalahan besar, dan rumit diselesaikan terutama dalam bidang kesehatan baik secara skalah internasional maupun nasional. Di dalam keadaan yang mendesak ini pemerintah indonesia sudah melakukan berbagai upaya dalam mengurangi penyebaran virus covid 19 di wilayah indonesia, termasuk dengan pengeluaran beberapa aturan hukum dalam keadaan darurat pendemi covid 19.Diantaranya pada tahap pertama tanggal 31 maret 2020 pemerintah mengeluarkan kebijakan hukum mengenai pembatasan sosial berskala besar (PSBB) dalam upaya membantu mengurangi aktivitas masyarakat diwilayah tertentu, kemudian di tetapkan untuk dilaksanakan secara nasional seluruh wilayah di indonesia.Menindak lanjuti semakin banyaknya warga yang menjadi korban pandemi covid 19 pemerintah pusat juga mengeluarkan peraturan baru dalam berupaya membatasi aktivitas masyarakat.Kebijakan baru yang dikeluarkan oleh pemerintah pusat yakni kebijakan pemberlakukan pembatasan kegiatan masyarakat (PPKM), kebijakan ini bertujuan sama untuk mengurangi lonjakan kenaikan angkah positif covid 19 di indonesia.Dalam penerbitan kebijakan baru dalam kondisi darurat covid 19 ini,kebijakan yang dikeluarkan dibarengi dengan sanksi sanksi pidana dan denda bagi masyarakat yang melanggar aturan. Hal ini kerap menjadi topik pembahasan mengenai kepastian peraturan yang dikeluarkan pemerintah.Terutama dalam pemberian keadilan bagi rakyat,karena pada faktanya penerapan kebijakan ini kerap menjadi permasalahan karena dianggap merampas hak rakyat,serta menyulitkan perekonomian rakyat.

Abstract

This paper aims to elaborate on the contextual rituals of Muslims in Indonesia as decreed by Indonesian scholars such as the Indonesian Ulema Council (MUI), Muhammadiyah, and Nahdhatul Ulama (NU) in connection with the Covid-19 pandemic. The type of research used is a literature study with a qualitative approach which is analyzed by means of content analysis. The result of the research is that there is a significant breakthrough in the ritual of worship which has been standard in the doctrine of al-ashlu fi al-ibadah al-tauqif wa al-ittiba'. The breaking of this worship protocol at least occurs in the principle of congregational prayer and its procedures, the use of masks during prayer, the implementation of Friday prayers, Eid prayers, and the organization of the corpse. Meanwhile, Indonesian clerics such as MUI, Muhammadiyah (through the Tarjih Council) and NU (through Bahsul Masail) justified this breach. The maslahah factor in order to avoid the risk of transmitting the Covid-19 virus, is the main reason for the justification of these scholars. This study strengthens the existence of Islamic legal theories which are summarized in the fiqh rules in answering social problems that have a wedge with religious rituals. So it is illustrated that Islamic doctrine is rigid in its provisions but remains flexible in application.

Abstract

This paper aims to explain the practice of pawning in Sariek Laweh, the law on the use of land pawning objects in Minangkabau from the perspective of Islamic scholars, and the solutions of pawning. This research is a field study using a normative approach, which is analyzed using a comparative descriptive method. The results of the study are: that in general, pawning in Minangkabau is carried out with the ability to use the object of land pawning and to take all the proceeds by the pawn holder. This applies until the mortgagee is able to pay off the debt. Scholars have different opinions regarding the use of pawn objects by pawn holders, the majority (jumhur ulama) forbid it. The second opinion (minority) says that it is permissible to take advantage of the pawn object, but there are still provisions in this matter. Based on the findings of this study, the practice of pawning in Sariek Laweh is not in accordance with the provisions of the Islamic Sharia which are seen from various schools of thought, apart from the element of exploitation of the pawn holder, the mortgagee does not receive any compensation from the goods used, other than fixed loan funds which must be paid according to the amount of the initial loan, without any reduction, also because there are conditions for taking benefits included in the contract, all schools of thought agree that this practice is not permissible. Regarding the pawning solution, it is in the form of musyarakah between the pawn holder and the owner of the pawn object. The pawn holder processes and takes the proceeds with a sharing system with the land owner.

Abstract

This paper aims to analyze the position of Islamic law in the national legal system during the democratic transition (2001-2004), which was led by Megawati Sukarnoputri. Although she and the supporting party she led (PDIP) are often associated with secularism (at least considered insensitive to the problems of Muslims), during her reign from 2001 to 2004 several regulations were born that accommodated the interests of Muslims in the form of laws. This study uses a normative research method with primary-based secondary data sources. This study found that of the 126 laws that were legislated during the 2001-2004 transitional government, fourteen of them had intersections with the interests of Muslims which were accommodated in two patterns; first, formalist accommodation where the law strengthened the enactment of Islamic law for Muslims in Indonesia, such as Law No. 18 of 2001 concerning Special Autonomy for the Province of NAD; Law No. 18 of 2003 concerning Advocates, and so on. Second, accommodation in the form of substantive laws that are in line with Maqashid Shari'ah or at least do not contradict Islamic teachings as illustrated in Law No. 20 of 2001 concerning Amendments to Law No. 31 of 1999 concerning Corruption, Law No. 30 of 2002 concerning the Corruption Commission, Law No. 23 of 2002 concerning Child Protection, and others.
