Abstract

Haryono No. 169 Malang e-mail: radyananda_argo@student.ub.ac.id Abstrak Penelitian ini dilatarbelakangi oleh ketimpangan ekonomi yang mengakibatkan aktivitas perekonomian pada bidang informal seperti berjualan menjadi upaya untuk mengatasi hal tersebut. Namun, para pedagang yang berjualan tersebut telah melanggar ketentuan pada Pasal 8 Ayat (1) Huruf K Peraturan Daerah Sidoarjo Nomor 10 Tahun 2013 tentang Ketertiban Umum dan Ketentraman Masyarakat, yang di dalamnya mengatur ketertiban usaha dan mengatur tempat-tempat yang dapat dijadikan tempat usaha. Hal ini terlihat dari Pedagang Kaki Lima (PKL) yang menempati jalur pejalan kaki yang seharusnya menjadi tempat pejalan kaki, perubahan fungsi pedestrian ini menyebabkan kemacetan dan mengganggu jalan protokol di Sidoarjo. Tujuan penelitian ini ialah untuk mengetahui unsur apa yang melatarbelakangi para PKL dalam melakukan pelanggaran Pasal 8 Ayat (1) huruf K Perda Kab. Sidoarjo Nomor 10 Tahun 2013 Tentang Ketertiban Umum dan Ketenteraman Masyarakat serta bagaimana upaya penegakannya yang sesuai dengan prinsip humanis dan memberdayakan masyarakat. Penelitian ini menggunakan metode sosio legal dengan pendekatan yuridis sosiologis yang bertujuan memperoleh pengetahuan hukum dengan terjun langsung ke objek penelitian tersebut. Hasil penelitian disimpulkan bahwa Teori efektivitas hukum yang dikemukakan oleh Soerjono Soekanto bisa digunakan untuk membuktikan tentang implementasi Perda No. 10 tahun 2013 Kabupaten Sidoarjo tentang ketertiban umum dan ketentraman pada pada PKL di Sidoarjo yang dinilai masih belum berjalan efektif, sebab ditemukan masih begitu banyak PKL yang tetap berjualan di sepanjang jalan. Pengenaan sanksi denda yang diberikan juga tidak dapat memberikan efek jera bagi para pedagang yang melanggar meskipun sebelum dikenakan denda, dagangan mereka disita terlebih dahulu dan mengikuti sidang di waktu yang telah ditentukan. Kata Kunci: implementasi, pelanggaran, sanksi, penataan, pemberdayaan Abstract This research departed from the imbalanced economy that indicates that selling seems to be the solution to this economic problem. In the case studied, street vendors have violated the provision of Article 8 Paragraph (1) Letter K of Regional Regulation of Sidoarjo Number 10 of 2013 concerning Public Order and Peace, which regulates business order and the management of venues available for selling. Street vendors are found to set their goods along sidewalks, causing traffic congestion in the area and along major arterial roads in Sidoarjo. This research aims to find out the causal factors of this violation of Article 8 Paragraph (1) letter K of Regional Regulation of Sidoarjo Number 10 of 2013 and what measures can be taken to enforce the regulation according to humanistic and empowerment principles. This research employed a socio-legal method and socio-juridical approach to gain legal knowledge. It required the direct involvement of the researchers in the field being researched. The research results reveal that the theory of the effectiveness of law by Soerjono Soekanto can serve as the basis for proving the implementation of the Regional Regulation concerned, which has not been effective, considering that there are street vendors operating their businesses along sidewalks and the sides of the roads. Fines preceded by confiscation imposed failed to deter the vendors concerned. Keywords: implementation, violation, sanction, management, empowerment

Abstract

Bankruptcy of State-Owned Enterprises (BUMN Persero) The chosen theme is motivated by the absence of regulations regarding limitations on bankruptcy petitions for BUMN Persero, which has caused differences in opinion leading to legal deviations in practice. Regulations on bankruptcy petitions for BUMN Persero can serve as a reference, but they must still be adjusted considering the fundamental special characteristics of BUMN. The legal materials obtained by the author will be analyzed using descriptive and evaluative analysis techniques. In this regard, the author collects legal materials such as legislation and also conducts source searches on the internet by accessing official sites like e-books, e-journals, or official articles published online. Based on the research using the above methods, the author finds that there are philosophical, juridical, and sociological urgencies that make regulations regarding bankruptcy petitions for BUMN Persero necessary. These regulations aim to prevent misinterpretations concerning the parameters of limitations on BUMN operating in the public interest sector, and banking regulations for BUMN Persero can prevent differences of opinion that result in legal deviations in practice. Law No. 37 of 2004 regulates bankruptcy of BUMN but does not clearly regulate bankruptcy petitions specifically for BUMN Persero, so it requires revision or additions. However, this law can be used as a reference in analyzing bankruptcy regulations for BUMN Persero. There are two models of bankruptcy petitions depending on the legal subject or the status of the company being petitioned for bankruptcy. It can be understood that bankruptcy petitions for BUMN Perum are filed by the Minister of Finance, whereas for BUMN Persero, if 100% or the entire share ownership is held by the State, the Minister of Finance can file the bankruptcy petition. However, if this is not applicable, the Bankruptcy Law does not apply because the Minister of Finance acts as the manager of State Assets.
