Abstract

MT Haryono No. 169 Malang e-mail: amaraayu@student.ub.ac.id Abstrak Perkembangan ilmu pengetahuan di era globalisasi berkembang semakin pesat terutama di bidang teknologi dan informasi. Dengan hadirnya internet, terdapat banyak fasilitas yang memberikan kemudahan pada kehidupan sehari-hari. Dengan internet, kehidupan kita saat ini telah bergeser ke dunia maya yang sebagian besar online. Media sosial merupakan salah satu platform dimana kita dapat membuat dan berbagi dalam jejaring sosial. Munculnya media sosial berfungsi untuk meningkatkan konektivitas, aksesibilitas dan visibilitas. Hadirnya media sosial menambah ide baru bagi pelaku usaha bisnis untuk mengembangkan bisnisnya melalui media sosial. Namun, sosial kini menghadirkan tantangan baru dalam perkembangan teknologi masa kini mengenai perlindungan bagi pemilik nama pengguna media sosial, yang dapat disebut juga dengan Username Squatting. Perlindungan hukum bagi pengguna media sosial atas tindakan penggunaan username tanpa hak belum diatur dalam peraturan perundang-undangan di Indonesia. Dengan demikian, terjadi kekosongan norma dikarenakan ketiadaan norma hukum dalam pengaturan perlindungan hukum mengenai username squatting. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis perlindungan hukum bagi pengguna media sosial atas tindakan penggunaan username tanpa hak serta untuk mengetahui dan menganalisis perlindungan hukum bagi pengguna media sosial atas tindakan penggunaan username tanpa hak di Indonesia. Hasil dari penelitian ini, penulis merekomendasikan agar dapat menambahkan eksekusi berupa menjamin adanya username transferability sebagai upaya pemulihan atas tindakan penggunaan username tanpa hak. Dengan demikian, bagi korban atau pihak yang dirugikan dapat mendapatkan username yang seharusnya menjadi hak mereka. Kata Kunci: legitimate interest, username squatting, media sosial Abstract The development of information technology triggers science development. The Internet provides facilities that lead to easier lives people can enjoy on a day-to-day basis. Simultaneously, the Internet has also made all activities go online. Social media are the platforms where we can share socially online, but it does not come without another issue, where username squatting is getting common in this cyber world. Social media enhance connectivity, accessibility, and visibility and give new ideas for businesses to keep growing on social media. However, social media now bring about new issues to tackle in the current development of technology, particularly regarding legal protection for usernames on social media over username squatting, and this protection is not regulated in the legislation in Indonesia, leaving legal loopholes in the matter. This research employed a normative legal method to find out and analyze legal protection for social media users over username squatting and to find out and analyze legal protection for social media users over username squatting in Indonesia. This research recommends that aspects guaranteeing username transferability be added as a recovery attempt over username squatting. This is intended to ensure that the aggrieved parties can gain their usernames appropriately. Keywords: legal protection, social media, username squatting

Abstract

Acquiring land rights can be accomplished through various legal acts, one of which involves buying and selling. This research aims to examine the efficacy of guaranteeing debts and receivables through a binding sale and purchase agreement for both debt providers and recipients, as well as to analyze the legal protection afforded to them through such agreements. The research utilizes a normative legal research approach, employing both statutory research and a conceptual framework, and relies on secondary data sources such as statutory regulations, books, and scientific journals. The results of this research indicate that the strength of proof of guaranteeing debts and receivables through a binding sale and purchase agreement for the debtor and debt recipient is invalid and cannot serve as the basis for transferring land rights, except by a PPAT deed or auction. Furthermore, legal protection for guaranteeing debts and receivables cannot be obtained through a valid sale and purchase agreement for the debt provider and the debt recipient. Appropriately, debt and receivable agreements should be guaranteed using mortgage rights.
