Abstract

Perlindungan terhadap hak cipta sangat penting terutama bagi negara-negara berkembang di masa depan. Karena merupakan instrument baru yang patut dikelola dengan baik. Hak Cipta merupakan salah satu hak kebendaan bergerak yang tidak berwujud (intangible assets). Dalam hal ini, hak cipta mempunyai hak ekonomi dan dapat memberikan keuntungan secara finansial, maka hak cipta dapat dijadikan objek agunan perbankan. Penelitian ini menggunakan penelitian hukum doctrinal melalui pendekatan kualitatif dengan memanfaatkan data sekunder sebagai data utama berdasarkan penelusuran literatur. Sumber data penelitian adalah peraturan perundang-undangan, teori dan konsep-konsep hukum yang relevan. Data dianalisis menggunakan metode yuridis kualitatif dan penarikan logika berpikir deduktif. Hasil penelitian menunjukan masih ada tantangan dalam pelaksanaan pengikatan hak cipta sebagai agunan kredit perbankan seperti tantangan tantangan belum adanya peraturan pelaksana yang lebih rinci antar instansi terkait, belum adanya lembaga penilai hak cipta yang efektif dan sistem deklaratif menentukan siapa yang berhak sebagai Pemberi Fidusia. Maka kedepan diperlukan Langkah strategis yang tepat berupa tindak lanjut dari aspek teknis, regulatif, administratif dan implementatif berupa pembentukan formulasi skema pembiayaan berbasis KI sehingga memberikan kepastian hukum dan perlindungan hukum bagi para pihak serta koordinasi dan sinergi antar kementerian dalam pengikatan hak cipta sebagai agunan kredit perbankan di Indonesia.

Abstract

This research aims to determine the legal nullity of fintech-based online loan agreements as well as forms of legal protection for debtors who enter into fintech-based online loan agreements. This research method uses normative legal research. This data is filtered through records in primary and secondary law, meaning studying and investigating several material materials such as journals, literature and statutory regulations. After collecting the material, then analyze the material using qualitative descriptive methods. The results of this research reveal that financial technology (Fintech)-based online agreements are invalidated if the agreement does not adhere to the basis of Article 1320 of the Civil Code and Article 47 paragraph (2) of Government Regulation Number 82 of 2012 concerning the Implementation of Electronic Systems and Transactions (PP PSTE). Then the form of legal protection for creditors who enter into online loan agreements based on financial technology (Fintech) consists of preventive legal protection and repressive law.

Abstract

The structure of joint property divided governed by Law No. 1 of 1974, and the Compilation of Islamic Law must fully reflect the importance of justice and legal clarity. Based on that, the issue addressed in this journal is how to design a more reasonable and legally specific partition of the joint property after divorce for the community in the relevant marital law in the future. This study is categorized as legal-normative research. According to the study's findings, the future concept of joint property law reconstruction is to incorporate the principle of balanced justice based on Pancasila into Article 37 of Law Number 1 of 1974 concerning Marriage and Article 97 of the Compilation of Islamic Law through amendments to Article 37 of Law Number 1 of 1974 and Article 97 of the Compilation of Islamic Law. The notion of balanced justice has been found in various Republic of Indonesia's Supreme Court decisions. As a result, some of the legal rules in the joint property decision must be reviewed while developing joint property law regulations.
