Abstract

This research explores the concept of usury, which refers to the practice of giving or taking interest or profits which is prohibited in Islam, and its implications for the economic growth of Muslims. The concept of usury has a significant impact on the people's economy, including economic injustice, restrictions on productive investment, as well as its impact on sharia banking and foreign investment. The practice of usury can also dampen entrepreneurship and change consumption patterns. This research uses a descriptive qualitative approach, the data used is secondary data obtained from journal articles, books and other related information. The results of this research are that in the Qur'an, usury is strictly prohibited. The prohibition of usury in Islam is based on moral and humanitarian considerations, with the aim of eliminating economic practices that give rise to oppression and injustice (Al-Qur'an Surat Al-Baqarah [2]: 275, 278-279; Surat Ar-Rum [30]: 39)

Abstract

The Nias community is unique and has a different cultural culture from other regions in North Sumatra. One of the unique things done in the traditional celebration of marriage/wedding by doing activities in the form of dances is called Maena. Maena is a traditional Nias dance with a simple movement pattern that is easy to learn. Maena is usually performed by a group of Sanötöi Maena (poet/singer) and ono maena (dancer). The research gap of this study is to focus on applying the value of local wisdom and religious values to the BNKP worship system on Nias, which has never been studied by previous research. The research was conducted in Gunung Sitoli, Nias Island, North Sumatra. The theoretical framework in this research is ethnography and data collection techniques use observation, interviews, video documentation and content analysis. Additional data information was obtained through observations and interviews with the Nias community. The traditional dance in the offering procession during worship at BNKP is a combination that creates a combination of local wisdom by involving culture by providing elements of a blend of church music so as to instill familial religious values at BNKP. Maena is the choice in the process of adopting local wisdom involved in worship at BNKP. The people of Nias feel inner satisfaction when they participate in making foot and hand movements and singing maena songs, this is a form of joy.

Abstract

Premarital screening remains voluntary in Indonesia, creating a policy gap in preventing hereditary diseases such as thalassemia despite increasing public health concerns. This study aims to analyze the politics of Islamic law regarding the institutionalization of premarital screening within Indonesia's national legal system by integrating the Health Belief Model (HBM) and the maqāṣid al-sharīʿah framework. This research adopts a qualitative socio-legal methodology that brings together doctrinal legal inquiry and empirical findings gathered through interviews with prospective marriage partners and key stakeholders. The findings demonstrate that public acceptance of premarital screening is strongly influenced by perceived susceptibility, perceived benefits, and health awareness as conceptualized in the Health Belief Model. From the perspective of Islamic legal politics, mandatory premarital screening represents a preventive legal policy that promotes the protection of life (ḥifẓ al-nafs) and lineage (ḥifẓ al-nasl), while also supporting the protection of intellect and property. The study further argues that institutionalizing premarital screening can be achieved through coordinated legal reforms involving the executive, legislative, and judicial branches. Although premarital screening is generally categorized within maqāṣid al-ḥājiyyāt, its strategic role in preventing genetic disorders justifies stronger legal intervention. This study contributes theoretically by integrating public health behavior with Islamic legal politics and offers practical recommendations for strengthening Indonesia's marriage and public health policies.

Abstract

Conflicts over the establishment of places of worship remain a recurring social issue in Indonesia’s multicultural societies, including the conflict regarding the construction of the Gereja Kristen Protestan Indonesia (GKPI) church in Lohsari Hamlet, Kampung Rakyat District, South Labuhanbatu Regency. This study aims to analyze the negotiation process in resolving the conflict over the establishment of the GKPI church and to identify the actors, strategies, and factors that influence the success of the negotiation process. This research employs a qualitative approach with data collection techniques including in-depth interviews, observation, and documentary analysis. The results show that the negotiation process involved various parties, including church administrators, community leaders, religious leaders, the village government, and security officials. The negotiations were conducted through dialogue, deliberation, and mediation by emphasizing the principles of tolerance, compliance with regulations, and efforts to maintain social stability. Although the process faced several obstacles, such as differences in perceptions and interests among the parties involved, the negotiation process was able to prevent the conflict from escalating and create opportunities for compromise. This study concludes that inclusive negotiation based on participatory communication plays an important role in resolving conflicts related to the establishment of places of worship in pluralistic societies.

Abstract

This study aims to analyze the implementation of direct and indirect regional head elections based on Indonesian legislation and to examine both mechanisms from the perspective of siyāsah dustūriyyah. This research employed a normative legal research method using statutory, comparative, and conceptual approaches. The legal materials consisted of primary, secondary, and tertiary sources, which were analyzed qualitatively through library research. The findings indicate that the mechanism for regional head elections under Article 18 paragraph (4) of the 1945 Constitution of the Republic of Indonesia constitutes an open legal policy, allowing either direct elections or indirect elections through the Regional People's Representative Council (DPRD). However, under Law Number 10 of 2016, the prevailing mechanism remains direct regional head elections, providing direct political legitimacy from the people. From the perspective of Siyāsah Dustūriyyah, both mechanisms are acceptable as long as they uphold the principles of shūrā (consultation), al-'adl (justice), al-amānah (trustworthiness), and maṣlaḥah (public interest). Nevertheless, direct regional head elections are considered more relevant to the principle of popular sovereignty in the current Indonesian constitutional system, while indirect elections may only reflect the concept of ahl al-ḥall wa al-'aqd if conducted by representative institutions possessing integrity and prioritizing public welfare.

Abstract

Kecelakaan kerja merupakan salah satu masalah yang sering terjadi pada pekerja bengkel las dan dapat dipengaruhi oleh perilaku kerja yang tidak aman (unsafe action). Penelitian ini bertujuan untuk mengetahui hubungan perilaku dengan kecelakaan kerja pada pekerja bengkel las di Kota Tebing Tinggi. Penelitian ini menggunakan metode kuantitatif dengan desain cross sectional terhadap 46 pekerja bengkel las. Data dikumpulkan menggunakan kuesioner dan dianalisis secara univariat dan bivariat. Hasil penelitian menunjukkan bahwa sebagian besar responden memiliki perilaku tidak aman sebanyak 24 orang (52,2%) dan pernah mengalami kecelakaan kerja sebanyak 28 orang (60,9%). Jenis kecelakaan yang paling banyak dialami adalah terbentur, tergores, terpotong, dan tertusuk. Hasil analisis menunjukkan terdapat hubungan antara perilaku dengan kecelakaan kerja pada pekerja bengkel las di Kota Tebing Tinggi (p-value < 0,001; PR = 5,500), yang menunjukkan bahwa pekerja dengan perilaku tidak aman memiliki risiko/prevalensi mengalami kecelakaan kerja 5,5 kali lebih besar. Dalam perspektif Islam, menjaga keselamatan diri merupakan bagian dari upaya menghindari perbuatan yang dapat membahayakan diri, sebagaimana dijelaskan dalam QS. Al-Baqarah ayat 195 berdasarkan Tafsir Ibnu Katsir. Disarankan kepada pemilik bengkel untuk meningkatkan penerapan SOP dan mewajibkan penggunaan APD secara lengkap, serta kepada pekerja agar lebih mematuhi prosedur keselamatan kerja guna mengurangi risiko kecelakaan kerja.
