Abstract

The article attempts to analyze Fiqh of Priority as an instrument of ijtihâd maqâṣidî from Yûsuf al-Qarâḍawî’s perspective and its significance within the contemporary era. The position of the Fiqh of Priority within the study of Islamic law is a part of the conceptual developments of ijtihâd which is based on maqâṣid al-sharî‘ah and has been oriented into Fiqh of Daʻwah. The Fiqh of Priority along with its principles can be functioned as a reference in stipulation of the Islamic law (ijtihâd al-ah}kâm). This is because the Fiqh of Priority is built on the priority values revealed in al-Qur’ân and mentioned in H{adîth as well as based on the concept of tadarruj al-ah}kâm (gradation of stipulation of the Islamic law) during the Prophet Muhammad’s lifetime. Epistemo-logical framework of the Fiqh of Priority consists of three main principles, i.e. the principles of gradation in the Islamic law (al-fiqh bi marâtib al-a‘mâl), the principles of attitude towards the reality of law (fiqh al-wâqi‘ li al-ah}kâm), and the principles of dealing with contradiction between arguments or reasoning between the stipulation of law and social reality

Abstract

From 2020 to 2022, Sidoarjo Regency has identified a surge in family conflicts triggered by wives' protests. Evidence includes an increase in divorce filings, child neglect, and internal family conflicts due to frustration. Therefore, it is necessary to educate the community through outreach activities on building family resilience, emphasizing the role of the wife in the family. Islamic family law based on maqasid al-Shari'ah was chosen as the outreach material because it is relevant and more acceptable to the wives in Sidoarjo Regency, the majority of whom are Muslims. The organized young mothers of Fatayat NU were selected as the target audience. The service method used was service learning, an approach that combines academic teaching with finding appropriate problem-solving solutions for the community. The results of this community service showed an increase in understanding among the young mothers of Fatayat NU in Sidoarjo Regency about strategies for building family resilience through the role of the wife post-pandemic, based on the concept of Islamic family law rooted in maqasid al-Shari'ah.

Abstract

Family waqf is oriented towards realizing family welfare in a sustainable manner, as the realization of the purposes of Shari'a Hifdz al-Nasal. The condition of families in Indonesia after the Covid-19 pandemic has experienced many resilience problems, so rescue efforts are needed. Using normative legal research methods, qualitatively, this research finds a synergy between family waqf and the concept of family resilience which is recognized in Indonesia, through five components: (1) legality and family integrity foundations, (2) physical resilience, (3) economic resilience ; (4) psychological social resilience (5) socio-cultural resilience. Useful research shows strategic steps in efforts to build families in Indonesia so that they have sustainable resilience

Abstract

The purpose of this study was to reveal the wisdom value of ruwat sukerta in the Javanese marriage tradition that still survives today. Ruwat sukerta is still believed to be able to prevent married couples from bad luck and is able to create a harmonious family. The subjects of the study were the semi-urban Muslim community in Sampangagung Village, Kutorejo, Mojokerto. The research analysis used Clifford Geertz’s symbolic interpretation theory and Zainab al-’Alwani’s Muslim family resilience theory. This field research used a qualitative approach with descriptive data presentation. The results of the study: (1) Ruwat sukerta in the Javanese Muslim community is still practiced and has shifted from traditional rites to religious ceremonies in the form of a walimah procession (a wedding celebration held after the marriage contract), wedding reception, thanksgiving and joint prayer; (2) The practice of ruwat sukerta still represents local wisdom that can encourage the realization of Muslim family resilience in strengthening the legal basis of marriage, economic resilience, psychological resilience, and socio-cultural resilience of the family.
